Board of Adjustment – Regular Meeting – August 24, 2023 9:15 AM RESULT: ACCEPTED PUBLIC HEARINGS 1. Ward Town of Somerset - Requests for three variances, one Conditional Use Permit, and one After-the-fact conditional use permit. Hearing opened at 9:19 AM. Hearing closed at 11:57 AM. SITE VISITS BUSINESS ITEMS 1. Variance from the standards listed in Section 17.36.1.2.e Expansion of Nonconforming Principal Structures to expand the principal structure located within the Slope Preservation Zone and within 75 feet of the Ordinary High-Water Mark and expand said structure further into the required 25-foot side yard setback listed in Section 17.36.G.5. Jared Wehner, Land Use Planner, presented the staff report to the Board. MOTION to approve the request for a variance from the standards listed in Section 17.36.1.2.e Expansion of Nonconforming Principal Structure to expand the principal structure located within the Slope Preservation Zone. RESULT: APPROVED [UNANIMOUS] MOVER: Buck Malick, Chair SECONDER: Greg Tellijohn, Supervisor AYES: Buck Malick, Greg Tellijohn, David Niccum, David Peterson EXCUSED: Joe Miller, Steve Schalla 2. Variance from the dimensional standards listed for R-2 Residential zoning district in Section 15.231 to expand the principal structure into the required 10-foot side yard setback MOTION: that we grant the variance for the modifications in the principal structure. Variance from the standards listed in Section 17.36.1.3.b. Nonconforming Accessory Structures to reconstruct the accessory structure (deck) and modify the footprint located within the slope preservation zone and within 75 feet of the Ordinary High- Water mark Jared Wehner, Land Use Planner, presented the variance request to the Board. MOTION - to accept modified option B as per plan. After-the-fact conditional use permit for the reconstruction of a Stairway per Section 17.36.H.12. on the property located at 310 221st Avenue, Somerset, WI 54025 Jared Wehner, Land Use Planner, presented. MOTION to approve the after-the-fact conditional use permit for the reconstruction of a Stairway to include vegetation mitigation and painting the stairway in a compliant color.
