CROIX COUNTY GOVERNMENT CENTER, HUDSON, WI October 22, 2002 Present: Supervisors Art Jensen, Linda Luckey, Veronica Anderson, Jan Zoerb and Lois Burri were present. Staff Steve Fisher, Mary Jenkins, Deb Zimmermann, Fran Bleskacek, and Pete Kling Others: Doug Zahler, Ed Flanum, Jason Paukner, Joe Granberg, Harold Peterson, Tom Healy Chairman Jensen called the meeting to order at 9:00 a.m. Anderson moved, seconded by Burri and carried, to adopt the agenda, with the removal of Article #5. Date of next meeting: The next meeting is October 23 at 7:00 p.m. at the Government Center in Hudson Approval of minutes: Motion by Zoerb, seconded by Anderson and carried to approve the September 11 th minutes with suggested changes. Motion by Luckey, seconded by Zoerb and carried to approve the August 27 and September 10 minutes with suggested changes. Minor Subdivisions: See attachment A: Major Subdivisions: See attachment B: The committee recessed from 10:55 a.m. to 11:05 a.m. 20% Slopes Policy: The committee reviewed the new policy on 20% slopes. This policy was drafted and approved at a joint meeting of the Land and Water Conservation Dept. and the Planning, Zoning and Parks Committee on October 15, 2002. Fisher told the committee that with the language in this new policy, any plats submitted that show disturbance of 20% slopes will have to come before this committee at the concept stage. Discussion held. It was decided that a discussion on drainage easements would be held at a later date. Fisher will send this new policy out to all of the towns, developers and surveyors. Bills, Invoices and Revenue Report: Motion by Jensen, seconded by Anderson and carried to approve September 2002 bills of $35,397.94 and to note revenue of $90,144.90. Violations and Citations: The Committee reviewed the report. Discussion held. Fisher informed the committee that an agreement was made regarding the Smeester lawsuit, and this dispute was settled. The Judge ordered the trailer to be moved onto the CSM on the property, and that has been done. Fisher explained that the Zoning Office sends out 3 -year pumping notices to homeowners, and that is being done. Staff will continue to work on the list of violations. Municipal Plats: The following municipal plats were reviewed by the committee: Berkseth Heights Townhome Community in the NE 1 /4, S31, T29N RI 6W, Village of Baldwin - Motion by Jensen, seconded by Luckey and carried to certify no objection to the plat.. No opinion is expressed concerning adequate sewer service. Heritage Greens in the NW 1 /4 & SW 1 /4, S33, T29N R19W, City of Hudson — Motion by Zoerb, seconded by Luckey and carried to certify no objection to the plat.. No opinion is expressed concerning adequate sewer service. Rezoning Decisions: None Rezoning Schedule: The committee scheduled the following rezoning requests: Rivard (Town of Star Prairie) and Ziegler (Town of Stanton) set for November 13, 2002 at 7:00 p.m. at the Government Center in Hudson. Feyereisen (Town of Troy) and Basel (Town of St. Joseph) set for December 11, 2002 at 7:00 p.m. at the Government Center in Hudson. The committee will view these properties at the end of their meeting on November 12th. Non - Metallic Mining Ordinance: The staff is reviewing this ordinance, and hope to have it to the committee by their next meeting. Planning, Zoning and LWCD have been working on it and it is quite complex. Announcements and Correspondence: Fisher handed out a letter he received from a member of the community supporting cluster development. Apparently, there are many interested in this type of development. Fisher updated the committee on two lawsuits that have been filed against the Board of Adjustments. One has been filed by Karl Neumeier, the other by the Town of Warren, appealing decisions made by the Board. Fisher will keep the committee updated. Fisher will place the contract position on the agenda for October 23 Planning Business Planning Grant Resolution: David Fodroczi presented a resolution supporting a planning grant application that he would like to submit on behalf of the Town of Emerald. The Town of Emerald did not get involved with planning last year, like many of the other towns, and now have a Planning Commission and are interested in moving forward and working with the county on a Comprehensive Plan. Fodroczi would like to include them in the Heartland project. Emerald completely supports this. Fodroczi is asking the committee to endorse this application. Motion by Zoerb, seconded by Burri and carried to support the grant application for the Town of Emerald. Fodroczi handed out an article to the committee from the Milwaukee Journal relating to parks. The article shows that property bordering/near parks are more valuable than properties that are not. He thought the committee may be interested in this article. Personnel Issues: Fodroczi informed the committee that due to a lay -off in the Finance Department, there is now a bumping issue in Real Property. Fodroczi has raised some questions on qualifications, and the process used, in the case of a bumping situation. The language in the union contract is quite vague. Discussion held. The committee asked that Deb Kathan, Personnel Director, be present at the next meeting on November 12 to explain the process used in bumping an employee. Buck Malick informed the committee that Dan Fedderly, Highway Commissioner, has given his letter of resignation. He plans to leave his position by mid to late December. A revised job description will be written for this position, and for the County Surveyor position. Staff Recommendation: Conditional approval: 1) DOT number must be placed on the map; 2) Minor map revisions. Committee action: Motion by Jensen, seconded by Zoerb to approve with conditions recommended by staff, carried. 