CROIX COUNTY GOVERNMENT CENTER, HUDSON, WI November 26, 2002 Present: Supervisors Art Jensen, Veronica Anderson, Jan Zoerb and Lois Burn were present. Linda Luckey arrived at 10:10 a.m. Staff. Steve Fisher, Mary Jenkins, Deb Zimmermann, Greg Timmerman, Fran Bleskacek, Pete Kling and Brian Halling Others: Doug Zahler, Allen Schlipp, Joe Granberg, Jim Rusch, Larry Thompson, Ed Kromrey. Chairman Jensen called the meeting to order at 9:00 a.m. Anderson moved, seconded by Burn and carried, to adopt the agenda. Date of next meeting: The next meeting is December 10, 2002 at 9:00 a.m. at the Government Center in Hudson Approval of minutes: No minutes to approve. Minor Subdivisions: See attachment A: Major Subdivisions: See attachment B: The committee recessed from 11:30 a.m. to 11:40 a.m. Plats having 20% Slopes: St. Croix National Southern Estates: Fisher presented this concept to the committee, stating that it is the first plat being submitted under the new 20% slopes policy, and asked that the committee review it. The developer has worked with the staff at the concept stage, but the preliminary plat has not been submitted yet. Ed Kromrey, with Melchert/Walkky, went over the proposed layout of the plat with the committee. Discussion held on 20% slope issues and how developer plans to avoid or mitigate disturbance of the 20% slopes on this property. The committee directed the developer /surveyor to submit a revised preliminary plat eliminating disturbance of 20% slopes for all driveway connections and building pads. If main roadways disturb 20% slopes, the applicant must provide offsetting mitigation efforts. The revised map will be reviewed by the staff and if acceptable, will be presented to the committee for plat approval. Erosion Control Measures for Grandview Estates (Town of Somerset ): Fisher and Jenkins informed the committee that there is a revised punch list for this subdivision, and a new bond in the amount of $10,000 is being requested, which is an increase of $5,000 over the old bond. The staff will work with the developer next spring on the erosion control measures for this subdivision. The committee recessed from 12:35 p.m. to 1:45 p.m. for lunch. County Surveyor: Brian Halling, surveyor with the Highway Department, handed out GPS maps showing re- monumentation projects within the county, and went over this map with the committee. Halling said there is no set time line for the re- monumentation project to be completed. Halling went over job duties for the two Registered Land Surveyors. Rich Loney, Finance Director, reviewed the budget summary of the County Surveyor budget over the last three years. Discussion was held on how the time is allocated for duties assigned to the surveyors and the support staff. The committee will set up a time to meet with the Highway Committee in the future on these issues. Bills, Invoices and Revenue Report: Motion by Zoerb, seconded by Burn and carried to approve October 2002 bills of $48,685.11 and to note revenue of $96,782.90. Violations and Citations: The Committee reviewed the report. Discussion held. Fisher informed the committee that the Sukowatey matter was in court yesterday in the contempt of court matter. The Judge extended the hearing until December 20 Fisher will keep the committee updated. Municipal Plats: The following municipal plats were reviewed by the committee: Richmond Heights Second Addition in the NW %4, 511, T30N RI 8W, City of New Richmond — Motion by Jensen, seconded by Anderson and carried to certify no objection to the plat. No opinion is expressed concerning adequate sewer service. Richmond Heijzhts Third Addition in the NW t /4, S 11, T30N R1 8W, City of New Richmond — Motion by Zoerb, seconded by Burri and carried to certify no objection to the plat. No opinion is expressed concerning adequate sewer service. Somerset Meadows 2 °a Addition in the NE t /4, S4, T30N RI 9W, Village of Somerset — Motion by Anderson, seconded by Luckey and carried to certify no objection to the plat. No opinion is expressed concerning adequate sewer service. Rezoning Schedule: The committee scheduled the following rezoning requests: Pike (Town of Stanton) set for January 8, 2002 at 7:00 p.m. at the Government Center in Hudson. Roettger (Town of St. Joseph) set for January 15, 2002 at 7:00 p.m. at the Government Center in Hudson. The committee will view these properties at the end of their meeting on December 10 Wildwood Trail: Greg Timmerman, Corporation Counsel, joined the group to discuss this matter.Don Rodel wishes to have an access to his property that would cross the trail. Timmerman explained that there are several other crossings on this trail already, so the granting of this request would not change the character of the trail, as that has already been established. He believes that an agreement between the parties is for the protection of both the County and the landowner. Discussion held on access location. The committee directed Fisher and Bob Heise of Land and Water to