APPROVAL OF MINUTES 1. Board of Adjustment – Regular Meeting – August 22, 2019 8:30 AM RESULT: ACCEPTED 2. Board of Adjustment – Regular Meeting – August 23, 2019 9:00 AM RESULT: ACCEPTED PUBLIC HEARINGS None. SITE VISITS BUSINESS ITEMS 1. Conditional Use Request - Moll - Town of Pleasant Valley - Manure Processing Facility MOTION: To deny the application using the Draft Decision document provided by Community Development Department Staff as the basis for this decision, especially item number 7, with the removal of 6, 7b, 7c, 7g and 8. RESULT: ADOPTED [3 TO 2] MOVER: David Peterson, Vice Chair SECONDER: Joe Miller, Citizen AYES: David Peterson, David Niccum, Joe Miller NAYS: Buck Malick, James Nelson 2. Amendments to BOA Rules & Bylaws Recess 9:18 AM - 9:25 AM. Chairman Malick introduced this topic in an effort to reduce the amount of paperwork that comes to the board, especially during the week before the hearing. Community Development Director Ellen Denzer reached out to the Center for Land Use Education (CLUE) at UW Steven's Point for advice on possible Board of Adjustment policies. CLUE staff members are not aware of any community that limits submittals or exhibits. They did suggest requiring the applicant to submit a maximum 5 or 10 page summary of the application and attachments for the BOA to refer to during hearings. CLUE also recommended limiting testimony to 3 or 5 minutes per person, including the applicant. St. Croix County BOA does limit testimony in many situations. Discussion regarding not providing BOA members additional submittals from date of hearing publication through day of hearing or day before hearing -- approximately 3 to 4 weeks before hearing; staff reports available 7 to 10 days prior to hearing; limiting initial staff report to application materials only; and charging applicant for cost of additional hearing dates. Board members concluded they would like to see several changes, staff directed to draft guidelines and possible changes to by-laws for review at November BOA and to take effect January 2020.
