This letter confirms zoning approval according to the plan you have submitted to the Zoning Office to
construct a 32-foot by 50-foot garage on your property. Please find enclosed an administrative land use
permit for your project. This permit allows you to complete the project as submitted.
This permit has been issued with the following conditions:
• The garage shall be sited in accordance with the survey dated December 6, 2003, drawn by Joe
Granberg.
• Submit an erosion control plan for the project area to the Zoning Office for review and approval.
The plan must be approved before commencing site preparations.
• The loft shall not to be used as a living quarters.
• Notify the Zoning Office 3 days prior to the commencement of the project and upon the
completion of the project.
• Permit is valid for one year from the issuance date.
• Obtain a town -building permit prior to the commencement of the project. Please contact Dwight
Farnham, Deputy Zoning Administrator for the Town of St. Joseph at 715-549-5203 to obtain the
necessary building permits for the project.
• Submit photos of the final construction to the Zoning Office.
The plans as submitted are found to be in compliance with the provisions of the St. Croix County Zoning
Ordinance and the Lower St. Croix River Valley District. Staff finds that the project meets the spirit and
intent of the St. Croix County Zoning Ordinance (Lower St. Croix River Valley District) for the following
reasons:
1. The proposed garage location meets the setback requirements.
2. Accessory uses are allowed in the Riverway district.
3. The structure's exterior will consists of stone and cedar shanks, which will bend the structure in to its
natural surroundings.
4. This structure will not have plumbing or running water.
5. The approval of this project will not affect the public health, safety and welfare of the residents of St.
Croix County.
6. This approval will not change the character of the neighborhood.
7. Structure does not exceed the height requirements of the Riverway District.
8. The construction and grading activities will not take place on slopes less than 12 %.
9. The garage will be used to store personal belongings.
If the scope of the project changes, please contact the Zoning Office immediately so we can assess the
project to ascertain if additional zoning permits or approvals are necessary.
For your information, I'm advising you that on October 23, 2003 the St. Croix County Board of
Adjustment (BOA) reversed staff's decision to deny Patrick and Kitty Delaney a land use permit
for the construction of a garage within the bluffline setback. The Delaney's property is located in
the Riverway District. The BOA stated that the bluffline setback requirement was not applicable at
this site because the bluffline criteria were not met. The land use permit was granted on the basis
of the board's decision, however it is still subject to an appeal. There is a 30-day appeal period
from the official date of the Board's written decision for the Delaney case, which any person
aggrieved by the Board's ruling to reversed staff's decision could file an appeal (wit of certiorari) in
circuit court.
Currently, a draft of the decision is being reviewed by the County's Corporation Counsel. The 30-
day appeal period begins once the decision is final. If you begin construction before the 30-day
appeal period expires and the Delaney decision is overturned, you may be required to remove some
or all of the construction associated with the garage. Therefore, until the 30-day appeal period
expires you are proceeding at your own risk.
