CR01X C06NT, Dear Ms. Peterson: Re: Private Onsite Wastewater Treatment System (POWTS) Evaluations For Property located at 33 - 230th St., Baldwin, WI 54002 I have reviewed your request for a determination regarding three items of concern related to recent evaluations of an existing onsite system serving the above referenced property. Question number one is whether or not the collapsed distribution line will affect the system°s ability to function as originally designed. The simple answer is yes. The original design incorporated a pipe that was intact and not collapsed. The second question relates to whether it is appropriate for a licensed plumber to pass a system knowing that a pipe is collapsed when the code in effect at the time required the pipe to run the length of the drain field. The most direct answer is no. All defects should be mentioned. However, in evaluating performance, it depends on what the plumber said about the operation of the system considering the defect. It is possible for a system as described to function (treat and disperse wastewater) with a collapsed distribution pipe. It just depends on where the collapse occurs. For example, if the pipe was 100 feet long and it collapsed 10 feet from the distal end, then there would be little or no impact on performance. Also keep in mind that the collapsed section might be able to be repaired and put back into service. A county permit would be necessary to do this type of repair work as long as it is not too extensive. In answer to your third question regarding the lack of records and proof that a licensed plumber installed the system, is it acceptable or appropriate to approve such a system for continued :.Ise? The answer is yes. It is my opinion that the system was most likely permitted but the records of all residential systems were discarded by Harold Barber, a former Zoning Administrator. This should not have happened but it did. In addition, our current code, under Comm 82.03(2)(b)1, Wis. Adm. Code, states that an existing POWTS installed prior to July 1, 2000, shall conform to the siting, design, construction, and maintenance rules in effect at the time the sanitary permit was obtained or at the time of installation, if no permit was issued. So if we know the home was constructed in 1975 the system would have to meet the rules in effect at that time as long as it is not failing as currently defined in s. 145.245(4), Wis. Stats. Pressure tank is defective. Dishwasher in kitchen has a leak so no water test can be done at this time. Septic tank has deterioration on the lid around the manhole cover .Tank is past life expectancy. Drainfield shows signs of excess water and evidence of biomat formation no effluent found at this time because of drought conditions and because the house has be vacant for prolong period of time. I ran a camera in vent pipe and in to dcainfield distribution line at 14' on north east line it is collapsed. There was rock inside pipe. Conclusion; System was probably installed in 1975 when house was built it has more than reached its life expectancy of 20 years. St Croix County has no record of any sewer or inspection of a sewer on this property .No part of this system meets current Wisconsin code.--Dana&Tracy Peterson and Jim Merth were present when inspection was done. Shaun's justification that field laterals are not necessary flies in the face of 30 some }rears of code enforcement. It also demonstrates an alarming lack of code knowledge andJor the disregard of such. This system does NOT meet "All standards, be it 1975 or 2007." Shaun called the pipe at the end of the system a vent pipe. Not an observation pipe according to comm83.02 (58) which was code in 1975 says the vent cap keeps debris out and permits circulation of air within the system. The collapsed line will not allow air flow nor will there be equal or even distribution of the effluent. Since Shaun did a soil boring I would like to see the soil report on that boring. Understand, these standards/codes were designed to protect the public health as well as the consumer. On this issue. I will not compromise.
