Treatment Courts Subcommittee of the Community Justice Collaborating Council Regular Meeting November 8, 2018 9:45 AM Minutes from November 8, 2018 Treatment Court were accepted aspresented. RESULT: ACCEPTED PUBLIC COMMENT No public comment. BUSINESS ITEMS 1. Review of the 2018 and 1st Quarter of 2019 Treatment Court Program Numbers Review of graphs showing 2018 data broken down by: Track 1 and 2, participants per quarter, their age, sex, drug choice for Track 1 participants, OWI offense number for Track 2 participants, referral source for entry into program, conviction type for Track 1 participants, program outcomes, referral processing averages and reasons for program ineligibility, program recidivism rate. Data was based upon review of the Wisconsin and Minnesota Circuit Court Access Program. RESULT: DISCUSSED 2. Review Availability of Sentencing Incentives for Treatment Court Track 2 Discussion ensued regarding the use of incentives. Front end incentives include use of electronic monitoring for Track 2 participants as an alternative to incarceration once the mandatory minimum has been served. Electronic monitoring would require some staff adjustments at the jail as well as development of a procedure in the case of violation. It could also include GPS monitoring. If there is no electronic monitoring on the front end, a back end incentive upon graduation could be terminating probation early. This has not been utilized because there have not been any Track 2 participants who have reached that point yet. This incentive could be included in the JOC and minutes for Track 2 participants. RESULT: DISCUSSED 3. Review Required Treatment Court Participation Fees for Track 2 The financial obligations of participating in Track 2 are becoming very high. Questions were raised as to whether the financial obligations of participation are increasing Currently there is no sliding fee scale. Our fees for treatment court are the highest in the state and are pricing out some defendants. To address how this opportunity can be provided to people who have less money, Kim Kitzberger and Judge Waterman will survey surrounding counties for fees and whether they use sliding fee scales. A brief memorandum with the findings and a proposal based on the findings will be circulated and presented to the Public Protection Committee in August. RESULT: DISCUSSED 4. St. Croix County Drug Court, OWI Court, and Diversion, DOJ Site Visit Review The TAD team did a site review in May to see how well the grant funds are being used. A copy of the report was provided and reviewed. The report holds us to best practice standards and is done by the State free of charge. Things seem to be working well. The report spoke highly of screening, admission, case planning process and evidence based practices/tools. The identified recommendations deal with structural things such as removal of DA veto, elimination of back up judge, measure of high needs for treatment court, equalizing phase, length and structure throughout treatment court. The recommended changes will be reviewed by appropriate departments and discussed as a group next time. RESULT: DISCUSSED REQUEST FOR FUTURE AGENDA ITEMS None ANNOUNCEMENTS & CORRESPONDENCE Kim Kitzberger announced a graduation from Track 1 which will be held July 31, 2019. The graduation will be confirmed the week before. ADJOURN Judge Waterman adjourned the meeting at 8:51 a.m. DATE OF NEXT MEETING The next meeting will be held after the CJCC meeting on November 14, 2019.
