COUNTY CLERK'S REPORT OF CORRESPONDENCE AND REZONING REQUESTS
County Clerk Christine Hines explained that County Board Supervisor candidacy paperwork and
non-candidacy paperwork is available in her office and will be available on the our website by the
end of this week. Important dates to remember - nomination papers cannot be circulated until
December 1, 2023, all candidacy papers are due in the County Clerk's office by 5:00 pm on January
2, 2024 and non-candidacy papers are due no later than 5:00 pm on December 22, 2023.
ANNOUNCEMENTS
Vice-Chair Feidler gave an overview of the Wisconsin Counties Associations Ambassador Program
and its goals. He also thanked Supervisor Ostness and Kristen Newton of ADRC for attending along
with him in October.

BACKGROUND INFORMATION
Scott Green has applied to rezone 22 acres of land in the Town of Baldwin from the AG-1
Agricultural Zoning District to the AG-2 Agricultural Zoning District.
A Class II notice was published in the Star Observer on November 2, 2023 and November 9,
2023 establishing a public hearing on November 16, 2023 at 5:00 PM with the St. Croix County
Community Development Committee (CDC) in the St. Croix County Government Center Board
Room, 1101 Carmichael Road, Hudson, Wisconsin.

4 Croix, Wisconsin, is hereby amended by rezoning the following property:

6 A parcel of land located in part of the SW ¼ of the SW ¼ of Section 5, T29N, R16W, Town of
7 Baldwin, St. Croix County, Wisconsin, further described as follows:

Request to Rezone 4.7 acres in the Town of Somerset from C-1
Commercial to C-3 Commercial

BACKGROUND INFORMATION
On June 6, 2023, the County Board voted to deny the rezoning application of Mike Kappers and
Hideaway, LLC to rezone 4.7 acres located in the Town of Somerset from C-1 Commercial to C-
3 Commercial. The vote was 11-6, but required a 3/4 super majority vote because of the protest
petitions filed. On July 6, 2023, Mr. Kappers filed a certiorari review action with the circuit
court.
Based on the filing of the certiorari review, briefs were submitted by both parties. On November
29, 2023, the Honorable Scott J. Nordstrand provided an oral ruling reversing the decision of the
County Board and ordering that the rezoning application be granted. Under certiorari review, the
circuit court reviews the record that was presented to the County Board along with briefs
submitted by the parties. After reviewing the record and the briefs, Judge Nordstrand had three
options before him when determining the case - affirm the decision of the County Board, reverse
the decision of the County Board, or remand the matter back to the County Board for further
action. Here, Judge Nordstrand reversed the decision of the County Board. Judge Nordstrand
relied on the Wisconsin Court of Appeals case of
Delafield, 2020 WI App 44, 393 Wis. 2d 496, 947 N.W.2d 214 in determining that the case
should be reversed instead of remanded. Judge Nordstrand held that the County Board did not
adequately articulate findings that would support denial of the rezoning application and
therefore, the decision of the County Board was arbitrary, oppressive, and unreasonable. Judge
Nordstrand held that outright reversal of the decision of the County Board is appropriate in this
County Board for further action.
The County Board may consider whether to appeal the decision of Judge Nordstrand to the Court
of Appeals.

1. Yes vote to appeal. A vote to appeal indicates that you do not agree with the judicial decision
and authorize Corporation Counsel to appeal the decision and request a stay on the rezoning until
a further decision is reached. A yes vote may also mean that you do not agree with the rezoning
and wish to stop the property from being rezoned.
2. No vote to appeal. A vote no can mean that you disagree with the judicial reason for the
decision but do not object to the net outcome of the property being rezoned. A no vote could also
mean that you agree with the judicial decision and the result of the property being rezoned.

BACKGROUND INFORMATION
The Community Development Department is informed about a competitive grant program called
the Transportation Alternatives Program (TAP) by the Wisconsin Department of Transportation.
This program provides 80% funding for bicycle and pedestrian projects, with a 20% local match
requirement. The funding cycle for this program occurs every four years, and the current cycle is
for 2024-2028. St. Croix County successfully secured TAP grants in 2014 for the Bicycle and
Pedestrian Plan and in 2021 for Phase I of the State Highway 35 off-road trail, with construction
scheduled for 2024.
Phase II of the STH 35 trail consists of a 1.23-mile off-road trail segment and a 0.98-mile on-
road striping and signage along River Road. This project aims to enhance safe access for
residents in North Hudson, the Towns of Hudson, and St. Joseph to key community facilities,
including North Hudson Elementary School, a retail/service area, and various parks. This trail
connects with Phase I and an existing sidewalk/bike lane facility, providing an 8-mile route
through North Hudson into the City of Hudson and onward into Minnesota via the I-94 bridge.