2. Owner: Hank Fogelberg Location: NE' /4 -SE 1 /4 Section 5, Town of Warren, 3 lots totaling 6.605 acres, original parcel 24.861 acres Staff Recommendation: Conditional approval: 1) Road must be constructed and dedicated. In lieu of immediate construction, a written estimate for construction may be submitted and a financial guarantee equal to 120% of the estimated construction cost submitted to ensure construction at a later date. The guarantee will be released when construction has been completed; 2) Detailed construction estimates for roadway construction and erosion control must be submitted and approved by the Count; 3) Once the estimates are approved, you must submit a letter of credit, cashiers check, bond or other acceptable financial guarantee for County approval. Financial guarantee is to be in effect for a minimum of one year and to be automatically renewable unless the county releases the money before this timeframe; 4) No construction, including earth moving, shall take place prior to approval of the financial guarantees; a construction waiver may be granted provided the financial guarantees are approved; 5) The Zoning Office, County Highway Dept. and the Land and Water conservation Dept. must be notified 3 days prior to construction beginning. Committee action: Motion by Zoerb, seconded by Anderson to approve with conditions recommended by staff, carried. Owner: Mr. and Mrs. Sid Anderson Location: SW 1 /4- NW 1 /4 and NW %4 NW 1 /4, Section 6, Town of Springfield, 1 lot and 3 outlots totaling 40.55 acres, original parcel 40.55 acres. Staff Recommendation: Conditional approval: 1) Minor map revisions as requested by the County Surveyor's Office. Committee action: Motion by Jensen, seconded by Burri, to approve with condition recommended by staff, carried. 4. Owner: Joseph and Paulette Anderson Location: NE 1 /4 - NE 1 /4 , Section 16, Town of Hammond. 2 lots totaling 14.03 acres, original parcel 14.03 acres Staff Recommendation: Conditional approval: 1) Lot 5 should be served by only one driveway. Removal of extra driveway is required. Committee action: Motion by Anderson, seconded by Burri to approve with conditions recommended by staff, and to add the following condition: 2) A statement is to be placed on the map stating cottage is not to be used for human habitation. Staff Recommendation: Conditional approval: 1) Dimensions of drainage way easement and drainage way statement must be mapped; 2) The joint access serving Lots and 2, and Lots 3 and 4, must be constructed to County standards to the point where it divides for the separate lots.. Committee action: Motion by Luckey, seconded by Zoerb to approve with conditions recommended by staff, carried. 7. Burkhardt Prairie — Final Owners: Al Nyhagen Location: Section 10, Town of Hudson, 6 lots totaling 16.48 acres Staff Recommendation: Conditional approval: 1) Minor map revisions as requested by the County Surveyor's Office; 2) Detailed construction estimates for roadway construction and erosion control must be submitted and approved by the County; 3) Once the estimates are approved, you must submit a letter of credit, cashiers check, bond or other acceptable financial guarantee for County approval. Wild Turkey Retreat — Final Owner: PC Collova Location: Section 12, Town of Somerset, 24 lots totaling 81.57 acres Staff Recommendation: Conditional approval: 1) Minor map revisions as requested by the County Surveyor's Department. Committee Action: Motion by Anderson, seconded by Jensen to approve with condition recommended by staff, carried. 5. Kelly Estates - Preliminary Owner: A. David Kelly, Jr., David Kelly, Merle Spinks Location: Section 22, Town of Hudson, 21 lots totaling 59.011 acres Staff Recommendation: Conditional Approval: 1) Detailed construction estimates for roadway construction and erosion control must be submitted and approved by the County; 2) Once the estimates are approved you must submit a letter of credit, cashiers check, bond or other acceptable financial guarantee for County approval. Financial guarantee is to be in effect for a minimum of one year and to be automatically renewable unless the county releases the money before this timeframe; 3) No construction, including earth moving, shall take place prior to approval of the financial guarantees; a construction waiver may be granted provided the financial guarantees are approved; 4) The Zoning Office, County Highway Dept and the Land and Water Conservation Dept must be notified 3 days prior to construction beginning; 5) The buildings shown on Lot 17 are to be removed; 6) A note is to be placed on the map stating that Outlot 1 will be used for picnic tables and play structures only. The Landing at Waters Edge — Preliminary Owner: Henry Lentz Location: Section 23, Town of St. Joseph, 45 lots totaling 151.66 acres Staff Recommendation: Conditional Approval: 1) Town approval conditions to be met. (Developer's agreements to be finalized; 2) DOT Certification number to be place on the map; 3) Land and Water Committee approval; 4) NR 216 Permit approval; 5) Detailed construction estimates for roadway construction and erosion control must be submitted and approved by the County; 6) Once the estimates are approved you must submit a letter of credit, cashiers check, bond or other acceptable financial guarantee for County approval. Financial guarantee is to be in effect for a minimum of one year and to be automatically renewable unless the county releases the money before this timeframe; 7) No construction, including earth moving, shall take place prior to approval of the financial guarantees; a construction waiver may be granted provided the financial guarantees are approved; 8) The Zoning Office, the County Highway Department and the Land and Water Conservation Department must be notified three days prior to the beginning of construction; 9) Any disturbance of slopes 20% or greater that is not identified on the preliminary plat must apply for and receive a special exception use permit. Mound View Estates - Preliminary Owner: Dick Beer Location: Section 11, Town of Hudson, 28 lots totaling 77.728 acres Staff Recommendation: Conditional Approval: 1) Detailed construction estimates for roadway construction and erosion control must be submitted and approved by the County; 2) Once the estimates are approved you must submit a letter of credit, cashiers check, bond or other acceptable financial guarantee for County approval. Financial guarantee is to be in effect for a minimum of one year and to be automatically renewable unless the county releases the money before this timeframe; 3) No construction, including earth moving, shall take place prior to approval of the financial guarantees; a construction waiver may be granted provided the financial guarantees are approved; 4) The Zoning Office, the County Highway Department and the Land and Water Conservation Department must be notified three days prior to the beginning of construction.
