1 RESOLUTION TO ISSUE QUIT CLAIM DEED TO 2 WILLIAM J. DeYOUNG AND TERESA A. DeYOUNG 3 4 Resolution 5 6 St. Croix. County, Wisconsin 7 8 WHEREAS, a tax deed issued to St. Croix County for the following described property in the 9 Town of Stanton was recorded on July 21, 1998: 10 11 That part of the former Chicago and North Western Railroad, lying within the NW1/4 of the 12 SWIA of Section 15, T3 IN, RI 7W, Town of Stanton, St. Croix County, Wisconsin. 13 14 and; 15 16 WHEREAS, for unknown reasons, no action has ever been taken to convey the tax deeded 17 property since 1998; and 18 19 WHEREAS, in February, 2011, the County Clerk received a call from Teresa DeYoung who said 20 she and her husband purchased a house in January 2011 and the title company found that approximately 21 20 feet of their driveway runs across the above described tax deeded property; and 22 23 WFIEREAS, the property contains 0.23 acres more or less and is subject to town road right-of- 24 way (170th Avenue); and 25 26 WHEREAS, it has been determined by the Administration Committee that because the small 27 parcel of land would most likely not receive a bid that would cover the costs of putting the parcel up for 28 bid, the procedures set forth in Chapter 3 - Ordinance Delegating Power to Acquire, Manage, and Sell 29 Tax-Deeded Lands (St. Croix County Code of Ordinances) should not be pursued and the County Board 30 of Supervisors should make the final decision to quit claim the property; and 31 32 WHEREAS, it is appropriate for the County to issue a quit claim deed to the DeYoungs to clear 33 the title of the parcel. 34 35 THEREFORE, BE IT RESOLVED that the County Board of Supervisors Chair and the County 36 Clerk, are hereby authorized and directed to sign the quit claim deed attached hereto from St. Croix 37 County to William J. DeYoung and Teresa A. DeYoung for the property described on lines 7 and 8 38 above. County records indicate the tax deed value is $9.57. Therefore, by allowing the County Board to take action, the procedures set forth in Chapter 3 - Ordinance Delegating Power to Acquire, Manage, and Sell Tax-Deeded Lands (St. Croix County Code of Ordinances) do not need to be pursued. If the Administration Committee chooses to proceed under Chapter 3 it would not need to be brought before the County Board, however, there would be a fiscal impact to the County consisting of appraisal costs, publishing costs and additional staff time.
