SUBMITTED BY: St. Croix County Planning and Zoning Department DATE: January 6, 2012 COPIES TO: County Board Office County Clerk Board Members News Media/Notice Board * CANCELLATIONS /CHANGES /ADDITIONS PUBLIC HEARING NOTICE The St. Croix County Board of Adjustment has scheduled a public hearing for Thursday, January 26, 2012, at 8:30 a.m. at the Government Center, 1101 Carmichael Road, Hudson, Wisconsin, to consider the following requests under the St. Croix County Zoning Ordinance. The Board will view the site in question, after which the Board will deliberate and vote on the request. SPECIAL EXCEPTION APPLICANT: Redeemer Lutheran Church LOCATION: NW 1 /4 of the NE 1 /4 of Section 10, T29N, R19W, Town of St. Joseph ADDRESS: 1097 County Trunk Highway A REQUEST: Special exception request for an exhibit design business pursuant to Section 17.18 (9) of the St. Croix County Zoning Ordinance. RECONSIDERATION APPLICANT: LOCATION: ADDRESS: REQUEST: Megan Duley NW 1 /4 of the SW 1 /4 of Section 9, T30N, R19W, Town of Somerset 1627 50' Street Reconsideration of a special exception permit for a contractor's storage yard required under Section 17.15 (6)(d) of the St. Croix County Zoning Ordinance. All interested persons are invited to attend said hearing and be heard. Malick, Chairperson St. Croix County Board of Adjustment BOARD OF ADJUSTMENT MEETING AND HEARING MINUTES January 26, 2012 CALL TO ORDER: The meeting was called to order by Chairperson, Clarence (Buck) Malick at 8:30 a.m. ROLL CALL — Members Present: Joe Hurtgen, David Peterson, and Sue Nelson, absent and excused Jerry McAllister. STAFF PRESENT: Kevin Grabau, Code Administrator; Alex Blackburn, Zoning Specialist and Bonita Clum, Recorder. Staff confirmed to the Board that this was a properly noticed meeting. DATE OF NEXT MEETING: The next Board of Adjustment meeting is scheduled for Thursday, March 1, 2012, at 8:30 a.m. in the County Board Room of the Government Center in Hudson. UNFINISHED BUSINESS Application #1 - Reconsideration of Special Exception for Megan Duley, requesting reconsideration for items 10 —14 of their Special Exception Permit to operate a Contractor's Storage yard: Alex Blackburn presented application and staff report. Peterson asked if the parking area was prepared or if they plan on doing asphalt. Blackburn stated that they would like to put up the building first, then pour the floor. Malick asked what Alex's recommendation was for the storage of the 1500 gallon tank. Alex noted the tank is currently located on concrete inside the garage. Malick wanted to know about the toxicity and blast point. Alex is not familiar with the chemistry of the substance. Todd Albert spoke in favor. Albert sold the business to the Duleys. Albert has been in business for sixteen years. Albert explained when thinking about the blast point, we should note that the substance is heated up right next to the sealer with a flame not more than 10 feet away from sealer. The sealer is water based and is not considered flammable. He does not think there is an environmental concern either. There were no other comments made in favor or in opposition. Malick closed the hearing. PUBLIC HEARING Application # 2 - Special Exception Permit for Chris Krumm of TropoStudio, LLC. Request to operate an exhibit design business in the existing Redeemer Lutheran Church building located in Commercial District of Burkhardt in the Town of St Joseph: Alex Blackburn presented the application and staff report. Malick questioned whether the parcels surrounding this site were also zoned Commercial. Alex confirmed that the area is zoned commercial although some parcels are used residentially. Malick questioned whether or not the paved parking area goes to the end of the property. Blackburn confirmed the parking goes to the end of the parking and showed a picture of the proposed parallel parking for six cars directly in front of the building. The parking is located on County Rd A, and is 16 feet to the seam of the right of way. The Highway Dept is recommending that parking for three cars is added to the south side of the building, but has left this decision up to the Board of Adjustment. Malick asked questions about the current location and condition of the well and septic system. Blackburn confirmed that there is a condition to bring the sanitary system into compliance and the well is a shared well on the next lot. The proposed parking lot or driveway could be over the well line. Chris Krumm spoke in favor. Krumm gave a history of his business. He would like to move his business to Burkhart. He currently is located in a business area with several neighbors and he has never had a complaint. He has done his due diligence and feels this building /location is perfect for his business. He is aware of the condition to bring the sanitary system into compliance. Krumm does have a problem with the parking conditions. He feels the current parking situation is sufficient for his business. Town of St Joseph unanimously approves his plan with the parallel parking proposal. He has also talked to his neighbors and they have no objection to using the proposed parallel parking. Malick suggested that this road is a high traffic area, Krumm is aware that this is a high traffic area; however, the speed limit is 25 mph. There is also a concern that the people that are parked there may make a u -turn. He feels that he should not be penalized for people that are breaking the law. He feels that a sign and striping should be enough to let people know that they are to parallel park there. Malick asked if Krumm would paint the stripes and place a sign there. Krumm indicated that he would. Malick stated that Krumm started out by saying that he felt he was being taken advantage of because of the timeline. Malick asked if Krumm would like another 30 days. Krumm did not feel as though he needed another 30 days: he is fine with the plan and feels the parallel parking plan is reasonable. He is prepared to deal with the septic system. He would like a resolution as soon as possible. David P Montbriand spoke in favor. Montbriand lives across the street from the old church. He has lived there for 35 years. He feels that Krumm's business will have less impact in the area than the church had with all the services, funerals, weddings, etc. He also feels that the parallel parking plan submitted by Krumm is a safe and reasonable plan. Montbriand went to neighboring communities in St Croix County and measured the distance from the curb to the traffic area. The distance ran from ten foot ten inches to thirteen feet ten inches. The distance in front of the church building is sixteen feet almost twice the distance. Montbriand does feel since the speed limit is 25 mph, with a clear view, the parallel parking is reasonable and safe. Montbriand also feels that limiting Chris to two employees seems unfair. Montbriand is concerned that leaving this property vacant will attract vandals. Montbriand feels this is a good fit for the community and would like to see this approved as soon as possible. There were no other comments made in favor or in opposition. The Board agreed there was no reason to go on site for either of these Special Exceptions. Malick closed the hearing at 9:45 a.m. The Board reconvened at: 10:00 a.m. DECISIONS After reviewing the material in the record, the Board rendered the following decisions: Application #1- Reconsideration of Megan Duleys Special Exception Permit to operate a Contractor's Storage yard: Motion by Hurtgen, 2nd by Peterson to approve with 7 findings and 14 Conditions. Motion carried unanimously. (Specifics on file in the Zoning Office) Application #2 - Special Exception Permit for Chris Krumm of TropoStudio, LLC. Request to operate an exhibit design business in the existing Redeemer Lutheran Church building located in Commercial District of Burkhardt in the Town of St Joseph: Motion by Peterson, 2nd by Nelson to approve with 12 findings and 14 conditions. Motion carried unanimously.
