CROIX COUNTY GOVERNMENT CENTER, HUDSON, WI April 24, 2002 Present: Supervisors Art Jensen, Linda Luckey, Lois Burri, Veronica Anderson and Don Jordan. Staff. Steve Fisher, Mary Jenkins, Deb Zimmermann, Fran Bleskacek, Dave Fodroczi Others: Doug Zahler, Ed Flanum, Joe Granberg Don Jordan, appointed as temporary Chairman, called the meeting to order at 10:00 a.m. Motion by Luckey, seconded by Jordan and carried, to adopt the agenda. Jordan noted that there are several new members to this committee, including himself, Veronica Anderson and Lois Burri. Election of Officers Jordan opened nominations for election of officers for the Planning, Zoning and Parks Committee. Motion by Anderson, second by Burri to nominate Art Jensen for Chairman of the Committee. Unanimous vote for Art Jensen to serve as Chairman. Motion by Burri, second by Jensen to nominate Linda Luckey for Vice - Chairman of the Committee. Unanimous vote for Linda Luckey to serve as Vice - Chairman. Motion by Jordan, second by Anderson to nominate Lois Burri as Secretary of the Committee. Unanimous vote for Lois Burri to serve as Secretary. Jensen presided over the remainder of the meeting as Chairman. He noted that the next meeting for this committee will be May 14 at 9:00 a.m. at the Government Center in Hudson. Minor Subdivisions: See attachment A: Discussion of invalid application: Fisher presented the Wil Studtman proposed CSM to the committee, stating that zoning does not believe this to be a valid request, as the applicant, among other things, has failed to prove that he legally owns the land that he is proposing to subdivide. Fisher went over a memo he handed out to the committee, stating reasons this is an invalid application, and copies of correspondence between Mr. Studtman and the zoning office. This CSM has been an ongoing issue since 1996, and Studtman has refused to address the issues that are outstanding. Studtman has asked that the committee make a decision on the proposed CSM. Greg Timmerman, Corporation Counsel, joined the group, stating that if Studtman does not agree with the decision made by the committee, he has the right to file an appeal with the Court. Fisher told the committee that a Quit Claim Deed between Wil Studtman and Verlin Studtman was produced to the zoning office, but the deed was never recorded. Timmerman said that it is his opinion that without a recorded deed, the county cannot approve this proposed CSM. The property legally belongs to Verlin Studtman. Discussion held. Motion by Jensen, seconded by Burri to reaffirm zoning department's written position on this matter, affirming the application is incomplete /invalid. Motion carried. Major Subdivisions: See attachment B: The committee recessed from 11:50 to 12:00 noon. St. Croix Regional Sewer District Update: Fodroczi updated the committee on this issue, stating that the county's comments have been submitted. A copy of these comments was handed out to the committee. He said that there is no doubt that the Roberts /Hammond area has serious issues with their sanitary system, but believes there are other avenues to explore that would be more beneficial to everyone. Fodroczi has spoken with the DNR about our concerns, and it has been suggested by the state that we work with the DNR Western District Office. In speaking with the DNR, Fodroczi said that they have indicated that they need to see more information on this issue before moving anything forward. Discussion held. County Board Chairman, BuckMalick suggested to the committee to look at budgeting for money next year to cost share on the study being done to look at the Roberts /Hammond sanitary system problems. Fodroczi will keep the committee updated. Zoning Business Bills, Invoices and Revenue Report: Motion by Luckey, seconded by Jensen and carried to approve March 2002 bills of $3,135.78 and to note revenue of $25,111.80. Violations and Citations: The Committee reviewed the report. Municipal Plats: The following municipal plat was reviewed: Red Cedar Canyon Cliff Ridge in the NE' /4 & SE 1 /4, S32, T29N R19W, City of Hudson. Motion by Jensen, second by Luckey and carried to certify no objection. No opinion is expressed concerning adequate sewer service. Rezoning Scheduling: The following rezoning requests were scheduled for 7:00 p.m. on May 22 °d at the Ag Center in Baldwin: Arthur and Nellie Gisbrecht, Town of Baldwin, Ag to Ag /Residential and the St.Croix County Highway Dept., Town of Stanton, Ag to Ag/Residential. Tower Ordinance: The new members asked to be updated on where the new Tower Ordinance is at. Luckey explained that the committee has been working on re- writing the Tower Ordinance for sometime. There is now a lawsuit pending between St. Croix County and VoiceStream, and the committee has opted not to finalize this ordinance until a decision is made in the lawsuit. A discussion was held on what has been looked at in re- writing the proposed Tower Ordinance. Training for Deputy Zoning Administrators: Fisher told the committee that this training session will be held on April 30 at the Ag Center in Baldwin. Every town is required to have someone appointed as a Deputy Zoning Administrator, according to the ordinance. The zoning office