The Board will view each site in question, after which the Board will deliberate and vote on the appeals. 1. ARTICLE: Variance request to exceed the height requirements of an accessory structure pursuant to Section 17.12(5) of the St. Croix County Zoning Ordinance. Request is for a three foot variance to the 15 -foot accessory structure height requirements. APPELLANT: Thomas and Theresa Geisffeld LOCATION: The NE 1 /4 of the NE 1 /4, Section 34, T31 N -R19W, Town of Somerset ADDRESS: Off of 605h Street, Somerset, Wisconsin All interested persons are invited to attend said hearing and be heard. OFFICIAL BOARD OF ADJUSTMENTS MEETING AND HEARING MINUTES November 21, 2002 The meeting was called to order by Chairperson Julie Speer at 8:30 a.m. A roll call was made. Julie Speer, Nick Golz ,Rich Peterson, and Stan Krueger were present. Tom Rose was absent and excused. Staff included: Steve Fisher, Zoning Director, Rod Eslinger, Zoning Specialist, and Deb Zimmermann, Administrative Assistant. Chairperson Speer believes this to be a properly noticed meeting. Motion was made by Peterson seconded by Golz to adopt the agenda. Motion carried. The Board set the next meeting date as December 18, 2002 and will be held in the County Board Room, at the Government Center. The starting time will be 8:30 a.m. MINUTES Motion by Golz, seconded by Krueger to amend the September 26 minutes, with the amendment to include the Decision for the Michael Howland request, which was omitted in the first set of minutes. Motion carried. Motion by Peterson, seconded by Krueger to adopt the minutes from the October 24 hearing as written. Motion carried. CORPORATION COUNSEL REPORT/ UPDATE ON VIOLATIONS AND LITIGATION Corporation Counsel will not be available today. The variance criteria discussion will be placed on the December agenda. OTHER BUSINESS River City Disposal, Inc.: Mark Rasmussen of River City Disposal explained to the Board that he is in the process of re- applying for an expansion of the business. The landscaping on the property has been completed. There are two front load trucks on the property, one is being used, but one is being repaired. These will not be kept on site. Eslinger explained that the special exception permit is for a roll -off dumpster business, and the Board asked staff to follow up on the conditions. The construction of the storm water pond is complete and the semi - trailers have been removed. The truck repair business on the site is allowed with the permit. Rasmussen is not sure when he will be applying for the expansion, as it is contingent on bids. ANNOUNCEMENTS Eslinger informed the Board that all conditions have been satisfied regarding the Rivard Quarry special exception permit. The Kraemer Company has submitted one plan, laying out the entire process. Staff stated that the Kraemer Company has been very accommodating in working with the County. The Town of Somerset is responsible for monitoring their own conditions placed on the quarry. The Board was informed that the lawsuit with the Town of Warren has a court date of November 26 for an Injunction Hearing. The staff will keep the Board updated on this case. NEW BUSINESS Chairperson Speer welcomed everyone in attendance and gave a brief overview of how the Board of Adjustment meeting is conducted. Julie Speer, Chairperson St. Croix County Board of Adjustment Article One: Thomas and Theresa Geistfeld Eslinger explained that this request is for a 3 -foot variance to exceed the 15 -foot height requirements of an accessory structure. Eslinger went over the staff report with the Board. The following exhibits were introduced: 1. Staff Report 2. Application for special exception with narrative 3. Location map 4. Photos Eslinger stated that this property is 3 -acres in size, and is currently vacant. The applicant is planning to move to this property upon retirement, but would like to construct a building at this time to house recreational vehicles and for other storage. The site is 80% wooded with pine trees, and is approximately %2 mile from the Village of Somerset. The Town of Somerset has recommended approval of the request at its meeting of October 2, 2002. 2 Thomas Geistfeld, being duly sworn, is the owner of the property. He went over the photographs of the property with the Board (Exhibit 4), pointing out that the building will not be visible to neighboring properties. He has spoken with the neighbors, and has received approval from all of them. He went on to explain that he owns a large recreational vehicle, and plans to put in an electric lift to work on his vehicles. The building will be set 20 -feet into the wooded area. Geistfeld further stated that his home in Prescott is for sale, and they hope to get the house sold and build a new home on this property sometime next year. The Board will view the site. The Board recessed at 9:00 a.m. to view the property. The Board reconvened at 10:05 a.m. to render the decisions. DECISIONS: Article One: Thomas and Theresa Geistfeld Motion by Golz, seconded by Speer to approve the request for a three -foot variance to the accessory structure height requirements based on the following findings: 1. The Town of Somerset has approved of the request. 2. There were no objections to the variance. 3. The variance request is a minimal, alleviating the hardship to allow for the storage of a large recreational vehicle and an electric lift for vehicle maintenance. 4. All setback requirements have been met, as well as consideration given to setbacks for the construction of a future new road. 5. The color of the building will be earth tone 6. The structure will located among the existing pine trees on the property which will provide for screening from neighboring properties. 7. The spirit and intent of the ordinance would be met by granting this request. With the following condition: 1. The applicant will have 3 years from the completion of the accessory building to construct a home on the property. The following vote was taken to approve: Peterson, yes; Krueger, yes; Golz, yes; Chairperson Speer, yes. Motion carried.
