Jeff Lauck, being duly sworn, stated thaE this entire parcel
was rezoned commercial . He is not sure where tshe sales fot
will be focated at. at t.his t.ime. They may want to put up mini
storage units in the future. As far as service and repair,
most. or all of the service and repair will be on vehicles for
sa1e. occasionally someone wil-1 have a vehicle in for repair.
There is no floor drain. cas and oi1 wiff be disposed ofproperly. They wiII have 2 to 3 employees besides himself.
They don't plan on this being large. They may have up to 15
to 20 RV's, same number for automobiles, trucks, boats. This
Iot has a nicer buitding to work out of than the building
across the road.

Lauck has a similar building on the other side of t.he road atthis t.ime. Ne1son indicat.ed tshat there is a 100' minimum
setback for parking of vehicles back away from the highway.
The property around the property in guestion is almost all-
zoned commercial.
At the Board of Ad j ust.ment. hearing which was held on February23, L995, Tom NeIson, Zoorl1g Administrat.or. indicated t.hat atthe Board of Adjustment hearing on ,fanuary 26, ]-994 the Boarddid nots approve this applicat.ion. It needed some additionalinformation such as a bet.E.er site p1an, tshe need to identify
t.he parking areas, right-of-way 1ine, information concerningthe septic system and code compliancy on the building itself.
Nelson sEated thaE he has received information only on EhesiEe pl-an and that Lauck was to be bringing i,nformation with
him concerning t.he building.
Jeff Lauck, being previ-ousl,y sworn, stated that he broughtwit.h him a new site plan which was a liEEIe clearer.
Introduced as Exhibit #1 was the site plan identifying thepropert.y a lj-t.t1e bit better,. Exhibit. #2, copy of a sanitarypermit and inspection sheet, instaLled ll/79/8o; Exhibit #3,hand drawn sketch of Ehe building with the proposed
configurat.ion of rooms in the building and their services.
Nelson questioned Lauck regarding the fire hydrant which wasinstalLed. Nelson stated he believes E.he hydrant is too closeto Ehe septic tank. There is a need for this to be moved.
Lauck st.ated they have no outside waEer. This was installedlast August .
Lauck stated he tafked with ,fim Rusch, Countsy Surveyor, who
looked up the road right.-of -way. The minimum in spots was 50feet and the maximum was 100 feet. Lauck stat.ed he has red
f l-ags that display the 100 foot right-of-way out. aE Ehe sitse.
He doesn't want. the displ,ay parking to be any closer to tsheroad. Lauck indicated on Exhibit #1 the following:

Lauck went on t.o st.ate Ehat the 3 phase power is stilf hooked
up but is inoperable. NSP was notified to unhook it. Thereis no power goj-ng to its. The ropes are gone, the motors have
been disconnected.
Lauck just does some repair to his own vehicles. The StsaEerequires that. if you are licensed you must have a pLace forvehicles to be pulled out of Ehe rain for customers. Lauck
has one 55 galIon drum of waste oiI, and the antifreeze he
recycles. They have a maximum of 55 gallons of new oif.Batteries they recycle, tires they don't do anything with.
They have no plans to make the building bigger. Most vehicleswill be for sal-e. Only a couple are not for sale at. thistime. Bathrooms wil-1 be operational .

Martin LeVake, being previousLy sworn, indicat.ed that he representsLevque Tower SysEems. LeVake indicated Ehat Lhe consultingengineers in Madison get over 200 plans a year to approve so Levakehired Scott Nordin, who is a professional registered engineer inthe St.ate of Wisconsin, t.o view his plans. The factory gets Eheapproval from Nordin, he fill,s out an application. Levake senE 4books to Nordin. Each one had Eo be signed by a Wisconsinengineer. Nordin signs everyEhing and sends the applicaE.ion toMadison. They are t.hen reviewed and Nordin consults wj-th them andthen everyone signs off on the project st.at.ing it is a safest.ructure. Nordin will inspect the footings and Lhe base of thetower. LeVake indicated thats he paid $250 Lo the State for thepermit. He has paid $600 t.o Nordin to look everything over. Zoning Administ.rator Nelson stated that. Levake had been Lo the
!.ownship for a building permit, which was not issued, which wasright. The Town Clerk cal-Led him concerning the new information of

