Ellen Denzer, Community Development Director, presented the application and staff
report to the Board.
MOTION to approve the request for the renewal of this permit for Non-Metallic
Mining for Mathy Construction in the Town of Emerald.
RESULT: APPROVED [UNANIMOUS]

2. Conditional Use Permit to operate a Contractor’s Storage Yard pursuant to Section
15.330 of the St Croix County Zoning Ordinance for Henderson in the Town of
Somerset.
Denzer presented the staff report to the Board. Read into the record, Town of Somerset
Plan Commission 6-21-2023 Minutes.
MOTION to approve the request for a Conditional Use Permit for a contractor
storage yard for Henderson in the Town of Somerset.

Denzer presented the staff report and supporting documentation to the Board.
MOTION to approve a variance for Rutter, Town of St. Joseph, to allow expansion
of non-conforming principal structure.

Denzer presented this as Variance #2 in the staff report.
MOTION by Niccum to deny variance request for Rutter, Town of St. Joseph to
all expansion of a non-conforming accessory structure, second by Miller. Aye-
Niccum; Nay-Peterson, Miller, Tellijohn.
MOTION by Tellijohn to approve variance for Rutter, Town of St. Joseph to
allow expansion of a non-conforming accessory structure as presented, second
by Peterson. Aye-Miller, Tellijohn, Peterson; Nay-Niccum.

MOTION to approve the request for a Conditional Use Permit for filling and
grading within 40 feet of the Slope Preservation Zone.

by Peterson, seconded by Tellijohn. Unanimous vote to postpone to the July 27 BOA
meeting.
