The Board will view each site in question, after which the Board will deliberate and vote on the appeals. Julie Speer, Chairperson St. Croix County Board of Adjustment AMENDED BOARD OF ADJUSTMENTS MEETING AND HEARING MINUTES September 26, 2002 The meeting was called to order by Chairperson Julie Speer at 8:30 a.m. A roll call was made. Julie Speer, Nick Golz ,Rich Peterson, Tom Rose and Stan Krueger were present. Staff included: Steve Fisher, Zoning Director, Rod Eslinger, Zoning Specialist, Deb Zimmermann, Administrative Assistant, Greg Timmerman, Corporation Counsel and David Sander, Land and Water Conservation Department. Chairperson Speer believes this to be a properly noticed meeting. Motion was made by Rose seconded by Krueger to adopt the agenda. Motion carried. The Board set the next meeting date as October 24, 2002 and will be held in the County Board Room at the Government Center. The starting time will be 8:30 a.m. NOVEMBER/DECEMBER HEARING DATES: A discussion was held on the dates for the November and December hearings. The dates will be as follows: November 21" and December 19 Both meetings will be held in the Community Room in the lower level of the Government Center in Hudson. CORPORATION COUNSEL REPORT/ UPDATE ON VIOLATIONS AND LITIGATION Corporation Counsel will be available if needed. UNFINISHED BUSINESS Rivard Family Trust Krueger recused himself from this article, as he has a conflict of interest. Eslinger reminded the Board that this request was tabled last month for more information. The request is for a special exception permit to expand an existing quarry in the Town of Somerset. Eslinger went over the staff report, pointing out the reasons for tabling the request at the last hearing, and presented the additional information submitted by the applicant in response to the information requested. Greg Timmerman, Corporation Counsel was present for legal advice if needed. Eslinger handed out correspondence from concerned citizens in regards to the expansion of this operation. Richard Marino and Jeff Redmon were sworn in. Marino is representing Kraemer Company and Redmon is an attorney present to answer questions on behalf of the Kraemer Company. Marino believes that they have addressed and answered every item of concern from the Board and the county staff. They plan to take measures to control the dust and noise created by the quarry, and will place white pines on the northern berm for additional screening from the St. Croix River. Marino reminded the Board that the quarry is existing and is allowed to operate. This is an expansion of a business that has been around for a long time. Redmon added that they received inquiries from LWCD a week ago, and responded as quickly as possible. He added that he believes the concerns of the LWCD are technical, and Kraemer is willing to work with them on any outstanding issues. David Sanders, LWCD, agreed that they can work together on this. Redmon stated that the pit has been in operation since the late 1950's/ early 1960's, and the fact that it has been in operation since then, is grandfathered in. Kraemer's felt it was the right thing to do to come before the Board for the expansion. Timmerman asked if the intention of the Rivard's was to continue the mining operation into this requested area, and Redmon answered that it has been their intention to do just that. Larry Wolf and Craig Burisch, being duly sworn, are adjacent property owners to the quarry. Wolf stated that if this is approved, would like to see them work to be as compatible as possible with the area. Burisch had concerns with noise, impact the operation may have on the St. Croix River Valley and stated he would like to see Kraemer leave the site after the highway project is completed. The Board will make a decision later today. It was noted that Stan Krueger re joined the Board at this time. Robert Gandee Eslinger updated the Board on this variance request that was tabled at the last hearing. The original request was for a 7 -foot variance to allow an existing home, deck and attached garage to remain in the side yard setback of a neighboring lot. Staff has received a letter from Cynthia Smith, agent for the parties, stating that this matter is in the process of being resolved. The owners have agreed on a property line location and a new deed has been drawn up. Staff is asking the Board to table for 30 days to allow the recording to take place. Once the deed is recorded, the issue will be resolved and there will be no action needed by the Board, as a variance will not be required. Motion by Golz, seconded by Peterson to table for 30 days to allow for deed to be recorded. River City Disposal Eslinger explained that he has reviewed this file and has been out to the site. The permit was for a roll -off dumpster and truck repair business. There were two dump trucks at the site, and the applicant has responded by saying that they are just storing the trucks on site for their business. Staff does not see this as a major expansion of the business. Staff will also be