would like to conduct a town training session twice a year. There has been a good response from the towns in attendance. Release of Escrow Money for the Town of Richmond: Fisher stated that the request is for $9800 to be released from their escrow fund for walkingibiking paths being constructed in the Water's Edge subdivision. Discussion held by the committee. Motion by Luckey, second by Anderson and carried that the request be tabled for further information from the town with regard to the following questions: • Who will maintain the walkingibiking path? • Is it located in the road right -of -way, and if so, does the town or the association (subdivision) have right to the land? • Are these paths for the residents of the Water's Edge Subdivision, or will the public have access, as well? Fisher will notify the town, and get back to the committee with a response. A discussion was held by staff and the committee on procedures for this committee. Staff will order name plates for the new members of the committee. Staff Recommendation: Conditional approval; 1) Financial guarantees equal to 120% of construction estimates must be submitted for road construction and erosion control. Written estimates must accompany the guarantees; 2) No construction, including earth moving, shall take place prior to approval of the financial guarantees; 3) The Zoning Office, the County Highway Department and the Land and Water Conservation Department must be notified three days prior to the beginning of construction; 4) Any disturbance of slopes 20% or greater that is not identified on the approved map must apply for and receive a special exception use permit. Committee Action: Motion by Jensen, second by Burri to approve with conditions recommended by staff, carried. Troy Village 5"' Addition - Final Owners: Troy Development Corporation Location: Section 24 & Section 19, Town of Troy. 16 lots plus 2 outlots Staff Recommendation: Conditional approval: 1) Final approval must be received from the Department of Administration; 2) Financial guarantees equal to 120% of construction estimates must be submitted for road construction and erosion control. Written estimates must accompany the guarantees; 3) No construction, including earth moving, shall take place prior to approval of the financial guarantees; 4) The Zoning Office, the County Highway Department and the Land and Water Conservation Department must be notified three days prior to the beginning of construction; 5) Any disturbance of slopes 20% or greater that is not identified on the approved map must apply for and receive a special exception use permit. Committee Action: Motion by Jensen, seconded by Luckey to approve with conditions recommended by staff and with the addition of the following condition: 6) Staff will verify the method used to place cart path on lots 137 through 144, 132 and 133. Motion carried. Hopkins Estates — Preliminary Owner: Kernon Bast & Donalda Speer Bast Location: Section 11, Town of Hudson, 11 lots totaling 30.79 acres Staff Recommendation: Conditional Approval: 1) Financial guarantees equal to 120% of construction estimates must be submitted for road construction and erosion control. Written estimates must accompany the guarantees; 2) No construction, including earth moving, shall take place prior to approval of the financial guarantees, a construction waiver may be granted provided the guarantees are approved; 3) The Zoning Office, the County Highway Department and the Land and Water Conservation Department must be notified three days prior to the beginning of construction; 4) Any disturbance of slopes 20% or greater that is not identified on the approved map must apply for and receive a special exception use permit. Written estimates must accompany the guarantees; 3) No construction, including earth moving, shall take place prior to approval of the financial guarantees, a construction waiver may be granted provided the guarantees are approved; 4) The Zoning Office, the County Highway Department and the Land and Water Conservation Department must be notified three days prior to the beginning of construction; 5) Any disturbance of slopes 20% or greater that is not identified on the approved map must apply for and receive a special exception use permit. Location: Section 16, Town of Somerset, 6 lots totaling 36.28 acres. Staff Recommendation: Conditional approval; 1) Financial guarantees equal to 120% of construction estimates must be submitted for road construction and erosion control. Written estimates must accompany the guarantees; 2) The driveways for Lots 3 & $ are to be constructed concurrent with other road construction within the plat; 3) No construction, including earth moving, shall take place prior to approval of the financial guarantees, a construction waiver may be granted provided the guarantees are approved; 4) The Zoning Office, the County Highway Department and the Land and Water Conservation Department must be notified three days prior to the beginning of construction; 5) Proof of issuance of Chapter 30 permit must be submitted; 6) Any disturbance of slopes 20% or greater that is not identified on the approved map must apply for and receive a special exception use permit.