view the property and report back to the committee on how this access would impact neighboring properties. Timmerman will talk to Rodel's attorney about the location for the access. He also added that he needs a decision from the committee in this matter in the very near future, as this has been debated for a long time, and a decision needs to be made. Non - Metallic Mining Ordinance: The staff has forwarded this ordinance to Corporation Counsel Timmerman. Timmerman has some issues he is looking into, and will finish his review and get back to zoning. Parcel Add -Ons: Fisher handed out a memo to the Land Surveyors doing work in St. Croix County and reviewed with the committee. He explained that there are exemptions in the St. Croix County Land Use Ordinance, Section 18.05 for add -on parcels. Fisher is asking the committee to endorse this memo stating that the county is strongly recommending that parcel add -ons be put on a certified survey map to create less confusion. Fisher has shared this with the State Plat Review, the Planning Department and Corporation Counsel, and they all concur that this would be the cleanest way to approach an add -on parcel. Motion by Zoerb, seconded by Burri and carried to approve the memo as proposed. Fisher will send the memo to area Land Surveyors. Park Fund Policy: Fisher asked the committee to review the Park Fund Policy and discuss with staff next month. Rezoning Decisions: Douglas Rivard: Fisher reviewed the proposed conditions for this rezoning. Corporation Counsel has reviewed. Discussion held. Motion by Zoerb, seconded by Anderson and carried to recommend approval of the Rivard rezoning request and to move forward to County Board based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. Site is a portion of a larger 261 -acre farm. The site is in the east 1/3 of the larger site. 3. Portions of the site are actively farmed with tilled fields and pastureland and some wooded areas. 4. The whole site is within a primary environmental corridor. 5. Environmental corridor features include two wetlands, one large and one small; four closed depression; 12 to 20 percent slopes and shorelands. 6. A small portion of the site has very poor soils with severe limitations for Private Onsite Wastewater Treatment Systems (POWTS). 7. No portion of the site is prime farmland. 8. Surrounding land uses include a mixture of large open farmland to the west and south and a large subdivision (Mallard Run) to the east. To the north is Polk County and a large expanse of prime farmland. 9. Surrounding zoning is exclusive ag to the west; ag residential to the south and east; and to the north is Polk County. 10. Site is located on a town road to the north. An additional connection is available through a stubbed town road to the east in the existing subdivision. 11. Immediately to the west of the proposed rezoning are the farmstead and a wooded area running north and south. This wooded are provides a natural buffer to the prime farmland on the remaining 174 acres of this farm. 12. Proposed development is 12 parcels based on the plan submitted. 13. The large wetland is located near the town road on the north side of the site. A secondary pond is located slightly to the south. Any access around these critical areas must address protection both during and after construction. 14. The owners should be encouraged to preserve all the environmental features and to be aware of the limitations associated with these features, i.e. 20 percent or greater slopes are to be avoided for land disturbance. The environmental elements should be incorporated into any type of development. 15. During design, POWTS should be located so that there is not a conflict with the wetlands, closed depressions and the limiting soils for POWTS. 16. The St. Croix County Natural Resource Management Plan Goals II, III and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats; and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. 17. Town of Star Prairie has recommended approval of the rezoning and considered State Statute 91.77 with their decision and the County has concurred. Approval of this rezoning shall incorporate the above findings and will be contingent upon the following conditions: 1. Approvals under the County subdivision ordinance and sanitary code shall incorporate these findings listed above. 2. Because the entire property is located within a primary environmental corridor and because there is a large area of prime farmland to the north and west, the 87 acres shall not be subdivided into more than 12 parcels. This condition shall be shown on the plat and shall be placed on every deed conveying any lot on this parcel. The County must review and approve any land divisions or exchanges of land between adjacent owners. County approvals and required deed restrictions shall be recorded at owners' expense. 