checking to make sure that the plantings at the site have been completed. Discussion held by the Board. The Board asked that the applicant make arrangements to come before them again in October or November to explain their intention for the business, and whether or not they plan to expand, or abide by the permit that was issued. NEW BUSINESS Chairperson Speer welcomed everyone in attendance and gave a brief overview of how the Board of Adjustment meeting is conducted. Julie Speer, Chairperson St. Croix County Board of Adjustment Article One: Mick Howland Eslinger explained that this request is for a special exception permit for a major home occupation business known as the Dry Dock. The business would be located in an 860 square foot accessory structure on the property. The following exhibits were introduced: 1. Staff Report 2. Application for special exception with narrative 3. Location map Eslinger stated that the neighboring property is located 500 -feet from the accessory building on the Howland property, and is in compliance with the ordinance requirements. The business is a "fix -it" shop and all work would be constructed from inside the accessory structure on the property. There are four part-time employees, whose total time equals approximately 40 hours per month. The Town of St. Joseph has recommended approval of the request. Mick Howland, being duly sworn, is the applicant. He explained that the employees are family members, his wife, a stepson and his 12 -year old son who helps on occasion. He has a friend who is a chemist, and another friend who is a contractor, who occasionally give him advice, but are not on the payroll. Howland entered Exhibit 4, an aerial photo of the property, sharing with the Board. The area around the shop is asphalt. He has received positive response from the town, and community that this business serves a need for the community. Approximately 70% of his business is conducted off site. There are no hazardous materials stored on site. He explained that he was the safety manager at General Motors for years, and is very safety conscious. There are three fire extinguishers at the site. There was no opposition to the request. The Board will view the site. Article Two: Lance Bohler The applicant was not present for the hearing. Motion by Rose, seconded by Peterson to table until the applicant is present for the hearing. Motion carried on a unanimous vote. Staff will contact the applicant and place on the October agenda. Article Four: St. Croix County Parks Department Eslinger told the Board that this request is for a rip rap project on the St. Croix River at Troy Beach Park in the Town of Troy. The following exhibits were introduced: Exhibit 1: Staff Report Exhibit 2: Application and Plans Exhibit 3: Location Map Exhibit 4: Letter from the Town of Troy approving the request with some stipulations (read into the record) Eslinger went over the staff report, explaining that the proposed project is to correct an erosion problem that has occurred on the banks of the St. Croix River. The Parks Department and Land and Water Conservation Department have been working with Humphrey Engineering on the plans for this project. Staff has not heard from the DNR or the Army Corps of Engineers. Joe Grant, being duly sworn, is representing the Parks Department. He explained that the recent floods have created some erosion problems, and they need to be repaired. The parks has received approval by FEMA for 87 '/2% of the cost share. The approximate cost of the project is $30,000 to $32,000. The plan is to do this project over the winter 4 months. Grant said that they have submitted the paperwork to the DNR for the Chapter 30 permit. The Board will view the site. Article Three: Terry Holme Eslinger told the committee that this request is for a contractor storage yard in the Town of Warren. The business is named "RT Resurfacing" and specializes in decorative concrete for residential and commercial properties. The property is approximately 10 acres in size. The Town of Warren was noticed, but to this date, staff has not received anything in writing. The following exhibits were introduced: Exhibit 1: Staff Report Exhibit 2: Application for special exception with narrative Exhibit 3: Location Map Terry Holme, being duly sworn, is the applicant. Holme shared a copy of his brochure with the Board. He explained that he resurfaces concrete for homes and commercial businesses. There are no retail sales, and all materials are delivered to the job site, so no materials stored on site. He has very little equipment, only a snowmobile trailer and a pressure washer. At some point, he may put up a shed, but not at this time. Holmes added that the Town of Warren approved his request two months ago at a Town Board meeting. Staff will check on getting a letter from them. There was no opposition to the request. The Board will view the site. DECISIONS• Rivard Quarry / Kraemer Company Krueger recused himself from this article. The Board previously viewed this property at its meeting on August 22 °d . Motion by Golz, seconded by Peterson to approve the request for an expansion of the existing non- metallic mining operation based on the following findings: The existing Rivard Quarry has been in operation for approximately 40+ years. This request is for an expansion of the existing non - metallic mining operation. Testimony was given at the hearing that the Rivards' intention has always been to continue operation of this quarry and to mine into the area that is being requested for expansion. The questions raised by the Board at the August 22 "a hearing have been addressed. 