2. Variance to the requirement that nonconforming accessory structures in the Lower
St. Croix Riverway District may not be reconstructed pursuant to Section 17.36 I.3.b
of the St Croix County Zoning Ordinance - Town of Troy - Marzolf

3. Conditional Use Permit for filling and grading within 40 feet of a slope preservation

Kevin Grabau presented the request.
MOTION: to adopt staff recommendations as presented issuing the Conditional
Use Permit to operate a Contractor's Storage Yard in the Town of Baldwin.
RESULT: APPROVED [UNANIMOUS]

4. A Variance to the requirement that nonconforming accessory structures in the Lower

Sarah Borrell, Land Use Specialist, presented the staff report. Two additional exhibits (3 &
4) were presented by the staff including a letter from the Wisconsin DNR and some
additional photos of the property. Time was given for the board and audience to view
the Wisconsin DNR letter. Ms. Borrell also showed photos from the contractor received
this morning.
MOTION: To adopt the recommendations of the staff as presented to issue a
Variance in the Town of Troy for reconstructing an existing structure.
RESULT: APPROVED [UNANIMOUS]

5. A Conditional Use Permit for filling and grading within 40 feet of a slope preservation
zone pursuant to Section 17.36 F.3.a.5)
Kevin Grabau, Land Use Specialist, presented the two applications. Letter from the
Wisconsin DNR has been added as Exhibit 5- time was given for the Board and
audience to review.
MOTION: To adopt the staff recommendation as presented with item 8 being
changed to 3 years for the Conditional Use Permit in the Town of Troy for
filling and grading within 40 feet of the slope preservation zone.
RESULT: APPROVED [UNANIMOUS]

MOTION to approve the request for a Conditional Use Permit in the Town of
Troy for filling and grading 10,000 square feet or more outside of the slope
preservation zone.