3. Because the entire property is located within a primary environmental corridor, development shall not be allowed on slopes 20% or greater or in closed depressions. Design elements for this development must: Protect wetlands and slopes less than 20% by using best management practices; incorporate erosion and sediment control and storm water management; and protect and preserve interior woodland habitat by building on fringes of woodland areas. 4. The County Board ordinance, which incorporates the legal description of the land rezoned along with the findings and conditions, shall be recorded at owners' expense. The staff will forward to County Board. Zoning Budget: Fisher informed the committee that the zoning department will be over budget this year due to the county surveyor fees and the contractual services budget. He has spoken to Finance about this and will take care of it, but wanted the committee aware that this may happen. Rezoning Decisions: Fisher updated the committee on the Ziegler rezoning in the Town of Stanton. Fisher has done some research on the Stanton rezoning criteria and has found that there was a Resolution from 1982 adopted by the Town of Stanton that states that "..... if a parcel meets aM or all of the criteria...." , it may qualify for rezoning. Planning has also further looked into the Ziegler rezoning, and believes this parcel does have less productive soils than I, II or III. Fisher will set up a meeting with a representative from the Town of Stanton to try to rezoncile their conflicting documents. Announcements and Correspondence: Fisher handed out a copy of a lawsuit filed against members of the zoning office by Denise Gunderson. Staff Recommendation: Conditional approval: 1) Final approval must be obtained from the Department of Administration; 2) Map revisions as requested by the County Surveyor's Department. Halling said there is no set time line for the re- monumentation project to be completed. Halling went over job duties for the two Registered Land Surveyors. Rich Loney, Finance Director, reviewed the budget summary of the County Surveyor budget over the last three years. Discussion was held on how the time is allocated for duties assigned to the surveyors and the support staff. The committee will set up a time to meet with the Highway Committee in the future on these issues. Bills, Invoices and Revenue Report: Motion by Zoerb, seconded by Burri and carried to approve October 2002 bills of $48,685.11 and to note revenue of $96,782.90. Violations and Citations: The Committee reviewed the report. Discussion held. Fisher informed the committee that the Sukowatey matter was in court yesterday in the contempt of court matter. The Judge extended the hearing until December 20 Fisher will keep the committee updated. Rezoning Schedule: The committee scheduled the following rezoning requests: Pike (Town of Stanton) set for January 8, 2002 at 7:00 p.m. at the Government Center in Hudson. Roettger (Town of St. Joseph) set for January 15, 2002 at 7:00 p.m. at the Government Center in Hudson. The committee will view these properties at the end of their meeting on December 10 Wildwood Trail: Greg Timmerman, Corporation Counsel, joined the group to discuss this matter.Don Rodel wishes to have an access to his property that would cross the trail. Timmerman explained that there are several other crossings on this trail already, so the granting of this request would not change the character of the trail, as that has already been established. He believes that an agreement between the parties is for the protection of both the County and the landowner. Discussion held on access location. The committee directed Fisher and Bob Heise of Land and Water to view the property and report back to the committee on how this access would impact neighboring properties. Timmerman will talk to Rodel's attorney about the location for the access. He also added that he needs a decision from the committee in this matter in the very near future, as this has been debated for a long time, and a decision needs to be made. Non - Metallic Mining Ordinance: The staff has forwarded this ordinance to Corporation Counsel Timmerman. Timmerman has some issues he is looking into, and will finish his review and get back to zoning. Parcel Add -Ons: Fisher handed out a memo to the Land Surveyors doing work in St. Croix County and reviewed with the committee. He explained that there are exemptions in the St. Croix County Land Use Ordinance, Section 18.05 for add -on parcels. Fisher is asking the committee to endorse this memo stating that the county is strongly recommending that parcel add -ons be put on a certified survey map to create less confusion. Fisher has shared this with the State Plat Review, the Planning Department and Corporation Counsel, and they all concur that this would be the cleanest way to approach an add -on parcel. Motion by Zoerb, seconded by Burri and carried to approve the memo as proposed. Fisher will send the memo to area Land Surveyors. Park Fund Policy: Fisher asked the committee to review the Park Fund Policy and discuss with staff next month. Rezoning Decisions: Douglas Rivard: Fisher reviewed the proposed conditions for this rezoning. Corporation Counsel has reviewed. Discussion held. Motion by Zoerb, seconded by Anderson and carried to recommend approval of the Rivard rezoning request and to move forward to County Board based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. Site is a portion of a larger 261 -acre farm. The site is in the east 1/3 of the larger site. 3. Portions of the site are actively farmed with tilled fields and pastureland and some wooded areas. 