2. The plans for the project have been professionally designed. The Board believes the applicant has addressed the concerns of the public with the revised plans that were submitted. 3. The applicant has agreed to work cooperatively and on an ongoing basis with the various government agencies and with the Town of Somerset. 4. The Board believes this quarry serves a public need to the area, and that there are few aggregate sources available in the County. 5. The Town of Somerset has recommended approval of the request. With the following conditions: 1. The Kraemer Company is to work with the St. Croix County Land and Water Conservation Department (LWCD) on their list of concerns presented at the September 26 hearing. The authorization for the expanded operation will not be valid (thus no earth- moving may take place) until the Land and Water Conservation Department concerns have been met and approved to the satisfaction of the LWCD. If an agreement cannot be reached between the two parties, Kraemer is to come back before the Board of Adjustment at the next possible meeting date. 2. This expanded operation is valid for a period of 5 years and expires September 2007. Applicant must either fully reclaim the site in this time frame or reapply for a new operational plan permit. The applicant is to contact the Zoning Office six (6) months prior to expiration date, so that reclamation or permit renewal is complete by the expiration date. 3. The non - metallic mining project is to proceed according to plans presented. Any expansion beyond this legal boundary shall require a new operational plan permit. 4. Operator /applicant shall comply with all of the general requirements and conditions listed in the Non - metallic Mining & Reclamation Ordinance (Ordinance # 226 (89) as attached and made part of the record (unless varied per conditions). 5. The applicant is responsible for dust abatement during the duration of the operation as proposed in the revised plans presented at the September 26 hearing. 6. The hours of operation for materials, handling, drilling, blasting, crushing and hauling shall be from 7:00 a.m. to 6:00 p.m. Monday through Friday. The Rivard Stone operation will conduct retail sales from the shop and the quarry on Saturday from 7:00 a.m. to 6:00 p.m. 7. The permit includes temporary placement of equipment necessary to conduct the mining operation. 8. The disposal of solid waste is prohibited at this site. 9. Site reclamation shall proceed according to the reclamation plan as approved by the Board. 10. Legal re- mediation arrangements shall be made with the Town for damage to Town haul roads. 11. The operation shall be reviewed by the Town Board and Zoning office one -year after commencement of operations to ensure operation is commencing as designed and ensure conditions are adhered to. 12. Berms to be erected as designed on revised plans dated September 51h 13. A wash -pit is not allowed until a design is submitted and approved by the county. 14. A Reclamation Bond will be submitted to the county in the form of cash bond, security bond or irrevocable letter of credit in the amount of $1,000 per open acre of land pursuant to Ordinance No. 226(89)F.8. In no event shall the approved bond be less than $20,000. 15. The existing well on the site shall be decommissioned per DNR specifications. 16. Refueling shall occur in a self - contained area where spillage can be captured. 17. Any breaks in berms or failures in erosion control practices must be repaired within 24 hours. 18. All slopes steeper than 3:1 shall have erosion control fabric installed that meets the WisDot Class II type B or equivalent. 19. The applicant shall provide designs and calculations for the proposed storm water pond. The designs and calculation must be certified by a licensed engineer in the State of Wisconsin, and approved by the St. Croix County LWCD. 20. All temporary seeding shall be seeded at a rate of 65 pounds (pls) to the acre, mulched, and fertilized per soil test recommendations. 21. The applicant must submit the specific seed rate for the permanent seeding for county review and approval by the St. Croix County LWCD. Any permanent seeding shall be mulched and fertilized per soil test recommendations. It is recommended that after reclamation and final grading, the site vegetation be returned to the mesic southern forest habitat. 