In addition, Phase II is an essential part of the larger trail system outlined in the 2017 St. Croix
County Bicycle and Pedestrian Plan. A potential Phase III would further expand the multi-modal
trail/bicycle lanes, connecting this project to the SCR Crossing Loop Trail and Main Trailhead in
Houlton, WI, and the St. Croix River Crossing Loop Trail System. This extensive network links
to Stillwater, MN, and the Twin City Regional Trail System.
The estimated cost for the Phase II STH 35 Trail project is $668,352, covering
design/engineering, construction, and oversight. The 20% county match is $133,671, allocated
from the Capital Improvement Fund. A detailed cost breakdown and project map are provided in
the agenda packet. These initiatives aim to promote healthier, safer exercise options and
strengthen regional connections among various communities.
The TAP Grant application requires a local resolution of support by December 22, 2023 and is
attached for your consideration.

11 Community Development Department proceeding with the TAP application for funding of the
12 State Highway 35 Off-Road Trail - Phase II project; and

14 WHEREAS, the St. Croix County Board of Supervisors supports the TAP application
15 submitted to WisDOT for the 2024-2028 award cycle in order to construct the State Highway 35
16 Off-Road Trail Phase II; and

18 WHEREAS, St. Croix County recognizes that WisDOT reimburses project sponsors for
19 the federal share of 80% of the approved TAP project costs. St. Croix County agrees to secure
20 and commit the required 20% match in a Capital Improvement Plan allocation.

22 NOW, THEREFORE, BE IT RESOLVED if St. Croix County is awarded funding by
23 WisDOT for the 2024-2028 TAP award cycle, the County of St. Croix is authorized to and
24 agrees to accept the award and enter into all necessary agreements with WisDOT for the above
25 referenced project.

27 BE IT FURTHER RESOLVED that St. Croix County agrees to comply with all
28 applicable laws, requirements and regulations as outlined in the WisDOT 2024-2028 TAP

Fiscal Impact: This resolution authorizes the County to seek 80% of construction costs for phase II
of the Hwy 35 Bike & Pedestrian Trail through a TAP grant. The County would be
required to match 20% of the total construction cost, which is estimated at $133, 671
currently. If the grant is awarded, their would be design and project bidding in fiscal
years 2025-26. If the cost of the project comes in too high, the County could elect to
return the grant dollars and not proceed with the project.

ST. CROIX COUNTY REGISTER IN PROBATE & JUDICIAL DEPT
Mission Statement: Provide efficient, effective and expeditious administration of justice and ensure equal
access to court services.
Summary of Responsibilities: Administer and maintain the Court Record for 10 different case types
including: Probate, Guardianship, Minor Guardianship, Child Protection, Juvenile Delinquency, Termination
of Parental Rights, Adoption, Mental Commitments, Temporary Physical Custody and Juvenile Injunctions.
Also, perform case management, clerk hearings and provide a high level of customer service to pro se
litigants, counsel and other county departments

Goals / Objectives Achieved: 2023 has been a year of change! In the summer months, the new assistant
corporation counsel attorney began the gradual transition to prosecuting all Child Protection matters. The
rosecutor was effective on November 1, 2023 and
our office worked diligently to ensure a smooth procedural transition. This change involved a lot of behind
the scenes discussion to determine responsibilities, clarify expectations and make necessary database
management updates. The office continues to dedicate time to additional training provided by the
such as publicly filed adoptions and termination of parental rights and record retention and confidentiality.
The Wisconsin Register in Probate Association also provides quarterly online training called the RIP RAP
provides in depth training on subjects like the appellate process and estate accounts. Relative to
guardianship annual reports and accounts the process was streamlined to increase staff accuracy and
additional time was spent communicating with non-compliant guardians to lower the number of cases that
required Court involvement for enforcement.

Register is currently engaged in additional leadership training through the National Association of
Counties High Performance Leadership Academy.

Issues, Concerns and Restraints There continues to be a shortage of local attorneys that are willing to
serve as Court appointed counsel for parents in child protection matters. As the number of complex and
serious cases continues to rise, the lack of qualified Court appointed counsel will have an impact on Court
efficiency. Additionally, the number of attorneys with specialized training to serve as a guardian ad litem,
which are Court appointed iinterests, has remained
steady as the need has increased. This shortage is also a concern especially with the uptick in the number
of adult guardianship proceedings.
