Request to modify a Conditional Use Permit for a Non-Metallic Mining Operation (Wilson Quarry) approved under Section 17.15 (6) (8) to change monitoring well sampling events from quarterly to annually Hearing opened at 8:33 AM - closed at 9:32 AM SITE VISITS Board members made site visits on their own. BUSINESS ITEMS 1. Modify Conditional Use Permit - Mathy Const. - Town of Springfield Mike Wozniak, Land Use Administrator, presented the application for Mathy Construction in the Town of Springfield, Wilson Quarry site. Request is to do water monitoring annually instead of quarterly due to that they are not currently mining, but will resume quarterly once mining resumes. Initially 3 monitoring wells were installed in 2017 three more wells for monitoring. Candy Anderson of Milestone Materials let the board know that mining did not happen since June 2017 but washing did happen until November of 2017. Buck asked question why wells 3a and 3b are close together, Candy stated that one is deeper than the other to monitor both aquifers of the Wilson Creek. Wozniak points out that Kevin Grabau is present, he worked on the original applications and subsequent modifications. Wozniak also acknowledged Tammy Traxler as a department specialist in these types of applications. Wozniak notes that Milestone Materials has given, as per the CUP, 9 years of quarterly monitoring, none of which would preclude this request from approval. Bob Servas - hydrogeologist for Milestone, licensed in Wisconsin, talked about the charts in the packet. State standard for sulfate is 250, and the PAL is 125. These values are around 16 which is not concerning. Some fluctuations do occur naturally in the surrounding rock. Nitrates are common in this region in the water. Some of the blasting compounds could contain nitrogen however, MW1 levels indicate that the water coming onto the site is bringing the nitrogen, we are not contributing to it- based upon the levels of nitrogen in the outgoing water wells. Malick now looks at the temperature charts - the temperature is very important to trout habitat, ppg 42, so for the Wilson Creek habitat do we need to be concerned about the fluctuating temperature of the groundwater samples. MW5 is deepest well to groundwater so is cooler. Typical rule of thumb for groundwater temperature is mean annual air temperature. They use both dredging and scooping operations. Wozniak, this mine is subject to renewal in 2021. Tamara Traxler, CDD planner, she helped establish the three original well areas for monitoring background water quality. She agrees with Mr. Servas. Kevin Grabau, CDD Land Use & Conservation Specialist, Buck asks about other operations mining into groundwater. Ordinance requires a 5' separation between washing pond and groundwater. This is the only mine in the county to mine into groundwater. Miller asks about settling pond - if no pond they cannot go into groundwater. Candy Anderson, Milestone materials, takes the stand, we hire a third party consultant and conducts the sampling. Tony Tomashek, Vice President of operations Milestone Materials, does not see frac sand mining coming back any time soon. We have to blast for both the sand and rock. Niccum asks about this. Dr. Tinker and we believe that the mining operation has had little to no effect on the groundwater and Wilson Creek. We also monitor the creek as well as the monitoring of the wells. Near the entrance the county has a rock crushing facility. Niccum asks why do you want this. Candy - sand market crashed, we do want to save money, no significant trends in quarterly monitoring. Excessive testing is no value. There is a due date for reporting the results of February 28 of the following year. MOTION: to reduce the requirement for quarterly testing to annual testing for the Wilson Quarry mine from Mathy Construction.
