THE RECORDED PLAT DOCUMENT DID NOT CLEARLY IDENTIFY ALL DIMENSIONS THROUGHOUT THE PLAT AND THEREFORE RESULTED IN VARYING ASSUMPTIONS BY THE PUBLIC. UPON REVIEWING THE ORIGINAL SURVEYOR NOTES AT THE REGISTER OF DEEDS THAT ACCOMPANIED THE PLAT, I REACHED THE FOLLOWING CONCLUSIONS RELATED TO A FEW MEASUREMENTS IN QUESTION. ALLEY WIDTH - THE ORIGINAL NOTES INCLUDED A MEASUREMENT OF 1337 FEET ALONG THE SOUTHERN BOUNDARY ("40" LINE) THAT I BELIEVE WAS HISTORICALLY OVERLOOKED. LOT LENGTHS OF 132 FEET ALONG THE SOUTHERN BOUNDARY AND RIGHT OF WAY WIDTHS WERE CLEARLY IDENTIFIED. WHEN TOTALING THESE MEASUREMENTS, IT IS CLEAR THAT THE INTENDED ALLEY WIDTHS WERE 20 FEET. HOWEVER, IT WAS COMMON PRACTICE TO ASSUME THAT ALLEY WIDTHS WERE 1 ROD (16.5') IN WIDTH IF NOT INDICATED AND A 16.5' WIDTH WAS ALSO IDENTIFIED ON THE ASSESSORS PLAT OF HUDSON. ADDITIONAL EVIDENCE OF THIS ASSUMPTION AND OVERSIGHT WAS OBSERVED IN VARIOUS PROPERTY RECORDS AND OTHER SURVEYS. TO FURTHER COMPLICATE THIS ISSUE, THE ACTUAL "40" DIMENSION IS SHORTER THAN 1337 FEET SO USING AN ALLEY WIDTH OF 16.5' IN SOME BLOCKS HELPS TO ADJUST FOR THE SHORTER "40" DISTANCE. COLE STREET R/W WIDTH - PAST RECORDS APPEAR TO INDICATE THAT COLE STREET SHOULD BE A 33 FOOT RIGHT OF WAY ALONG THE SOUTH LINE OF THE SECTION. HOWEVER, THE PLAT ALSO INDICATES THAT LOTS 1 & 12 SHOULD HAVE BEEN GREATER THAN 45 FEET IN WIDTH AND THERE IS PHYSICAL EVIDENCE SUPPORTING THAT ASSUMPTION. TO PARTIALLY MAINTAIN THIS ADDITIONAL LOT WIDTH AND HONOR PHYSICAL EVIDENCE, I HAVE DETERMINED TO USE A RIGHT OF WAY WIDTH OF 28 FEET WHICH IS CONSISTENT WITH OTHER RIGHT OF WAY WIDTHS IN THE PLAT OF EAST HUDSON WHILE STILL PROVIDING ADEQUATE WIDTH TO MAINTAIN THE EXISTING ROADWAY. IF NEEDED, THE CITY OF HUDSON OWNS OUTLOT 117 AND COULD CHOOSE TO PROVIDE ADDITIONAL RIGHT OF WAY WIDTH SOUTH OF THE SECTION LINE IF NEEDED TO MAINTAIN COLE STREET. i
