Board of Adjustment – Regular Meeting – July 27, 2023 9:15 AM RESULT: ACCEPTED PUBLIC HEARINGS 1. Conditional Use Permit to construct a lift in the Lower St. Croix River Overlay District for Odegard in Town of Troy Hearing opened at 9:25AM . Hearing closed at 9:48AM. 2. Conditional Use request for after-the-fact approval of structural erosion contol measures within a slope preservation zone and Variance Request for after-the-fact reconstruction/alteration of a deck for Jones in the Town of Troy Hearing opened at 9:51 AM. Hearing closed at 10:38 AM. 3. Two Variances for Ward in the Town of Somerset Hearing opened at 11:02AM. Hearing continued at September 28, 2023 meeting of the Board of Adjustment. 4. Three Conditional Use and Four Variances for Hartung in the Town of Troy Hearing opened at 12:01 PM. Hearing closed at 3:52 PM. SITE VISITS BUSINESS ITEMS 1. Conditional Use Permit to construct a lift in the Lower St. Croix River Overlay District per Section 17.36.F.3. of the St. Croix County Code of Ordinances for Odegard in the Town of Troy Mike Wozniak, Land Use Administrator, presented the staff report to the Board. MOTION to approve the request for a conditional use permit to construct a lift for Odegard in the Town of Troy with conditions as presented. RESULT: APPROVED [UNANIMOUS] MOVER: Joe Miller, Vice-Chair SECONDER: David Niccum, Citizen AYES: Buck Malick, Joe Miller, David Niccum EXCUSED: Greg Tellijohn, David Peterson, Steve Schalla 2. Variance for after-the-fact reconstruction/alteration of a deck pursuant to Section 17.36.I.3.b., of the St. Croix County Code of Ordinances for Jones in the Town of Troy Jared Wehner, Land Use Planner, presented the report for both the variance and the conditional use request to the Board. MOTION to approve the request by Jones for a Variance for after-the-fact reconstruction of a deck on the property in the Town of Troy. Ward - Variance for expansion of a structure exceeding 1,500 sq. ft. within the 75-ft setback of the OHWM - Town of Somerset MOTION to postpone until next months' meeting to allow for corporation counsel to draft a memo to reply to applicant's attorney's memo. Variance to allow nonconforming accessory structures to be altered or expanded (deck, patios, walkways) in a slope preservation zone pursuant to Section 17.36.I.3.1., of the St. Croix County Code of Ordinances for Hartung in the Town of Troy Mike Wozniak, Land Use Administrator, presented the 4 variances and 3 conditional use requests for after-the-fact permits for Hartung in the Town of Troy. MOTION to adopt staff recommendations as presented on all items.