Levake stated that the tsownship is questioning wherher or not they
have enough ground Lo put the Lower on. The t.ownship claimed t.hat.
LeVake was to be at the site on a certain date and he was not told
Ehat date. Levake stsatsed that t.he board members who were on the
t.ownship board aE. tshe Eime of his firsc proposal are no longerthere. He is anxious to get matters settl-ed. They would like toerect Ehe lower in May. Levake indicaE.ed that the new buj-Idingshaven't been shared witsh the t.own board, just Ehe t.own chairman,

knows everything involved. He should go t.o the town board and then

won't be back until the first parts of May but indicated that his

Orrin Summers, previously sworn, indicated that he has been sick
and hasn't been to the site since the last hearlng. He indicat.ed
Ehat he did cafl Kadinger and after March 1st. Kadinger wrll- starE.hauling vehicles away. Summers stated that Ehe Town of PleasantValley is close knit and prejudiced. Anyone that. is an out.sider
st.ays an outsider. He is not. trying Eo do any less or any more
lhan anyone else is out there. Summers stated Ehat he intends to
use the 10 pole building as his main building Eo work out of. He
has one vehicfe out Ehere t.hat doesn't belong to him and his son
has a couple of chassis ouE Ehere. He will not. be tsaking anyoneelses vehicles. The shop is a metal building which has a woodbarrel stove in it. IE was indicated to Mr. Summers that the Board
would make a decisi.on later this daEe as to how many cars he could
have on the premises ats one time. Summers st.at.ed Ehat he would
abide by whatsever decision the Board makes.
Donna Hauser, being duly sworn, stated that their place is kiddy
corner from Orrin Summers' p1ace. Not.hing againsL Orrin, but they
don't. want him to have a salvage yard there. Her son runs Hauser
Auto Repair. If Orrin geEs a commercial- f i-cense to paint cars and
keeps it. neaE they would have no problem with it. NeIson indicatsedthat Orrin salvages vehicles and selLs t.hem. Donna Hauser inquired
why Orrin Summers didn't. have E.o have a commercial, License Eo fix
and seII cars Iike they do.
Mary Zwa1d, being duly sworn. staEed she owns property to t.he west.of the property j-n question. Mrs. Zwald staEed that Summers has
been there for 1-7 months. Things are just geEting worse. She is
concerned with the drainage. The Parker Creek Watser Shed Project
dumps into the Kinnickinnic. There are 2 culverts in place Ehat go
under Highway N on their properEy thaE handle run off. There are25 cars on the propertsy at this tsime. What happens if t.he Board
okays this and Summers moves ouE there. They have 5 drivers nowwith 8 cars. The house is right on Highway N. Two more kids wil-I
be driving in t.he near future. There is just not enough room Lopark out t.here for that many cars.
Orrin Summers, being duly sworn, stated that the issue here for the
Zwalds is that they had a chance to buy the rest. of the properE.y
and didn't. They would l-ike to have Ehis properEy now and wished
t.hey would have bought it. Summers stated he has a land contract.for this property. Summers slaEed that Z$ralds can't see what he is
doing from his house now.
Roberts Zwald, previously sworn, st.ated he doesn't know where
Summers got the information that they wanted Eo buy Ehis properEy.If Lhey woul-d have known this would have happened they would have
bought it..

