MINUTES
St. Croix County Planning, Zoning and Parks Committee
November 13, 2002
St. Croix County Government Center, Hudson, Wisconsin
Committee members present: Supervisors Art Jensen, Linda Luckey, Veronica Anderson and
Jan Zoerb. Lois Burri was absent and excused. Staff present: Steve Fisher and Deb
Zimmermann
Chairman Jensen called the meeting to order at 7:00 p.m. A motion was made by Zoerb,
seconded by Anderson and carried to adopt the agenda. The next meeting will be November 26
at the Government Center in Hudson.
Jensen explained the hearing process and opened the hearing.
Minutes: Motion by Zoerb, seconded by Luckey and carried to approve the minutes from
October 22 and 23, 2002 with changes noted.
Douglas Rivard: Fisher read the notice into the record. The request is to rezone approximately
87 -acres from Agriculture to Ag/Residential. The SW t /4 of the NE 1 /4 and the NW 1 /4 of the NE 1 /4,
all in Section 4,T31N -R18W, Town of Star Prairie.
This rezoning request was originally heard on June 26, 2002, and was tabled for more
information. Dick King, a Supervisor in Rivard's district, is representing Rivard. The Town of
Star Prairie has approved of the request.
Fisher updated the committee on what has happened with this request since the June meeting.
The committee tabled this request as they felt they needed more information before they could
make a decision. Rivard was asked to provide specifics on access issues and some idea of how
the property would be subdivided. Fisher handed out the LESA and GIS maps to the committee
and reviewed them. Staff is concerned that the property is located entirely within an
environmental corridor, and the County Plan is very specific on preserving these areas. Fisher
went over the staff report with the committee, stating that the staff still has some concerns and
shared the 23 points listed on the Planning Department Analysis. Fisher reminded the committee
that there are limiting soils for septic systems on this property. He added that there are also still
concerns on access to the property.
King added that Rivards own 600 acres of good land, and the land being requested for rezoning
is not good farmland. The remaining acres will continue to be farmed. King pointed out that
there is a major subdivision that adjoins this property to the east. Lengthy discussion held on
suitability of developing this land, and how it coincides with §91.77 with regard to rezoning
property out of agriculture.
Dick Hesselink, Chairman for the Town of Stanton, told the committee that no matter what is
placed on this property, it could be a problem, and needs to just be regulated. It could have
problems, even if it is left in agriculture.
Discussion held on potential problems with land and water pollution if there are 40 homes
developed on this property. King stated that Rivard is not interested in developing the property,
but would like to sell off some larger parcels to adjoining landowners, and would be in
agreement to restricting him to a certain number of parcels per the 87- acres. Further discussion
held on ways to rezone the property and protect the sensitive areas.
The committee directed the staff to formulate the concerns discussed into conditions. There are
to be no more than 12 lots on the entire parcel. This would allow for careful site design in the
sensitive areas. The committee agreed to hold the hearing open to further discuss, and review the
drafted conditions, at the meeting to be held on November 26, 2002. King told the committee
that he would inform Rivard to be at the November 26 meeting.
Staff will place this item on the agenda for November 26 and will draft conditions as directed.
Donald and Alice Ziegler Property: Fisher read the notice into the record. The request is to
rezone approximately 5 -acres from Ag to Ag/Residential. Location: The SW '/a of the NE 1 /a,
Section 4, T31N -Rl7W, Town of Stanton.
Don Ziegler, owner of the property, told the committee that the 5 -acre piece of property is hilly,
with rock and grass, and is not good for farming. He originally wanted to rezone three lots, but is
now asking for just two lots per the request of the Town of Stanton.
Dick Hesselink questioned the guidelines used to determine soils. He does not believe this property
is 50% Class II soils, and thinks the land is suitable for development, and is not good farmland. He
added that Stanton is working on a Smart Growth Plan, but it is not in place yet. The town would
like to see some development on land similar to this piece of property, but wants to keep the prime
farmland in agriculture. Hesselink said that this property cannot be farmed as it has too many rocks,
and is the perfect type of property that should be rezoned out of agriculture.
Fisher went over the staff report with the Board, stating that staff believes that 50% of the soils are
Class II and III, and 50% are Class IV. Staff does not believe this conforms to the Town of Stanton
guidelines for rezoning out of Agriculture, as their guidelines state that land with Class I, II or III
soils are not eligible for rezoning.
A lengthy discussion was held on the Stanton guidelines and how it relates to this request. The
committee believes it is important to respect adopted guidelines that are in place, and work with the
towns to ensure rezoning requests meet adopted standards. It was suggested that the town look at
amending their standards for rezoning if that is their desire.
Hesselink stated he would send zoning a copy of updated guidelines from 1996 for the Town of
Stanton. Fisher and the committee stated that the town should specifically amend the document
titled - "Standards for Rezoning From Exclusive Agriculture, in the Town of Stanton. St. Croix
County ". Once the town properly amends these adopted standards, the town could forward those
revised standards with a recommendation specifying how this application meets the revised
standards.
Motion by Zoerb, seconded by Luckey to table this request, carried. This request does not meet the
current rezoning standards for rezoning land out of the exclusive agriculture- zoning district in the
Town of Stanton. The committee stated that if it is the Town's desire to use revised criteria, the
Town Board should amend the existing standards and forward this information to the county. The
Town may then submit a new recommendation stating how the request meets the revised criteria.
Once that information is received, the committee will move forward with a decision in this matter.

Parks Reorganization: The committee reviewed the new job description for the Parks Department
for the County Conservationist and Parks Director. Discussion held. Motion by Luckey, seconded
by Zoerb, and carried that effective today, Bob Heise is to assume the new duties as declared under
the new County Conservationist job description with administrative oversight of the County Parks
Department and he is to begin his assignment given to him on part two of a motion passed on
August 14, 2002 in a joint meeting with the Planning, Zoning and Parks Committee and the Land
and Water Conservation Committee. Also effective today is the new job description for the Parks
Director.
County Sponsored Rezoning: Fisher handed out a letter that was drafted to the Town of St.
Joseph regarding the David lhle property located in Houlton. The county will be sponsoring this
rezoning from Ag/Residential to Commercial, as decided by the committee at its meeting on
November 12 ". The committee approved the letter, with a few changes, and staff will forward it to
the Town.
County Surveyor: The committee reviewed a memo that will be sent to the County Board Chair,
Administrative Coordinator, Administration Committee, Transportation Committee and
Corporation Counsel regarding the PZP Committee's duties and responsibilities in the matter of the
County Surveyor. After reviewing, the committee agreed that the memo should be sent out. They
will be requesting that Dan Fedderly and Rich Loney attend the PZP meeting on November 26 to
discuss this position further.
Job Description: Fisher handed out a copy of the updated Zoning Technician job description. The
committee reviewed and made some suggestions. Motion by Zoerb, seconded by Anderson and
carried to approve the Zoning Technician job description as amended and the Zoning Director to
make the suggested changes with no further approval needed. Fisher will amend the job description
and forward to Personnel Director, Deb Kathan for her review.
Meeting dates: The committee set the dates of December 10 and December 17 as the next
regular PZP meetings, to be held at the Government Center in Hudson.
