9 WHEREAS, Ordinance No. 614(2002), Ordinance Establishing New Maintenance and Boarding
10 Charges to Huber Law Prisoners was approved by the St. Croix County Board of Supervisors on March
11 19, 2002; and
12
13 WHEREAS, Ordinance No. 614(2002) established the maintenance and boarding charge for
14 Huber Law prisoners in the St. Croix County Jail to be $19.00 per day; and
15
16 WHEREAS, on May 20, 2003 the St. Croix County Board of Supervisors approved codification
17 of all County ordinances into a chaptered code; and
18
19 WHEREAS, Ordinance No. 614(2002) was inadvertently not included in the codification; and
20
21 WHEREAS, the Public Protection Committee has determined that an increase of $1 per day ($20
22 total) for Huber inmates is justifiable; and
23
24 WHEREAS, the Public Protection Committee also determined that assessing other allowable fees
25 per Wisconsin Statutes Chapter 302 and 303 is desirable in an effort to offset the costs of operating the St.
26 Croix County Jail; and
27
28 WHEREAS, Wisconsin Statute §302.372(2) allows a county to seek reimbursement of expenses
29 from inmates as set by the county board by ordinance.

33 Ordinance No. 614(2002) is hereby repealed and recreated as Chapter 63 - Maintenance and
34 Board of Jail Inmates of the St. Croix County Code of Ordinances, attached hereto.

36 FURTHER, the attached Maintenance and Board of Jail himates Fee Schedule for the St. Croix
37 County Jail referred to in Chapter 63, Section 63.07, is approved.

MAINTENANCE AND BOARD OF JAIL INMATES
63.01 Authorization and Intent.
(A) Pursuant to the authority provided by Wis. Stats. §§302.372, 302.38, 302.381,
302.388, 302.425, 302.43, and 303.08, it is the intent of this chapter that inmates
at the St. Croix County Jail be responsible for paying the costs of incarceration
and any related expenses to the extent permitted by law.
(B) For each inmate, the sheriff, or his/her designee shall choose whether to seek
reimbursement under this chapter or as otherwise provided by law.
(C) Any money collected under this chapter shall be deposited with the county
treasurer to help offset the costs of operating the St. Croix County Jail
63.02 Maintenance and Board Charges
(A) Processing Fee. A one-time processing fee will be charged to each person
booked into the St. Croix County Jail on a sentence.
(B) Transfer Processing Fee. A transfer processing fee will be charged to each out-
of-county Huber inmate transferred to the St. Croix County Jail to serve his/her
sentence.
(C) Huber Fees. Each inmate who is sentenced to the St. Croix County Jail under
the provisions of Wis. Stats. §303.08(4), (Huber Law) and is gainfully employed,
receives unemployment insurance or employment training benefits while in
custody in the jail, shall be liable for per capita maintenance and board costs as
follows:
(1) St. Croix County Huber inmates will be charged a daily fee in addition to a
processing fee.
(2) Out-of-county Huber inmates will be charged a daily fee in addition to a
transfer processing fee.
(3) Huber inmates will be charged a per day fee for a GPS bracelet for each
day a Huber inmate leaves the jail.
(4) Huber inmates who are subject to drug screening, randomly or with cause,
during incarceration shall be charged the actual cost of testing.
(D) Electronic Monitoring Program. A daily equipment fee and a per day monitoring
fee shall be charged to inmates placed in the electronic monitoring program. The
sheriff may require prepayment of the expenses set forth herein as a requirement
for participation in the program.

(E) Medical Expenses.
(1) Each inmate shall be responsible for the actual costs of medical expenses
incurred by the inmate as set forth in Wis. Stat. §302.38
(2) The sheriff may establish a system of copayments to partially reimburse
St. Croix County for the actual costs of the medical service or medication
provided to the inmate in the jail.
(F) Municipal Housing Fee: A per day fee will be charged to the municipality for
persons placed in the jail on a municipal hold.
(G) Out-of-County Inmate Housing Fee: The Sheriff may charge a fee for housing
out-of-county inmates up to the maximum allowed by law as set forth in Wis.
Stat. §302.27 and any amendments thereto.
63.03 Inmate Reimbursement.
(A) Each person confined to the St. Croix County Jail shall complete a financial
disclosure form containing the information set forth in Wis. Stat. §302.372(2)(b).
(B) Pursuant to Wis. Stat. §302.372(6) St. Croix Count may, within 12 months after
the release of an inmate from jail, commence an action in circuit court to recover
the expenses under this chapter.
63.04 Institutional Accounts.
(A) The sheriff may charge an inmate for the expenses set forth above, while he/she
is an inmate plus the costs to investigate the financial status of the inmate and
the expenses of collection.
(B) If the sheriff maintains an institutional account for an inmate's use for payment of
items from canteen, vending, commissary or similar services, the sheriff may
make deductions from the account to pay for the expenses set forth above. If the
inmate has a balance due for expenses under this chapter, from prior
incarcerations, any institutional account created as part of a subsequent
- incarceration may be used to recover the sums due from the prior incarceration.
(C) If the sheriff maintains an account of a Huber inmate pursuant to Wis. Stat.
§303.08(3), the sheriff may make deductions from the account to pay for the
expenses set forth in this chapter subject to the limitation of Wis. Stat.
§303.08(5).

63.05 Inmate Cooperation
(A) An inmate in the jail shall cooperate with the county in seeking reimbursement
under this section for expenses incurred by the county.
(B) An inmate who intentionally refuses to cooperate may not earn good time credit
under Wis. Stat. §302.43 or diminution of sentence under Wis. Stat. §303.19(3).
63.06 No Duplication of Expenses. St. Croix County shall not recover the same
expenses twice.
63.07 Fees. Inmates shall pay the applicable fee(s) in accordance with a schedule that
shall be adopted and amended from time to time as necessary by the County
Board.
