HomeMy WebLinkAboutResolution 2012 (03)I RESOLUTION APPROVING RECEIPT OF ESTABLISHED RATE OF 2 COMPENSATION BY SHERIFF'S DEPUTY TAMARA MARK 3 4 Resolution No. 2 0 La) 6 St. Croix County, Wisconsin 7 8 WHEREAS, on October 7, 2011, while performing her official employment 9 duties, Deputy Tamara Mark was injured while attempting to gain physical control 10 of a combative inmate in the St. Croix County Jail; and 11 12 WHEREAS, as a result of her efforts to maintain the security and 'orderly 13 operation of the St. Croix County Jail, Deputy Mark has been incapacitated since 14 October 7, 2011, by significant injuries; and 15 16 WHEREAS, those injuries require surgery and extensive long-term 17 rehabilitation, and have affected the quality of life and have placed a financial 18 strain on Deputy Marl-, and her family; and 19 20 WHEREAS, while Worker's Compensation benefits are available to Deputy 21 Mark, payments will not make up what Deputy Mark's normal compensation 22 would be had she not been incapacitated and she has had to, and will continue to 23 use PTO (personal time off) to make up the difference; and 'IM 25 WHEREAS, Article 17 — Duty Incurred Disability — of the Bilateral 26 Agreement between St. Croix County Deputy Sheriff's Association Local# 453 27 and St. Croix County allows the County Board to approve, upon recommendation 28 of the Sheriff, that any employee covered by said agreement receive his/her 29 established rate of compensation without deduction from accrued PTO if benefits 30 paid to the employee under Worker's Compensation are assigned to the County; 31 and 32 33 WHEREAS, Sheriff John A. Shilts has recommended that, during her 34 incapacity, Deputy Mark receive her established rate of compensation, retroactive 35 to October 7, 2011, without deduction from accrued PTO and assign her Worker's 36 Compensation benefits to St. Croix County; and 37 38 WHEREAS, the recommendation was made on the basis that it is 39 fundamentally unfair to force Deputy Mark to use accrued PTO to supplement the RESOLUTION APPROVING RECEIPT OF ESTABLISHED RATE OF COMPENSATION BY SHERIFF'S DEPUTY TAMARA MARK - Continued 40 41 42 43 44 45 46 47 48 Worker's Compensation payment for injuries incurred while protecting the public and enforcing the law. THEREFORE, BE IT RESOLVED by the St. Croix County Board of Supervisors that Deputy Tamara Mark receive her established rate of compensation during her incapacity, for a maximum period of six months, retroactive to October 7, 201 without deduction from accrued PTO on the condition that Deputy Mark assign any Worker's Compensation benefits for the incapacity resulting from the incident of October 7, 201 to the County.
