Community Development Committee – Regular Meeting – September 21, 2017 5:00 PM Supervisor Berke - corrections to minutes of 9/21/17: PDR= Purchase of development rights. Also would like to include title, for example supervisor, included in the minutes; and in the last section of the Friends of the St. Croix County Fair announcement the event will be held in New Richmond at Gibby's not at the fairgrounds. RESULT: ACCEPTED AS AMENDED PUBLIC COMMENT Ben Fochs, 680 Cty Rd MM. There is an MOU about jurisdictional transfers, changes road naming and what addresses will be. Cty Rd MM, road is gone and what is the future address for him and surrounding neighbors. Don Jordan, Town of Hudson, item#5 on the agenda, homeowner's bill of rights, resolution in opposition from this committee and the county. Next Thursday WTA meeting will work to oppose as well. Don Johnson, Town of Baldwin, Tollefson rezoning was passed by town board, trying to keep AG in township. PUBLIC HEARINGS 1. Rezoning - Tollefson Trust - Town of Baldwin Hearing opened at 5:08 p.m. Hearing closed at 5:17 p.m. BUSINESS ITEMS 1. Election of Chair for Community Development Committee Supervisor Berke nominated Supervisor Dan Hansen - Seconded by Supervisor Coulter. Roll Call Vote taken. Ordinance Amending the Comprehensive Zoning Ordinance, Chapter 17 Section 28, T29N, R16W, Town of Baldwin Grabau presented staff report. MOTION: To recommend approval of the rezoning request based upon the information presented by staff. Introduction of UW Extension Area Director - Kristen Bruder Kristen Bruder introduced herself and gave her background information. Area Extension Director, AED, for three county area: St. Croix, Pierce, and Polk counties. How do we continue to provide the outstanding service that we have always provided? Supervisor Berke asked about Horticulture position. Supervisor Hansen asked about communication from Bruder to Committee. Also asked about Joan Sprain's position and will it be refilled? Are the staff under Bruder's watch being shared with the other counties in her jurisdiction? Bruder stated that if county has full-time Ag position now, then they will have a full-time Ag position going forward. 2. Financial Report No comments from Committee. RESULT: DISCUSSED 3. St. Croix County Comprehensive Plan Amendment based on Town Comprehensive Plan Amendments John Hilgers, Community Development Department Planner, presented. These amendments pertain to the Town of St. Joseph, Town of Stanton, Town of Baldwin. 4. Ground and Surface Water Study Group Final Report Director Denzer and Chairman Hansen brought to committee. Committee will have on November agenda to give staff direction. Berke would like people on the water committee listed in the appendix of the document. Hansen would like this funded and to make this plan work. Protecting the groundwater in SCC is one of the most important things we need to do. Berke would like to have a committee to carry out the objectives of the study. Hansen feels there is no committee needed. Supervisor Moothedan agrees with Supervisor Berke. Hansen invites Roy Sjoberg to the microphone. Chair of Administration Committee. Page 57 of the packet (page 31 of the report) Sjoberg requests for CDD staff to put numbers to the eight items on this page. Compile items, timeframe, budget for associated costs and staffing for new implementation strategies not existing activities the staff are already doing. Concerns with a separate committee: if topic is always on the agenda then maybe don't need one, on the other hand it is a critical issue and a special committee which meets quarterly would keep groundwater protection on target. There is some funding from the study group left, but not enough to complete the eight items. Moothedan asks for Ellen's feedback. CDD will work up estimated timeframe and budget and include staff for the components of the eight core recommendations. Denzer pointed out that an additional committee provides the advantage of evaluating a problem holistically and in this situation was able to focus and learn a great deal in order to determine recommendations. However, another committee does add a lot of work for CDD staff and requires constant education of committee members who do not participate in the special committee yet are required to vote on recommendations and budgets. There are other ways to address citizen input, such as appointing a couple of citizens to participate in CDC on this topic or keeping it on the agenda on a regular basis. Moothedan asked about getting grants for some of the recommendations. Hesselink suggested possibly seeking help from Extension - contact with Kristen Bruder. Get this information into extension fliers if possible too. Kristen mentioned specialists - Berke brought up - we may be able to tap into that. Hansen - next month we will review staff recommendations, provide feedback and discuss funding. He invited Supervisors Roy Sjoberg and Bob Long to attend. 5. Assembly Bill 479/Senate Bill 387 "Homeowner's Bill of Rights" Director Denzer gave background. Timeframe and short turnaround are concerns. 11 years of upholding state statutes by SCC, now state is thinking of changing. Has been opposed in whole from Wisconsin Chapter of American Planning Association, Wisconsin County Planning and Zoning Director’s, Wisconsin Town’s Association and Wisconsin County’s Association. Copies of AB479 and SB387 were handed out during the meeting. This bill allow increased development and density, further changing the scenic nature of the St. Croix River and other water bodies in the County. The lawsuit with the Murr family was supported by the State of Wisconsin for the full 11 years and at the US Supreme Court by the US Solicitor General. Hundreds of thousands of dollars have been spent in support of protecting the lot merger and substandard lot provisions and now state legislators are contemplating overturning these provisions. Motion to authorize CDD staff to draft a resolution opposing these bills to be sent to the Legislature and Governor. Supervisor Berke - greatly concerned. lives in Troy which includes the property in the National Scenic Riverway, Gaylord Nelson, Walter Mondale in late 60s worked to protect the St. Croix Riverway. Recommendation from this committee to have CDD work with Corp Counsel to draft a resolution in opposition to have the CDC recommend to the county board a resolution in opposition to AB479 and SB387 Chairman Hansen - we should make a statement. SCC worked for 11 years to uphold the zoning laws. Zoning laws are the foundation of protecting property owners rights. This proposed law is disrespectful of local governments authority. The CDC should meet prior to the next county board meeting. Director Denzer - set a CDC meeting just prior to next county board meeting to consider proposed resolution at 830am on November 7th. Director Denzer to forward Trempeleau County resolution of opposition to committee members.