22. Any change (or addition) in use, or expansion of the non - metallic mining project shall require review and approval by the Zoning Administrator and in some circumstances through the Board of Adjustment approval process, where applicable, as stated in the ordinance. 23. These conditions may be amended or additional conditions may be added if unanticipated conditions arise that would affect the health and/or safety of citizens or degrade the natural resources of St. Croix County. Conditions will not be amended or added without notice to the applicant and an opportunity for a hearing. 24. Accepting this decision means that the applicant has read, understands, and agrees to all conditions of this decision. The following vote was taken to approve: Golz, yes; Peterson, yes; Rose, no; Chairperson Speer, yes. Motion carried. Krueger recused himself from taking part in any discussion and voting of this request, due to a conflict of interest. The Board recessed to visit the remaining sites at 12:20 p.m. Krueger re joined the Board for the site visits. The Board reconvened at 2:35 p.m. to render the remaining decisions. Article One: Michael Howland Motion by Golz, seconded by Rose to approve the request for a special exception permit for a major home occupation to operate a business knows as The Dry Dock, based on the following findings: 1. The Town of St. Joseph has approved of the request. 2. The business provides a unique service to the community. 3. The property is screened and is located in a secluded area. 4. The use is compatible with the Ag/Residential area. 5. There was no opposition to the request. 6. The spirit and intent of the ordinance would be met by granting this request. With the following conditions: 1. This approval is for a major home occupation for the business known as the "Dry Dock" and is approved as submitted. 2. The total floor area dedicated to the home occupation, including any area used in the dwelling, shall be limited to a maximum of one thousand (1,000) square feet. 3. Hours of operation for the home occupation shall be limited to 8:00 a.m. to 10:00 p.m. 4. All business related products to be stored inside the building. Outside storage of business related material is prohibited. 5. This approval does not include storage of hazardous materials onsite. 6. No more than two (2) persons other than a resident of the principal dwelling may be employed or engaged in the business. 7. One (1) sign is allowed with total signage area not to exceed 6 square feet. This sign must be located a minimum of 10 feet from all property lines. Any other signage must be approved by the zoning department and must strictly adhere to the St. Croix County Signage Ordinance. 8. Applicant to maintain a minimum of one (1) parking space for each 300 square feet of business use, plus one parking space for each family for which accommodations are provided on the premises. (Note: For this request, three (3) spaces are required to be maintained for the business). 9. Applicant to maintain proper state licensing to operate the home business. Applicant to maintain proper state licensing to operate the home business. 10. The applicant shall secure all necessary town approvals, including compliance with any building code issues. 11. The applicant is to contact the Town of St. Joseph fire department to have an inspection conducted of the site, to insure that the fire extinguishers are up to code, and that the building is equipped with the correct number of extinguishers in case of a fire. Applicant is to provide the zoning office with proof that his inspection has been completed. 12. The applicant shall have one (1) year from the issuance of the Special Exception permit to act on the Special Exception permit. Failure to commence business operation in this period shall result in the expiration of this Special Exception permit. If the Special Exception permit expires, the applicant will be required to secure a new Special Exception permit before commencing the business operation. 13. Any minor changes (or additions) in expansion of the project, including the business, signage, lighting, hours of operation, shall require review and approval by the Zoning Director. Any major change and/or addition to the originally approved plan will go through the Special Exception approval process, where applicable, as stated in the ordinance. 14. These conditions may be amended or additional conditions may be added if unanticipated conditions arise, that would affect the health and/or safety of citizens or degrade the natural resources of St. Croix County. Conditions will not be amended or added without notice to the applicant and an opportunity for a hearing. 15. Accepting this decision means that the applicant has read, understands, and agrees to all conditions of this decision. The following vote was taken to approve: Peterson, yes; Krueger, yes; Rose, yes; Golz, yes; Chairperson Speer, yes. Motion carried. Article Three: Terry Holme Motion by Rose, second by Krueger to approve the request for a Special Exception permit for a contractor's storage yard to operate a business known as RT Resurfacing, based on the following findings: 1. The Town of Warren has approved of the request. 