4. The whole site is within a primary environmental corridor. 5. Environmental corridor features include two wetlands, one large and one small; four closed depression; 12 to 20 percent slopes and shorelands. 6. A small portion of the site has very poor soils with severe limitations for Private Onsite Wastewater Treatment Systems (POWTS). 7. No portion of the site is prime farmland. 8. Surrounding land uses include a mixture of large open farmland to the west and south and a large subdivision (Mallard Run) to the east. To the north is Polk County and a large expanse of prime farmland. 9. Surrounding zoning is exclusive ag to the west; ag residential to the south and east; and to the north is Polk County. 10. Site is located on a town road to the north. An additional connection is available through a stubbed town road to the east in the existing subdivision. 11. Immediately to the west of the proposed rezoning are the farmstead and a wooded area running north and south. This wooded are provides a natural buffer to the prime farmland on the remaining 174 acres of this farm. 12. Proposed development is 12 parcels based on the plan submitted. 13. The large wetland is located near the town road on the north side of the site. A secondary pond is located slightly to the south. Any access around these critical areas must address protection both during and after construction. 14. The owners should be encouraged to preserve all the environmental features and to be aware of the limitations associated with these features, i.e. 20 percent or greater slopes are to be avoided for land disturbance. The environmental elements should be incorporated into any type of development. 15. During design, POWTS should be located so that there is not a conflict with the wetlands, closed depressions and the limiting soils for POWTS. 16. The St. Croix County Natural Resource Management Plan Goals II, III and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats; and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. 17. Town of Star Prairie has recommended approval of the rezoning and considered State Statute 91.77 with their decision and the County has concurred. Approval of this rezoning shall incorporate the above findings and will be contingent upon the following conditions: 1. Approvals under the County subdivision ordinance and sanitary code shall incorporate these findings listed above. 2. Because the entire property is located within a primary environmental corridor and because there is a large area of prime farmland to the north and west, the 87 acres shall not be subdivided into more than 12 parcels. This condition shall be shown on the plat and shall be placed on every deed conveying any lot on this parcel. The County must review and approve any land divisions or exchanges of land between adjacent owners. County approvals and required deed restrictions shall be recorded at owners' expense. 3. Because the entire property is located within a primary environmental corridor, development shall not be allowed on slopes 20% or greater or in closed depressions. Design elements for this development must: Protect wetlands and slopes less than 20% by using best management practices; incorporate erosion and sediment control and storm water management; and protect and preserve interior woodland habitat by building on fringes of woodland areas. 4. The County Board ordinance, which incorporates the legal description of the land rezoned along with the findings and conditions, shall be recorded at owners' expense. The staff will forward to County Board. Zoning Budget: Fisher informed the committee that the zoning department will be over budget this year due to the county surveyor fees and the contractual services budget. He has spoken to Finance about this and will take care of it, but wanted the committee aware that this may happen. Rezoning Decisions: Fisher updated the committee on the Ziegler rezoning in the Town of Stanton. Fisher has done some research on the Stanton rezoning criteria and has found that there was a Resolution from 1982 adopted by the Town of Stanton that states that "..... if a parcel meets any or all of the criteria....", it may qualify for rezoning. Planning has also further looked into the Ziegler rezoning, and believes this parcel does have less productive soils than I, II or III. Fisher will set up a meeting with a representative from the Town of Stanton to try to rezoncile their conflicting documents.
