Staff present: Rod Eslinger and Deb Zimmermann Chairman Raymond called the meeting to order at 7:00 p.m. A motion was made by Jensen, second by Luckey and carried to adopt the agenda. The next meeting will be April 9th at 9:00 a.m. Raymond explained the hearing process and opened the hearing. Glen Mohn: Eslinger read the notice into the record. The request is to rezone approximately 8.84 acres of land from Agriculture to Ag/Residential. Location: A parcel of land located in part of the SE '/4 of the NE 1 /4, Section 9, T28N, R17W, Town of Pleasant Valley, St. Croix County, Wisconsin. Ed Flanum, surveyor for the Mohns, spoke on their behalf. He explained that they would like to rezone this property to Ag/Residential in order to sell to Mohn's brother, for him to build a new home. The remaining Agricultural property is contiguous with the surrounding Ag land. The Town of Pleasant Valley has recommended approval of the request and have considered State Stat. 91.77 in making their recommendation. Eslinger went over the staff report. The request is consistent with the county plan. It was noted that the parcel could not be further subdivided as the minimum acreage in the Town of Pleasant Valley is five acres. There was no opposition to the request. The hearing was recessed by Raymond. Motion by Malick, second by Jensen and carried to recommend the request be forwarded to the County Board for approval based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. There are foundations from previous structures still on the site and a rock pile. 3. Proposed use is a hobby farm for one residence and horse structures 4. The perk test has been done and the site is suitable for a mound system. 5. Site is located on a County road, approximately 1 mile south of Interstate 94. 6. Potential development of the site is one home site, as the minimum lot size in Pleasant Valley is five - acres. 7. Proposed development is one hobby farm. 8. None of the site is identified on the primary environmental corridors map 9. Town of Pleasant Valley has reviewed the rezoning and recommends approval, stating that they have considered §91.77. The request will be forwarded to the April 16 County Board meeting. Raymond and Pamela Johnson: The hearing was reopened. Eslinger read the notice. The request is to rezone approximately 32.664 acres of land from Agriculture to Ag -II located in the SE ' / 4 of the NE ' / 4 and the SW '/4 of the NE ' / 4 of Section 17, T28N -R17W, Town of Eau Galle and 3.001 acres of land to be rezoned from Ag to Ag /Residential located in the SE ' / 4 of the NE '/4 of Section 17, T28N -Rl6W, Town of Eau Galle, all in St. Croix County, Wisconsin. Ray Johnson is the owner of the parcel at 370 230' Street, Baldwin, WI. He is asking for the 3 -acre parcel to be rezoned to Ag/Residential to allow his son to build a home on that site. It is the only part of the property that they were able to get a perk test on. He would like to rezone the remaining 33 acres to Ag -II, as recommended by the zoning department. His first request was to rezone the entire 35.7 acres to Ag /Residential, and that was approved by the Town of Eau Galle. After speaking with the zoning department, he decided to rezone just 3 acres from Ag to Ag/Residential, and 32.664 acres to be rezoned to Ag -II. The town approved his rezoning the entire 35.7 acres from Ag to Ag/Residential, and Eslinger added that the town will be sending something in writing giving approval of this current request. Eslinger went over the staff report with the committee, stating that this request is consistent with the county plan, and the town has considered §91.77 in making their decision. There was no opposition to the request. The hearing was closed on a motion by Malick, second by Jensen. Motion by Jensen, second by Malick and carried to recommend the request be forwarded to County Board for approval based on the following findings: 1. The land is in the rural planning area and is an appropriate use. 2. The site is heavily wooded with some open pasture land and some crop land. There is an existing home in the northeast corner of the site. 3. The whole parcel has slight to severe limitations for Private Onsite Wastewater Treatment (POWTS). The owners have perked the site and found one additional building site in the southeast corner. 4. The land around the parcel is zoned ag residential to the north and east and exclusive ag to the west and south. 5. The site is located on a town road. 6. The proposed use of the land is one three -acre home site for a family member and one 32+ acre hobby farm with the existing home site. 7. The Town Board reviewed the rezoning and recommended approval with §91.77 findings. The request meets the Planning Commission plan for the Town of Eau Galle. Committee will forward to April 16 County Board meeting. Brugler/Lenzen Variance Request: Raymond reminded the committee that this request for a variance to the minimum radius of curvature standard for a local road serving more than one lot was heard yesterday at the committee meeting held in Hudson. The committee voted to table a decision in this matter, in order to get an opinion from Corporation Counsel. Raymond referred the committee to a memo given to them from Corporation Counsel stating that he believes there is no need for a variance. The access to the Brugler property was approved in 1987 as part of the West Grove Estates plat approval, and at that time, the radius requirement was not in existence. Therefore, it is Corporation Counsel's opinion that the access is grandfathered in, making the need for a variance unnecessary. Discussion held. The committee is in agreement with Corporation Counsel's opinion, and agreed that a variance is not needed. The committee then went on to review the Certified Survey Map for the Brugler /Lenzen property. The map consists of 3 lots totaling 19.848 acres. The Town has approved the map and soil tests are on file. Eslinger went over the map with the committee. Motion by Luckey, second by Jensen and carried to approve the map with the conditions recommended by the staff as follows: 1. An erosion control plan that addresses temporary and permanent erosion control shall be submitted and approved for each lot prior to the issuance of sanitary permits. 2. A Special Exception Use Permit must be obtained for a land division within the Riverway District. 3. Financial guarantees equal to 120% of construction estimates must be submitted for road construction and erosion control. Written estimates must accompany the guarantees. 4. No construction, including earth moving, is to take place prior to approval of the guarantees 5. Developer to provide adequate erosion control plan to be approved by the LWCD before map is accepted for recordation. FA 6. The Zoning Office, the County Highway Dept. and the Land and Water Conservation Dept. are to be notified three days prior to the beginning of construction. St. Croix Regional Sewer Update: The committee held a discussion on this issue. The Planning, Zoning and Parks Committee and the Land and Water Conservation Committee will be meeting jointly on April 9 to go over the issues related to this proposed project. These two committees will be reviewing the comments that are being submitted on the county's position regarding this proposed Hammond/Roberts sewer project. Comments need to be submitted by April 19 to the St. Croix Regional Sewer District group. Parks Reorganization: A discussion was held by the committee on hiring a site manager for the Perch Lake park. They believe it is important to hire someone familiar with the project, as the park is almost completed. They would like to see this position report directly to the committee.