Ehe centerline of C.T.H. 42' x t2i-, mini storage warehouse.Nelson statsed that an aII weather surface usually surrounds thebuilding. Jim Harper indicated that it is gravel. Nel-son went ont.o state that Ehere are 24 individual st.orage units with 9, x g,

t.he past. They have had no problem wit.h the quarry being a party

Ehey keep the gatse up. They did have problems with people driving
around the gate but they dug ditches around t.he gate Eo make it
impassible also. Nel,son indicated thaE he had recently talked with
Gary Seen who owns E.he propert.y immediat.ely south of this property.
His greatest concern was noted at the tsime che first permit wasissued. With t.he sE.orm water run off being correcEed, he is now

Nerson indicated that this natter was before the Board severarmonths ago for a variance for a driveway. At that tine theapplicant requested a winding driveway. Strawns do not want thewinding driveway but instead wish to have a driveway that goesstraight out to the road. Introduced as Exhibit #1 was anillustration of where they would Iike the ner+ driveway to be.
Troy Strawn, previously sworn, stated that after driving on theirIawn-where the original proposal was to have the driv6way, theynoted it was tough to nake the hiII up into the garage. f-here isfiII there now to filf the hole in where the pr6posJ to have thenew driveway. exception use for a contractor storage yard for his portable toilet
business. He needed tolrnship approval at that time. Introduced as
Exhibit #1 was a letter from the Town of Stanton approving the
special exception use request for a contractor storage yard.
Nelson stated that the Zoning office also recommends approval for
the special exception use reguest. A motion was made by Neuman to
grant the special exception use of Rickie G. Powers for a
contractor storage yard, seconded by Mehls. A unanimous vote v/as
reflected. Motion carried.

Vice Chairman Dorsey introduced the other mernbers of the Board asbeing Tim Filipiak, charLes Mehls and Jerry Neuman. Tom Nelson,Zoning Administrator, vras present to assist the Board with theintroduction of the materials as well as recommendations as to hor{the ordinances applied. on call- was the St. Croix countyCorporation Counsel ,s Office. Vice Chairman Dorsey explained theprocedures of the hearing requesting that individuals wishing totestify sign their nane in the front of the room on the sign upsheet provided.
CheryL Kohort Laursen/Aqua-llates - Dean LaursenNelson stated that this is a request for a major home occupation.This is not a permitted use but rather a special exception use.
One of the things to look at is that it is 5OO feet fron anotherresidence or in excess of 1,OOO sguare feet. Introduced as Exhibit
#l- was a site plan of the property; Exhibit 92, copy of minutesfrom the Town of Somerset supporting this request.
Dean rLaursen, being duly sworn stated that the it is more than 5OOfeet to the next residence. He stated that they have po$rder andIiquid chlorine which is stored in a shed which is separate frornthe other sheds. They would only have approximately 3o five gal-1onpails. As far as trichloride, 5OO pounds naxirnum. He $rent on tostate that in 1978 he started his business. He wiII not beexpanding his business but instead down sizing it. This is aseasonal business. He has an 8 ton bobcat which is outside now.Everything else is inside except for one van. They also have adunp truck which is in a granary shed. They will have oils andsolvents for the bobcats and trucks which they will be disposing ofproperly. He stated that they don,t anticipate adding any vehiclesin the future. william Fye, being duly sworn, stated that he represents Sollon
Springs Telephone company. Their main purpose is put in a remote
site, to run cables together from the east, west, north, south as
a junction site. The pl-atform is 6'x 10'. It wiII be raised off
the ground L to 1l'. The height of the cabinet wiII be 24rr to 30rr
tall and will be located in the northwest corner of the property.
It $riII be a minirnun of 50'off of the roadway and located 70'to
8O' fron the centerline of the road. There is an existing driveway
there to bring vehicles in and out for maintenance when necessary
which needs some work. No towers are required for this project.

has approved this already.