2. There were no objections to the request. 3. The operation is small and compatible with the surrounding neighborhood properties. 4. The spirit and intent of the ordinance would be met by granting this request. With the following conditions: 1. This permit allows "RT Resurfacing" to maintain a contractor storage yard to store equipment and supplies related to the business and to have an office onsite. 2. Deliveries shall be limited to the hours of 8 a.m. to 6 p.m. 3. The contractor storage yard must be screened. Pine trees of 3 -feet to 4 -feet to be randomly planted at the back of the property. Planting to be completed by July, 2003. 4. Applicant must secure any necessary town building permit approvals prior to commencing construction. 5. The property shall be kept in a neat and orderly manner. No junk, junk cars or garbage shall be allowed to accumulate on the property that may attract rodents or pose a threat to the health, safety and welfare of those citizens of St. Croix County. 6. No onsite retail sales is allowed. 7. Security lighting to be installed. Lighting must be illuminated downward and is to be shielded away from neighboring properties. (A light plan may be required, if warranted) 8. No hazardous materials to be stored inside the facilities. 9. The applicant must allow free and unlimited access to the project site at any reasonable time to any Zoning Office employee to inspect the property for compliance with these conditions. 10. The applicant shall have the zoning administrator review this special exception permit in two years from the approval date for compliance with this approval (September 2004). 11. Any change (or addition) in use, or expansion of the project, including building, signage, shall require review and approval by the zoning administrator and in some circumstances through the Special Exception approval process, where applicable, as stated in the ordinance. 12. The applicant shall have one (1) year from the issuance of the special exception permit to commence the operation. Failure to do so shall result in revocation of the special exception permit. If the special exception permit expires before business commences, the applicant will be required to secure a new special exception permit before starting or completing the project. 13. These conditions may be amended or additional conditions may be added if unanticipated conditions arise, that would affect the health and/or safety of citizens or degrade the natural resources of St. Croix County. Conditions will not be amended or added without notice to the applicant and an opportunity for a hearing. 14. Accepting this decision means that the applicant has read, understands, and agrees to all conditions of this decision. The following vote was taken to approve: Golz, yes; Peterson, yes; Krueger, yes; Rose, yes; Chairperson Speer, yes. Motion carried. 9 It Article Four: St. Croix County Parks Department Motion by Golz, seconded by Speer to approve the request for a Special Exception permit for a rip rap project at Troy Park located on the St. Croix River, based on the following findings: 1. The Town of Troy has recommended approval of the request. 2. There was no opposition. 3. The granting of this request will correct an erosion problem on the embankment of the St. Croix River and will stabilize the slope on the public park property from further erosion. 4. The plans have been designed and approved by a professional engineer. 5. The spirit and intent of the ordinance would be met by granting this request. With the following conditions: 1. The applicant shall work with the St. Croix County Land and Water Conservation Department and Humphrey Engineering during this project to insure that the plans are implemented as designed and approved. 2. The applicant is to notify the Zoning Office at the commencement and completion of the project. 3. Comply with all DNR and Army Corps of Engineers requirements and obtain any permits necessary. 4. The applicant shall have one (1) year from the issuance of the Special Exception permit to act on the Special Exception Permit. If the Special Exception permit expires, the applicant will be required to secure a new Special Exception permit before commencing the rock rip -rap project. 5. Any minor change (or addition) in expansion of the project, shall require review and approval by the Zoning Director. Any major change and/or addition to the originally approved plan will go through the special exception approval process, where applicable, as stated in the ordinance. 6. These conditions may be amended or additional conditions may be added if unanticipated conditions arise that would affect the health and/or safety of citizens or degrade the natural resources of St. Croix County. Conditions will not be amended or added without notice to the applicant and an opportunity for a hearing. 7. Accepting this decision means that the applicant has read, understands, and agrees to all conditions of this decision.
