Please find enclosed an administrative land use permit for your project. This permit allows you to complete the project as submitted. This permit has been issued with the following conditions: • Submit an erosion control plan for the project area to the Zoning Office for review and approval. The plan must be approved before commencing site preparations. • Notify the Zoning Office 3 days prior to the commencement of the project and upon the completion of the project. • Permit is valid for one year from the issuance date. • Obtain a town -building permit prior to the commencement of the project. Please contact John Ruemmele, Chairperson for the Town of Troy at 715-386-3486 or Brian Wert, Building Inspector at 715-386-5279 to obtain the necessary building permits for the project. • Submit photos of the final construction to the Zoning Office. The plans as submitted are found to be in compliance with the provisions of the St. Croix County Zoning Ordinance and the Lower St. Croix River Valley District. Staff finds that the project meets the spirit and intent of the St. Croix County Zoning Ordinance (Lower St. Croix River Valley District) for the following reasons: 1. On October 23, 2003 the St. Croix County Board of Adjustment (BOA) reversed staffs previous decision to deny you a land use permit to construct a 22-foot by 24-foot garage on your property. The BOA required that staff issue the land use permit to construct a garage as submitted on June 29, 2003. 2. The BOA stated that the proposed garage location is visually inconspicuous, thus the 12 % slope shown on the surveyed site plan does not constitute a bluffline by ordinance definition. 3. The approval of this project will not affect the public health, safety and welfare of the residents of St. Croix County. 4. This approval will not change the character of the neighborhood. Please be advised that there is a 30 day appeal period from the official date of the Board's decision, which any person aggrieved by the Board's ruling to reversed staffs original denial of this request could file an appeal in circuit court. St. Croix County Board of Adjustment Appeal Rights: Any person aggrieved by this decision may file an appeal in St. Croix County circuit court within 30 days after the filing date shown below, pursuant to sec. 59.694 (1), Wisconsin Statutes. St. Croix County assumes no responsibility for action taken in reliance on this decision prior to the expiration of the appeal period. St. Croix County does not certify that the identity of all person legally entitled to notice of the Board of the Adjustment proceedings, which resulted in this decision, was provided to the County. If an appeal is taken of this decision, it is the responsibility of the appellant to submit at his/her expense a transcript of the Board of Adjustment proceedings to the circuit court, which is available from Northwest Court Reporters, Hudson, Wisconsin. It is the responsibility of the Board of Adjustment to submit its record (file) of this matter to the circuit court. If the scope of the project changes, please contact the Zoning Office immediately so we can assess the project to ascertain if additional zoning permits or approvals are necessary.