repair. This is not a pernitted use in the commercial district but
rather a special exception use. He recently r.rent thrqugh the
rezonement. Introduced as Exhibit #1 was a site plan showing the
Iocation of the property in relationship to Highways 35/64; Exhibit
#2, copy of minutes from the Town of Somerset supporting the
application. NeIson indicated that he is concerned with the
disposal of solvents or storage of them on the property and salvage
of autos at the business.
Jeff Lauck, being duly sworn, stated that this entire parcel was
rezoned to commercial. He is not sure where the sales lot will be
Iocated at this time. They nay want to put up mini storage units
in the future. As far as service and repair. most or all of the
service and repair will be on vehicles for sal-e. occasionally
someone wiII have a vehicle in for repair. There is no floor
draj.n. Gas and oil will be disposed of properly. They will have
2 to 3 employees besides himself. They don't plan on this being
large. They may have up to 15 to 20 RV's, same number for

autonobiles, trucks, boats. This lot has a nicer building to workout of than the building across the road. Lauck has a similarbuilding on the other side of the road at this tirne. Nelsonindicated that there is a 1OO, minimum setback for parking ofvehicles back away from the highway. The property around theproperty in question is alnost a1l- zoned comnercial .

Roger Wilbur, being duly sworn, stated that he asked Jerry Neunanfrom the Town of somerset if the whole parcel would be converted tothe najor home occupation. He r^/as wondering if you have to l"ive onthe property. wilbur indicated that he doesn,t knos, for sure ifDean Laursen lives on the property or not. He $rent on to state theDean Laursen broke down in front of his place and in tatking withLaursen, Laursen stated that either his son or his daughter wasgoing to be moving into the house, he couldn,t renember which one.

Nelson indicated that this is a request fron Kuryakyn Holdings toexpand a comnercial sales and distribution center on the proparty.Introduced as Exhibit #1 was a copy of a CSl,t of the aevetopmentshowing the location of the property; Exhibit #2, second map frornthe tax listers office; Exhibit #3, copy of blue prints consistingof 3 pages showing the location of the proposed building; Exhibit#4, copy of minutes from the Tor.rn of Somerset apprbving thepreliminary pLans for expansion of the property. Mike Jordon, being duly sworn, stated that he represents KeIlisonConpany. The business has currently been there 2 years. They haveoutgrorirn the existing facility there. The applicant wants toexpand the business. They currently have office space for phoneservice and 2 existing buildings for warehousing and shipping.Outside vendors make attachments for rnotorcyclei and the-y arebrought to the site and they ship them out. The existing structureis 20 to 25 feet fron the property Iine. The bu-ilding wasidentified on the CSM and the property Iisters statement. Jordonstated that these are all beauty products which are added tomotorcycles, i.e. fenders, gas tanks, handle bars, mirrors, etc.These are only demonstration motorcycles. They only have householdchenicals there besides car wax and buffing cornpounds. They haveI office staff and 6 people in shipping and recLiving for a totalof 14 employees. They share the access to this property with two

other businesses as well as a residence. There is also a culdesac
for 3 other driveways concurrent to this access. The semi trucks
straddl,e everyone's property Iines. At this time this is a comrnonparking lot for everyone. They recently talked to the truck
drivers and they currently are having the trucks do a three point
turn around going into the property and then again going out of theproperty. They have approximately 6 semis go in and out to deliver
and pick up things in a rnonths time. Nelson indicated that this is
one of the things the Board will have to look at while out there
viewing the property. Jordan stated that the asphalt now is 30'
vride and it turns into a single lane closer to the buildings.
Nelson stated that they nay have to obtain an easement from theadjoining property owners for access. There is a need to checkj-nto that. This may be a requirement. Jordan stated that no oneout there has comrnitted to a single access at this time but rather
a colntnon access. They have nD customers that come out to the site.This is strj.ctly a mail order business. Parking is designated for
employees. If more staff is acquired, they would have to create a
bigger parking area for additional parking. The existing road j,s
nore on the adjacent property. They wilI be building the road rnoreon the property line and up to standards. They rrill give an
easement to the residence adjacent to this property. There is nota problem with drainage or run off on this property.
The board stated they are concerned with fire safety and access offire emergency trucks to this bui1ding.
Jordan indicated that the state approved plans have been put onhold. The metal building needs a deposit and they need theirengineer's calculations for the buitding before the State approved
pl-ans are sought. The existing septic system is inadequate so a
nev, system will have to be installed.

