'I-SCO/h'l!! ORDINANCE TO REPEAL CHAPTER 11 - ANIMAL WASTE STORAGE FACILITIES -
AND RECREATE CHAPTER 11- MANURE STORAGE FACILITIES - OF THE ST.
CROIX COUNTY CODE OF ORDINANCES
1 The County Board of Supervisors of the County of St. Croix does ordain as follows:

3 WHEREAS, current Chapter 11 — Animal Waste Storage Facilities — of the St. Croix
4 County Code of Ordinances is authorized by Wisconsin Statutes §§ 59.69, 92.07, 92.15, 92.16,
5 Wisconsin Administrative Code Ch. ATCP 51, and Wisconsin Administrative Code Ch. NR 151;
6 and

8 WHEREAS, Chapter 11 applies to all the unincorporated areas of St. Croix County; and
9
10 WHEREAS, on October 1, 2024, the St. Croix County Community Development Director
11 filed, pursuant to Wis. Stat. § 59.69(5)(e), a petition to amend Chapter 11 of the St. Croix County
12 Code of Ordinances, through the enactment of the proposed amendments attached; and

14 WHEREAS, the amendments include manure storage requirements and Nutrient
15 Management Plans (NMP) for all the waste generated or processed at a facility; and
16
17 WHEREAS, the proposed amendments have been drafted to comply with Wisconsin
18 Statutes and Administrative Code sections; and

20 WHEREAS, a public hearing was held on Thursday, October 17th and December 19, 2024,
21 at the St. Croix County Government Center by the Community Development Committee of the St.
22 Croix County Board of Supervisors as required by the provisions of Wis. Stat. § 59.69(5)(e)
23 regarding the proposed amendments; and

25 WHEREAS, the Community Development Committee has reviewed said amendments,
26 and recommends the St. Croix County Board of Supervisors enact said amendments to Chapter 11
27 of the St. Croix County Code of Ordinances.

29 NOW, THEREFORE, the County Board of Supervisors of the County of St. Croix does
30 hereby ordain that Chapter 11 — Animal Waste Storage Facilities — is repealed and recreated as
31 Chapter 11 — Manure Storage Facilities as attached hereto.

33 BE IT FURTHER ORDAINED that the provisions of the recreated Chapter 11— Manure
34 Storage Facilities shall supersede any prior Chapter 11 — Animal Waste Storage Facilities
35 provisions.

37 BE IT FURTHER ORDAINED that the St. Croix County Community Development
38 Department is directed to forward the recreated ordinance to necessary governmental units and
39 agencies.

41 BE IT FURTHER ORDAINED that the amended Chapter 11— Manure Storage Facilities
42 - of the St. Croix County Code of Ordinances shall be published by the County Clerk, pursuant to
43 Wis. Stat. § 59.14, and will become effective upon publication. This ordinance shall be codified.
