BOARD OF ADJUSTMENTS MEETING AND HEARING MINUTES
February 28, 2002
The meeting was called to order by Chairperson Julie Speer at 8:30 a.m. A role call was made.
Julie Speer, Tom Rose, Rich Peterson, and Nick Golz were present. Dick King was excused.
Staff included: Steve Fisher, Zoning Director, Rod Eslinger, Zoning Specialist, Deb
Zimmermann, Administrative Assistant and David Sander, Land and Water Conservation
Department. Chairperson Speer believes this to be a properly noticed meeting.
Motion was made by Peterson second by Golz to adopt the agenda. Motion carried. It was noted
that there are no hearings for today.
The Board set the next meeting date as March 28, 2002 and will be held in the County Board
Room at the Government Center. The starting time will be 8:30 a.m.
Motion by Rose second by Speer to approve minutes from the January 24, 2002 meeting. All in
favor. Motion carried.
CORPORATION COUNSEL REPORT/ UPDATE ON VIOLATIONS AND LITIGATION
Corporation Counsel will be available if needed.
OTHER BUSINESS
Update on VoiceStream vs. St. Croix County Case: Fisher informed the Board that we now
have a new law firm representing the County in this case, the Boardman Law Firm out of
Madison. Fisher has been impressed by them in his conversations that he has had with them.
Will keep the Board updated on the progress of this case.
Staff Update on past Board of Adjustment Decisions: Eslinger and David Sander, of Land and
Water Conservation Department, updated the Board on a change to the Emerald and Baldwin
Dairies original plan. These two dairies plan to change their bedding system, and the staff believes
this can be done through an administrative approval, and will not have to come before the Board.
Sander explained that they would like to change their bedding system to allow them to use sand
bedding instead of the sawdust shavings. The Land and Water Conservation Department will
monitor the installations. There will not be any modifications to the lagoons. Ultimately by
eliminating the sawdust, this will increase the storage capacity of the lagoons. The Land and Water
Conservation and Zoning Departments see this as an improvement to the dairy, and this type of
bedding has proven to be better for the animals. Discussion held. Staff wil keep the Board updated.
Eslinger and Sander are working with Jon -D -Farms on a possible expansion of their facility, that
would have to come before the Board, if they go through with this plan.
The staff will bring an update on tabled items to the Board next month.
Fisher told the Board that the Bettendorf and Gunderson cases are in court, and that the County has
asked to have these lawsuits dismissed. The Sukowatey case is in court as well. The County is
waiting for a Decision by the Judge. Discussion held. Staff will continue to update the Board on
these cases.
Motion by Peterson, second by Golz to adjourn the meeting at 9:35 a.m.
