CROIX COUNTY GOVERNMENT CENTER, HUDSON, WI May 28, 2002 Present: Supervisors Art Jensen, Linda Luckey, Lois Burri, and Don Jordan. Veronica Anderson was absent and excused. Staff. Steve Fisher, Mary Jenkins, Deb Zimmermann, Fran Bleskacek, Dave Fodroczi Others: Doug Zahler, Ed Flanum, Richard Nelson, Jim Fife, Phyllis Fife, Bob Fife, Larry Murphy, Ron Johnson Chairman Jensen called the meeting to order at 9:00 a.m. It was noted that the agenda item number 8, Wildwood Trail, is off for today. Luckey moved, seconded by Burri and carried, to adopt the agenda with the change noted. Date of next meeting: The next meeting is June 11 at 9:00 a.m. at the Government Center in Hudson. Approval of minutes: Luckey moved to approve minutes of April 24, 2002, seconded by Jensen and carried. Minor Subdivisions: See attachment A: Major Subdivisions: See attachment B: The committee recessed from 10:20 a.m. to 10:40 a.m. Zoning Business Bills, Invoices and Revenue Report: Motion by Jensen, seconded by Luckey and carried to approve April 2002 bills of $6,593.72 and to note revenue of $41,388.50. Violations and Citations: The Committee reviewed the report. Fisher explained that Jon Sonnentag is still devoting some of his time to the septic program, but that time has decreased due to the new contract position. Discussion was held on money budgeted for the one -half time position that was to be shared with the Land and Water Conservation Department. Fisher told the committee that Land and Water did not get their half of the position approved for the budget, and zoning did. Fisher will check on the possibility of allocating the budgeted money for this half time position in the zoning budget toward the septic program. Municipal Plats: The following municipal plat was reviewed: Boulder Ridge Village Townhome Community in the SE 1 /4, S31 & SW 1 /4, S32, T28N RI 8W, City of River Falls. Motion by Luckey, seconded by Jensen and carried to certify no objection. No opinion is expressed concerning adequate sewer service. Rezoning Scheduling: The following rezoning request was scheduled for 7:00 p.m. on June 26 at the Government Center in Hudson: Doug Rivard, Town of Star Prairie, Ag to AglResidential. Rezoning Decisions: Arthur and Nellie Gisbrect: This rezoning request was heard on May 22, 2002 at the Ag Center in Baldwin. The request is to rezone 5 -acres of land in the Town of Baldwin from Agriculture to Ag /Residential to allow their daughter to construct a home on the property. Discussion held. Motion by Jensen, second by Jordan and carried to forward to the County Board for approval with the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. Site is a portion of a larger 70 -acre farm. The site is in the northeast corner of the larger site. 3. The site has Baldwin Creek, a tributary to the Rush River, going past on the west. 4. The whole site has slight to moderate limitations for Private Onsite Wastewater Treatment Systems (POWTS). The perk test has been done and the site is suitable for a mound system. 5. No portion of the site is prime farmland. 6. A registered land surveyor has determined that the proposed locations of the home and septic system are approximately 14 feet above floodplain level. 7. Surrounding land uses include a mixture of large acreage farms, hobby farms and small acreages. 8. Site is located on a town road. 9. Proposed development is one home site. 10. Potential development is two home sites. 11. None of the site is identified on the primary environmental corridors map. 12. Town of Baldwin has reviewed the rezoning and recommends approval, stating that they have considered §91.77. 13. The St. Croix County Natural Resource Management Plan Goals II, III and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. 14. There is no Town Plan. St. Croix County Highway Department: This rezoning request was heard on May 22, 2002 at the Ag Center in Baldwin. The request is to rezone 3.99 -acres of land in the Town of Stanton from Agriculture to Ag/Residential to allow for the creation of a single residential home site for the former owner of the property. Discussion held. Motion by Luckey, second by Jensen and carried to forward to County Board for approval based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. Site is rolling terrain of 12 to 20 percent slopes with some woods and a closed depression. 3. No portion of the site is prime farmland. 4. None of the site is identified on the primary environmental corridors map. 5. Site is located on a town road. 6. Proposed development is one home site. 7. Access to the site should be designed to protect the closed depression. 8. The owners should become aware of the limitations associated with closed depressions and steep slopes. 9. As the owners plan construction on the site, they should: buffer the closed depression; use best management practices to prevent erosion, control sediment and manage stormwater on the steep slopes; and design any stormwater system to prevent degradation to the closed depression. 