Please find enclosed an administrative land use permit for your project. This permit allows you to complete the project as submitted. This permit has been issued with the following conditions: • Notify the Zoning Office 3 days prior to the commencement of the project and upon the completion of the project. • Permit is valid for one year from the issuance date. • Submit photos of the final construction to the Zoning Office. Staff finds that the project meets the tower ordinance provisions of the St. Croix County Zoning Ordinance, section 17.87 (2) for the following reasons: 1. The existing tower can support the co -location. 2. This is an accepted use and co -location is encouraged by ordinance. 3. The application was found to be complete. If the scope of the project changes, please contact the Zoning Office immediately so we can assess the project to ascertain if additional zoning permits or approvals are necessary. The existing tower is located on property owned by the John and Lorraine Merritt Trust, off 190'h Street. If you wish to view the land use permit application or have questions about the application contact the Zoning Office. The land use permit maybe issued after 10-days of the date of this letter. Tower Ordinance Cc: file August 5, 2003 Design 1 Attn: David Goulson 9973 Valley View Road Eden Prairie, MN 55344 RE: Land -Use Permit Application, South Baldwin Cellular Tower, Section 2, Town of Rush River Dear Mr. Goulson: Staff has reviewed the land -use permit application request made by Verizon Wireless to co -locate antennas on a 300- foot guyed tower on property owned by John and Lorraine Merritt Trust located in Section 2, Town of Rush River, St. Croix County, Wisconsin. Staff has determined that the application is incomplete. To complete the review, you must provide the following information that is required by ordinance for land -use permit applications (Refer to Section 17.87 (4): 1. A registered professional engineer's report per section 17.87 4.) (a.) 2,3,5,6 2. A facility plan per section 17.87 4.) (b) 2,3,5 3. The landowner acknowledgement statement per section 17.87 4) (c) 4. The performance bond sufficient to provide for removal of the transmission facility per section 17.87 4.) (d.). The bond shall be in amount that covers the removal of the proposed antennas. 5. A $200.00 application fee. Checks can be made out to the St. Croix County Zoning Department. Other observations staff noted while reviewing the plans; an engineer stamp was missing, the design plans were noted as "preliminary", and the Verizon Wireless plan referenced monopoles on sheet drawings G1 and G2. The application will be reviewed once the requested information is received by the Zoning Department. You are encouraged to contact zoning staff to review the above items mentioned. If no zoning is needed please respond by email please. If building permit is needed or not needed please respond by here too by email. If we do need a permit let me know what types and what drawings you will need with the application, and is the application on line or could you send me a pdf copy. How long is the permit good for and how much is the cost? We are not adding any new equipment on the ground. Pertaining to the discussion of the ordinance requirements that there is no destructive interference, I have included the ordinance language in this email for your convenience. See Section 17.87(4)(a)5. below: (4) Applications. In addition to the application requirements of section 17.70(3) or section 17.70(7), any application for a county land use permit or special exception permit for a new transmission facility shall include the following information. Applications for land use permits may omit (b) 4 below. (a) A report from a registered professional engineer and other professionals which: 1. describes the tower height and design, including a cross section and elevation; 2. certifies the transmission facility's compliance with structural and electrical standards; 3. describes the tower's capacity, including the potential number and type of antennas or generators that it can accommodate; 4. describes the lighting to be placed on the tower if required by the FCC or FAA; 5. certifies that the transmission facility will not cause destructive interference with previously established public safety communications systems; and 6. describes how the requirements and standards of this ordinance will be met by the proposed transmission facility. If you need to review the latter for preparation of this new permit, I can fax you other pages; our format for issuing land use permits has changed slightly due to the 2006 county ordinance changes. The application can be submitted anytime, since we process LUPs by staff review, not Board of Adjustment. We share copies of the application with the town & appropriate agencies involved in regulation, which will require a couple weeks turnaround time for their review and comments. The result of that research is that a land use permit will be required. I read the engineering report and they currently have 12 antennas. They will replace 6 of the 12, and will leave 6 of the original antennas. They will also be adding 6 other new antennae of another type. (They had 12, will end with 18 antennas.) The fee is $550. It is also in the ordinance that if the County needs to employ an independent technical expert to review or verify any of the materials, then the applicant will pay the costs of such review and/or independent analysis. The County cannot issue the land use permit until after 10 days of sending notice of the application to the affected Town. Thanks.
