Conditional Use Permit for limited commercial recreational activities, pursuant to Section 17.15(6)(m) - Huebner - Town of St. Joseph Hearing opened at 8:33 AM. Recessed at 9:10AM. Closed hearing at 1:10 PM 2. Conditional Use Permit for a total of three (3), two-family dwellings on three (3) separate lots, pursuant to Section 17.15(6)(a) of the St Croix County Zoning Ordinance - Stout - Town of Warren Hearing opened at 9:10 AM. Recess hearing 9:20 AM. Reconvene 9:28 AM. Closed hearing at 10:34AM. 3. Variance to the Setback in a Rural Residential District - St. Croix Animal Friends - Town of Warren Hearing opened at 9:29 AM. Hearing closed at 10:15AM 4. Continuation of hearing from April 26, 2019 - Conditional Use Request - Animal Shelter, Boarding Kennel, Education Center - Town of Warren - St. Croix Animal Friends SITE VISITS Recess for site visits at 10:57 AM. Return at 1:02 PM. BUSINESS ITEMS 1. Conditional Use Permit for limited commercial recreational activities, pursuant to Section 17.15(6)(m) - Huebner - Town of St. Joseph Nicole Hays, Land Use Technician, gave the staff presentation. Applicant spoke and answered questions from the Board. Several others spoke regarding this application. Observations from site visit were discussed. The Board will alter the condition containing time and months of operation. MOTION: To approve the conditional use permit request for Huebner for limited commercial recreational use. RESULT: APPROVED [UNANIMOUS] MOVER: Joe Miller, Citizen SECONDER: David Niccum, Citizen AYES: David Peterson, David Niccum, James Nelson, Joe Miller EXCUSED: Buck Malick 2. Conditional Use Permit for a total of three (3), two-family dwellings on three (3) separate lots, pursuant to Section 17.15(6)(a) of the St Croix County Zoning Ordinance - Stout - Town of Warren Sarah Droher, Land Use Specialist, presented the staff report. Exhibit 3 was handed out to the board - Town of Warren recommendation of approval. A minor land division was approved as of May 23, 2019. Ed Flanum, Northland Surveying, did this survey. MOTION: To approve the conditional use permit request as presented by the staff for Stout in the Town of Warren. Variance to the Setback in a Rural Residential District - St. Croix Animal Friends - Town of Warren Sarah Borrell, Land Use Specialist, presented the staff report. Noted: this is a continuance from the April 26, 2019 BOA meeting. Based upon the result of the variance request the conditional use, approved at the April 26th meeting, may need to be revised. Revised site plan has been provided by the applicant. Moving retention basin will allow future connection to the property in the north. Denzer spoke to the analysis of the conditions for granting the variance. MOTION: To approve the application for a Variance to the Setback and amend the Conditional Use as per the changes discussed. Conditional Use Request - Animal Shelter, Boarding Kennel, Educational Center - St. Croix Animal Friends - Town of Warren - Amendments Conditions amended as directed by the Board of Adjustment. Approved in conjunction with the Variance. Biogas Digester Conditional Use Permit Application -- Status of Community Development Department assignments and revisions to recommended conditions for BOA consideration. Ellen Denzer, Community Development Director, summarized the Board's direction given to staff at the April 26, 2019 meeting. The Board concurred with Denzer's summary. 6. Biogas Digester Conditional Use Permit Application Determination of Impact Studies needed, if any, per steps in section 17.70 (8) The Community Development Department staff researched cost of hiring an appraiser to provide a property value analysis of the proposed biodigester's impact. If an appraisal is done, the board would have to make a resolution and assign to staff and then hold a public hearing on the findings. Corporation Counsel, Scott Cox, reviewed section 17.70 (8)- the process for the impact study. Discussion. Board instructed legal counsel and Community Development Department staff to draft a resolution for Board consideration upon return from site visits. MOTION: To accept the resolution as recommended by the staff. Motion by Peterson, Second by Miller. Passed unanimously.
