HomeMy WebLinkAboutPlanning & Zoning 08-08-02} MINUTES St. Croix County Planning, Zoning and Parks Committee August 8, 2002 St. Croix County Agriculture Center, Baldwin, Wisconsin Committee members present: Supervisors Art Jensen, Linda Luckey, Lois Burri, Veronica Anderson and Jan Zoerb. Staff present: Steve Fisher, Deb Zimmermann. Others: Buck Malick Chairman Jensen called the meeting to order at 7:00 p.m. A motion was made by Zoerb, seconded by Anderson and carried to adopt the agenda. The next meeting will be August 13 at 9:00 a.m. Jensen explained the hearing process and opened the hearing. Lee and Patricia Dorwin: Fisher read the notice into the record. The request is to rezone approximately 11 +/- acres of land from Agriculture to Ag/Residential. Location: A parcel of land located in the NW '/4 of the SE ' / 4, Section 3, T29N, R16W, Town of Baldwin, St. Croix County, Wisconsin. Lee Dorwin owns the property with his wife Patricia, and he is speaking on their behalf. The request is to allow the owner to sell the 11 acres of land to an individual to build a single family home. He stated that the land is not farmable, so would be a good site for a home. He added that the person planning to buy the property would have a conservation easement placed on the property to allow for only the one home site. Paul Lokker, supervisor for the Town of Baldwin, and Wayne Willink of the Town of Baldwin, both stated their support for this rezoning, saying that they agree it is not farmable land and is a good site for a home. Fisher went over the GIS map with the committee. There are limiting soils on the property, and a soil test has been submitted to zoning showing that the property is suitable for a mound system. Fisher added that the staff believes this rezoning request to be consistent with the county plan. There was no opposition to the request. Chairman Jensen closed the public hearing. Motion by Jensen, seconded by Burri and carried to recommend approval of the request and to forward to the County Board based on the following findings: 1. The land is in the rural planning area and is an appropriate use. 2. Site features include pasture, old cropland and an intermittent stream on the east side with some trees and woody vegetation. 3. The whole site has slight limitations for Private Onsite Wastewater Treatment Systems(POWTS). A perk test confirming sanitary treatment has been provided. 4. The surrounding land uses include large acreage farms, hobby farms of 40 acres and one small acreage parcel to the north of approximately 7 acres. 5. Site access is a town road. 6. Surrounding zoning is exclusive Ag all around. 7. Proposed development is one home site. 8. The potential buyer has indicated by letter that he intends to place a deed restriction/conservation easement on the property limiting development on this rezoned parcel to one building site. 9. Town of Baldwin has reviewed the rezoning and recommends approval, stating that they have considered §91.77. 10. The St. Croix County Natural Resource Management Plan Goals I1, III and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. 11. The rezoning of this parcel is consistent with the County Plan. With the following condition: A conservation easement/deed restriction is to be placed on the deed, limiting development on the property to one building site. This rezoning will not be approved by County Board until the deed restriction is submitted to and approved by the zoning director. The restriction will be required to be recorded on the new deed that will be created when the Certified Survey Map (CSM) is approved. The request will be presented at the August County Board meeting. Tower Ordinance: The hearing was reopened to hear comments regarding the proposed Tower Ordinance. Tom Bradley, with the National Park Service, offered a letter to the committee in support of the proposed ordinance. Buck Malick, County Board Chairman, supports the proposed ordinance, as well. He further stated that he has spoken to other counties that are looking into revising their tower ordinances. There were no other comments. Motion by Jensen, seconded by Zoerb and carried to sign in the affirmative on this proposed ordinance, and to move it onto the County Board for their approval. Municipal Plat: The committee reviewed the following municipal plat: Prairie View in the NW 1 /4, S35, T29N R16W, Village of Woodville. Motion by Zoerb, seconded by Anderson and carried to certify no objections. No opinion is expressed concerning adequate sewer service. Land and Water Conservation Committee/ PZP Reorganization: Jensen explained that for several reasons, they are looking at a plan to reorganize the Parks Department, by having it report to the Land and Water Conservation Director. Bob Heise is currently working on job descriptions for the changes. A discussion was held on the job description for the director's position. This item will be placed on the August 14 agenda for further discussion. Other Business: Fisher informed the committee that he has passed his tests to become a Certified Planner. The membership for the Certified Planners has asked that a press release be given to the area papers stating that Fisher now holds this certification. Fisher shared this with the committee, and they congratulated Fisher and agreed on the press release being sent to the area papers. Jensen reminded the committee and the staff that the Personnel Committee meeting is August 14 ' and the proposed positions for the Planning and Zoning Departments are on that agenda.