He went on to statethat he would like for the Board to grant the perruit. He thought

He stated he has workedon a to$rn board member,s car when he was going to college.Lorraine Monson was on his side at one time but she has changed hermind since then. He indicated that he doesn,t work there everyday. He stated he buys the cars, fixes thern up and resells then.
He has found out that he can buy the cars, as tnany cars as he lrantsjust so that they are titled in his name. He doesn,t $rant over 25cars total on the property at one tirne. He needs to buy the cars
when the price is right. If someone else wants a car repaj.red hegoes to. their place. He stated that he does do some painting onthe vehicles but stores no more than 5 gallons of paint at one tirnethere on the premises. He may have up to 5 gaflons of lacquerthinner there at one tirne. when he drains antifreeze he reclairnsit and stores it in 5 gallon plastic containers.
Sarah Sunners, being duly sworn, stated that she is Orrin Summers,oldest daughter. She has helped her father in the past and feelshe is not hurting anybody. She helps hin out with the paperwork.
She has gone with him to Eau Claire to get vehicles licensed andalso runs parts for her dad. she i4dicaied that 3 children in thefamily drive at this tine.
Richard Zwald, bej-ng duly sworn, stated that he is a supervisor forthe Town of Pleasant Val-Iey. He indicated that he has nothingpersonal- against I{r. Summers but is just concerned about thesituation. Introduced as Exhibit #8 was a copy of an article fromthe Minneapolis Tribune trhich rel-ates to junkyards with runoff.Introduced as Exhibit #9 is a copy of an Army Corp of Engineers mapwhich sho$/s where the water runs. Zwald indicated thai they haveworked with Sunmers for over a year, They $/ant him to clean theplace up and put as many vehicles inside as possible. He feel-snothing will change wj.th Mr. Summers. They have checked on thepast history of past residences for Mr. Sunmers and those placeshave had sinilar problems as they are having with Mr. Sunmers.

Nelson, Zoning Administrator, stated that the Zoning Office knowsthere are other violations out there and will be getting to them.Right now they are dealing with the Sunners place only.
Lurene Bahnsen, being duly slrorn, stated that she Iives to the eastof Orrin Summers. She is a pig farrner and she has nothing agai-nstMr. Surnmers. When Summers moved in she went over to see hin.
Summers stated at that tine that he was going to have a body shopout there. She recently got a letter fron the Zoning office
regarding his salvage yard. On f/L8/95 she call-ed Jim Thompson ofthe Zoning Office who indicated that citations had been ibsued toMr. Summers. Summers told her that he got an extension to get thecars under cover. She indicated that there is not a dumpster outthere, no recycl j.ng. She is concerned about what will be happeningout there-
Tom AfdahL, being duly s$/orn, stated that he is the town board
member Sunmers referred to in which his car was worked on. Afdahlindicated that Summers does excellent work. The people of PleasantValley did vote to defeat the special, exception use request. He
v/ent on to state that he feels Mr. Summers needs a break. He hasgone through rough tirnes. He was in vietnam. Afdahl indicatedthat he shares the common concerns of the rest of the peopl,e here
today .
During the course of Afdahl's testirnony, Mr. Summers stood up and
advised the Board that he didn't r^rish to pursue his request for asalvage yard if the people fron Pleasant VaIIey don't want hirnthere in the first place.
Later in the morning, orrin summers again came before the Board andindicated to then that he v/ould Iike to reinstate his permitapplication and continue \dith his hearing. He stated he can Iivewith any decision the Board makes. A motion was nade by Neuman,
seconded by Filipiak to reinstate Summers' permit appl-ication.
Motion carried. The natter will again be heard next nonth.

Tom Nelson indicated that this is a request to build a two familyresidence on property that is zoned Ag. -Residential- . This is not
a pernitted use but rather a special exception use. Introduced asExhibit #1 is a site plan; Exhibit #2, copy of building plans
showing a blue print of the structure. The Board needs to addressthe septic system, vehicle access and any other possible
construction on the property.