10. The Town of Stanton has indicted that they considered the town's six criteria for rezoning out of exclusive ag as part of their deliberation to recommend approval of this request. The Town has determined that the request meets §91.77. 11. There is no Town Plan. 12. The rezoning request is consistent with the County Plan. 13. Non - metallic mining is permitted in the Agricultural District for governmental uses. With the following conditions: 1. No building will take place in the closed depression and the closed depression area is to be buffered. 2. When land is being developed, steep slopes are to be avoided. 3. A note to be placed on the CSM stating that the land immediately to the north is used for a gravel pit. Training for Deputy Zoning Administrators: Fisher gave an update on the training session that was held on April 30 at the Ag Center in Baldwin. There were about 50 town representatives in attendance, and staff believes it was very beneficial for everyone. Staff would like to conduct another training session later in the year. Release of Escrow Money for the Town of Richmond: Fisher stated that the request is for $9800 to be released from their escrow fund for walking/biking paths being constructed in the Water's Edge subdivision. This request was presented at the May 28 meeting and the Board had the following questions: • Who will maintain the walking/biking path? • Is it located in the road right -of -way, and if so, does the town or the association (subdivision) have right to the land? • Are these paths for the residents of the Water's Edge Subdivision, or will the public have access, as well? The Town has addressed these questions, as well as the Highway Department. The Town will maintain the paths, and the public will have access to these trails. The walking/biking path will be located on an 8 -foot path on the shoulder of the road. The Highway Department has asked that a "fog line" be painted on the path to separate the walking/biking path from the vehicle traffic. Motion by Jensen, second by Burri and carried to approve the request for $9800 to be released from the Richmond Escrow Account, with the condition that a "fog line" be painted on the edge of the path to separate the path from the vehicle traffic. Septic Ordinance Update: Dave Fodroczi joined the group for this discussion. Fisher went over the letter handed out to the committee from the developers in the area. The developers would like to see the septic ordinance amended to allow for cluster septic systems. Fisher talked about Comm -83, and the fact that a group of citizens opposed the new Comm -83 update and it went to the District IV Court of Appeals, and was upheld by the Court. Discussion held on what needs to be addressed with these new types of systems. Fisher said that maintenance is a big issue. Staff is working on the comprehensive zoning re -write, but it is taking quite a while to complete, so the county may need to look at doing separate "updates" to the ordinance. The county has decided to accept the new technologies set forth in Comm 83, but have not seen many of these new technologies being used. The county ordinance does not allow for more than one home per septic system. Fodroczi added that this is bigger than just amending the septic ordinance, and the cumulative ordinance re -writes should be addressed. Discussion was held by the committee and staff. The committee believes it would be a good idea to hold an orientation session for the committee, as there are so many new members. This topic could be discussed again after that orientation session. The date of June 19 at 7:00 p.m. at the Government Center in Hudson was chosen for the orientation date. Capital Outlay: Kay Walsh, Register of Deeds, presented the Capital Outlay plan for the Register of Deeds department. They are looking at computer software for their department, and believe the Life Cycle pricing is the best. The committee reviewed the comparisons that she handed out. Discussion held on the one -time purchase of the software rather than the Life Cycle yearly rates. The committee would like to see more information, and have Walsh get some input from finance and computer services on the most economical plan. Walsh will bring back to the committee. Dave Fodroczi presented his Capital Outlay Plan to the committee. Motion by Luckey, second by Burri and carried to approve Capital Outlay Plan for the Planning Department as presented. Joe Grant, Parks Director, presented his revised Capital Outlay Plan to the committee. Discussion held. After reviewing the plan, a motion was made by Jensen, seconded by Luckey and carried to approve the plan with the following changes: $80,000 to be the amount in the yearly miscellaneous outlay for the parks, and the Perch Lake Manager will report to the "committee ", along with the Parks Director.
