October 23, 2002

Committee members present: Supervisors Art Jensen, Linda Luckey, Lois Burri, Veronica
Anderson and Jan Zoerb. Staff present: Steve Fisher and Deb Zimmermann
Chairman Jensen called the meeting to order at 7:00 p.m. A motion was made by Zoerb,
seconded by Burri and carried to adopt the agenda. The next meeting will be November 6th at
7:00 p.m. for a rezoning hearing.
Jensen explained the hearing process and opened the hearing.
James and Margaret Woodruff: Fisher read the notice into the record. The request is to rezone
approximately 13.026 acres of land from Agriculture to Ag/Residential. Location: A parcel of
land located in the SE 1 /4 of the NE 1 /4 of Section 21, T28N, R19W, Town of Troy, St. Croix
County, Wisconsin.
Louie Filkins, Ogden Engineering, Highway 29, River Falls, Wisconsin, is the engineer
representing the Woodruffs. He went over the aerial photo map of the property, pointing out the
location, and explained the proposed layout of the plans for this request. The soil tests have been
completed and the soil perks for a conventional system. Filkins has worked with the Town of
Troy and believes this complies with their plan.
Jim Woodruff, owner of the property, agrees with statements made by Filkins, and asked the
committee to consider approving their request for rezoning. There was no opposition to the
request.
Fisher went over the staff report with the committee. Staff has worked with Filkins on this
request to get to this point. Staff believes this request does comply with the Town Plan, and the
Town Plan Map shows that the long -range plan for this property is Ag/Residential. Fisher
handed out the LESA map on this property, and believes that the 50150 Farm Plan and the Town
Plan is compatible with this map. The rezoning request is also consistent with the County Plan,
and the staff recommends approval of this request. The Town of Troy has recommended
approval and has considered State Stat. 91.77 in making their recommendation. There was no
opposition.
Motion by Zoerb, seconded by Luckey and carried to close the hearing.
Discussion held on this request. Motion by Jensen, seconded by Zoerb and carried to
recommend approval of this request and to forward on to the next County Board meeting for
their approval, based on the following findings:
1. The parcel is in the rural planning area and is an appropriate use.
2. None of the site is in an environmental corridor.
3. Surrounding land uses include agriculture to the north, west and northeast and
subdivision to the south and southeast.
4. The site has access to town roads to the north and east.
5. Proposed use is one immediate lot and a 6.5 -acre area, which will have a conservation
easement to prevent further development. The applicant states that at this time the site
will be a hobby farm.
6. The site has been laid out for a second lot in the future. The proposed conservation
easement is located between the two lots to create a buffer.
7. The conservation easement area has been configured to allow a 200 -foot driveway
separation between the driveway access for the future second lot and an existing
driveway to the west.
8. Potential development of the site is two lots.
9. The applicant states that the Town of Troy did not require this rezoning to meet the whole
farm plan requirements for the additional acreage across the town road.
10. The applicant states that site was reviewed under the Town of Troy's 50150 Whole Farm
Plan provisions in the subdivision ordinance.
11. Town of Troy has reviewed the rezoning and recommends approval, stating that they
have considered §91.77.
Staff will forward to County Board for their approval.
Zoning Contract Position: Fisher informed the committee that the money budgeted for the
contract septic position is close to being depleted. There is enough in the budget to run for
possibly another month. Fisher would like to see zoning keep the person hired for this until the
end of the year. He asked the committee to authorize a transfer of $5000 from line item 8130
(New Equipment) to line item 2990 (Other Contractual Service). This transfer would allow
zoning to keep the septic contract position until the end of the year. The septic inspectors have
been working non -stop, as it has been another very busy year. The excess money in "new
equipment" was money available to purchase an Arc Pad for the department, but staff elected not
to make that purchase at this time, as they were not happy with the hardware for this device, and
plan to look elsewhere.
Motion by Jensen, seconded by Burn to authorize zoning to transfer $5000 from line item 8130
to line item 2990 to allow the zoning contract position to work through the end of 2002. Motion
carried on a unanimous vote.
Fisher told the committee that he is in the process of updating the Zoning Technician job
description and will bring the updated copy to them at the next meeting. He would like to have
someone hired for the new Zoning Technician position, for septic inspections, by January 1,
2003.
