APPROVAL OF MINUTES
PUBLIC HEARINGS
1. Conditional Use permit to construct stairs pursuant to Section 17.36.F.3.a.3) of the
Lower St. Croix Riverway Overlay District
Hearing opened at 9:05 AM. Hearing closed at 9:42 AM.

BUSINESS ITEMS
1. Conditional Use permit to construct stairs pursuant to Section 17.36.F.3.a.3) of the
Lower St. Croix Riverway Overlay District for Rieser
Mike Wozniak, Land Use Administrator, presented the staff report and findings to the
board.
MOTION to approve the request for a conditional use permit to construct stairs
pursuant to Section 17.36.F.3.a.3) of the St. Croix County Zoning Code of
Ordinances, Lower St. Croix Riverway Overlay District provided the required fees
are paid.
RESULT: APPROVED [UNANIMOUS]
MOVER: David Peterson, Citizen Member
SECONDER: Joe Miller, Vice-Chair, Citizen Member
AYES: Buck Malick, Joe Miller, Greg Tellijohn, David Niccum, David Peterson
EXCUSED: Steve Schalla
2. Closed session, pursuant to Wis. Stat. § 19.85(1)(g), to confer with legal counsel
concerning strategy to be adopted by the Board of Adjustment with respect to
litigation in which it is involved and/or updates related to litigation in which it is
involved, specifically St. Croix County Case No. 22CV388 (Apple River Hideaway).
Motion to enter into closed session.
RESULT: APPROVED [UNANIMOUS]

3. Reconvene into open session and take action on items under discussion in closed
session and/or report action taken in closed session, regarding St. Croix County Case
No. 22CV388 (Apple River Hideaway).
Motion to reconvene into open session and take any necessary action on items
discussed in closed session.
MOTION by Malick, second by Miller to invite members of the Public Health
Committee or Department and representatives of the Town of Somerset to our
next Board of Adjustment meeting to the closed session in which we will be
discussing with corporation counsel current litigation. Unanimously passed.
