PUBLIC HEARINGS
1. Shoreland Overlay Districts Chapter 17
COMMENTS - Current Meeting:
Chair Ring opened the public hearing for the Shoreland Overlay Districts Chapter 17. Denzer
began by commenting that several meetings have been held throughout the County leading up to
this public hearing. The WI DNR has submitted their comments as well, and staff feel that the
majority of those comments have been addressed. Denzer acknowledged that public comments
are welcome and will be accepted, but asked the committee that no action be taken tonight, rather
at a future meeting so staff has time to incorporate comments. This ordinance does not need to be
in place by February 1, 2014, because the DNR has the discretion to extend timeframes if the
shoreland update is close to completion. Staff anticipates the changes should be completed in
time for the March County Board meeting.
Wittmer gave the powerpoint presentation summarizing the ordinance changes.
Chair Ring invited anyone that would like to speak in favor of, or in opposition to the Shoreland
changes presented.
Jeff Ericson, resident of the Town of Forest, asked about the wind turbines and how close they
are allowed to shoreland areas. Wittmer answered that would be covered under the Tower
Ordinance if it is within county zoning.
Rick Steinberger spoke in favor and commented that when dealing with mitigation strategies, to
always look at impervious surfaces.
Hearing no further comments, Chair Ring closed the hearing.

2. Town of Forest Zoning Ordinance and Zoning Map
COMMENTS - Current Meeting:
Chair Ring opened the public hearing by asking Town of Forest Plan Commission Chair and
Town Board Supervisor Rick Steinberger, to talk about the process that occurred to create the
Town of Forest Zoning Ordinance. Steinberger reviewed the process and stated that a
professional engineer was hired to assist. The Town Board had asked the Plan Commission to
work on this ordinance. Multiple Plan Commission meetings were held, sometimes twice a
month, over what has become a two-year process. Public comments were allowed throughout
the meetings. Two public hearings were held, along with a special meeting in July 2013 that also
allowed comments. Once the Resolution for Adoption of Town Zoning was drafted, the Town
Board gave approval to forward on to the County and the review by the county is complete and
was very positive. Steinberger also stated that the Zoning Administrator is ready to go, as well
as the Board of Appeals and a fee schedule.
Chair Ring asked if the County has reviewed this along the way, and Denzer confirmed that it
has been reviewed with the Town of Forest for consistency and conflicts, and feedback was
provided. Denzer also verified that Steinberger's information is accurate.
Engesether explained the bullet points of the resolution when these processes come through the
County. Engesether proceeded to go through the comments received prior to the start of the
meeting, and read those that requested into the record. Those speaking in favor were: Nikki
Sunday, Janet Scepurek, Janet Monson, Patrick Scepurek, Anne Johnston, Richard and Marlys
Lampert, and Attorney Catherine Munkittrick.
Those opposed were: Melissa Ulrich, Carol Johnson and James Kreyer.
Chair Ring addressed the comments that were submitted during the hearing and called up each
person to read their comment. Those that spoke in favor were: Todd Ostberg, Brenda Salseg,
LaVerne Hoitant, John Strom, Nicole Miller, Jeff Ericson, Cindy Kuscienko and Doris Schmidt.
Those opposed were: Doug Karau.
Engesether received additional comments, which she read. Those in favor were: Phillip and
Lorna Rogers, Dale and Gloria Logan, Lloyd and Ines Logan.
Also received and read by Engesether, was a letter from Attorney Daniel O'Callaghan giving
Notice of Circumstances Giving Rise to a Claim and Notice of Claim Pursuant to Wis. Stat.
893.80.
Steinberger spoke and addressed some of the points of contention and explained how
determinations were made. Strom also made a short comment to address loss of property values
if the wind farm goes in. Hoitant spoke and wanted to make sure the zoning map shown was the
latest version, which Engesether confirmed. Attorney Munkittrick was the final person to speak
and summarized the comments she had written in her letter.
Hearing no further comments, Chair Ring closed the hearing. All comments are on file in the
Community Development Department.

BUSINESS ITEMS
1. Resolution of the St. Croix County Board of Supervisors Approving Creation of the
Town of Forest Zoning Ordinance
Cox stated that the State Statutes do not provide much guidance, but with the information
provided tonight, there is nothing that alarms him if the County would go ahead and
approve.
Motion by Russett, 2nd by Brinkman to recommend County Board approval of the
resolution and to allow the Town of Forest to adopt their own zoning ordinance.
Discussion. Motion carried.

2. Financial Reports
Denzer reported that the financials are in good shape. The Parks Division revenues were
good and now finalized for the year. The committee asked if there is anything of
concern, and Denzer responded that there are no concerns.
3. Ordinance Repealing Chapter 17 Subchapter III Section 17.25-17.35 Shoreland Zoning
and Recreating as Chapter 17 Subchapter III Section 17.30 Shoreland Overlay Districts
and Amending Related Shoreland Text, Definitions and References in Chapter 17-Zoning
Sections 17.06, 17.07, 17.08, 17.09 and 17.72.
The committee made a recommendation not to take further action.
Chair Ring clarified that staff will be looking at mitigation to address concerns of the WI
DNR. Denzer explained staff is repealing and replacing to simplify the numbering
system, and also correcting some missed cross-referencing with regard to the
Conservancy District. Corp Counsel would like more time for thorough review, as a
defender of this ordinance. There may need to be a second public hearing, Corp Counsel
will advise if necessary.
Chair Ring asked if the committee had any further comments or questions. Gausman had
a comment regarding the accessory structure standards and objected to legislating the
color of stairways. She feels this should be part of covenants and not regulated by the
County. Wittmer answered that it falls under addressing natural scenic beauty. It is a
requirement that in the Riverway District, everything is earth tone, which gives staff
consistency in regulating.
Gausman also commented on the reasonable accommodations for the disabled,
questioning why accommodations would be removed once a disabled person no longer
lives at a Riverway District property. Denzer explained the permitting involved for these
accommodations, which are already administered in the ordinance. If someone who is
not disabled purchases the property, the accommodations would have to be removed.
Denzer summarized that if the committee has anything further that needs to be addressed,
it can be brought up at the next hearing.
Chair Ring thanked the staff for the amount of detail and their responsiveness that was
put into this Shoreland Ordinance.
