Croix County Zoning Office * Amended Items DATE: November 8, 2001 COPIES TO: County Board Office Committee Members County Clerk News Media/Notice Board i MINUTES St. Croix County Planning, Zoning and Parks Committee November 14, 2001 St. Croix County Government Center, Hudson, Wisconsin Committee members present: Supervisors Ron Raymond, Linda Luckey, Art Jensen, Buck Malick and Gerald Larson. Staff present: Steve Fisher Chairman Raymond called the meeting to order at 7:00 p.m. A motion was made by Malick, seconded by Jensen and passed, to adopt the agenda. The Committee will be meeting again on November 27 after the County Board meeting. A motion was made by Malick, seconded by Jensen and carried to approve the minutes from the 8/29, 9/25, 10/3 and 10/10/2001 meetings. Raymond explained the meeting process. Fisher read the hearing notice. Troy and Stacy Haigh: The request is to rezone approximately 10 +/- acres of land from Commercial to Ag /Residential. Location: A parcel of land located in part of the SE 1 /4 of the NE 1 /4 of Section 5, and part of the NW 1 /4 of the SW 1 /4 of Section 4, both in T30N, R19W, Town of Somerset, St. Croix County, Wisconsin. Stacy Haigh, property owner, is planning to rezone the property to construct a home. She and her husband bought the property in February 1997, and did not realize that it was zoned commercial. In September of 2001, they tried to obtain a building permit, but found that there was not a Certified Survey Map on the property. In October, during the CSM process, it was discovered that the property was zoned commercial. This whole process has delayed their building and they are way behind in the construction process. Don Wishert, a neighbor of the Haighs, stated that he has no objection to this request. Fisher then stated that they had received a call from Francis and Barbara Rivard, another adjoining landowner, stating their support of the rezoning request. Fisher indicated that the rezoning is consistent with the County Land Use Plan. Al Nyhagen, surveyor for the Haighs, stated that due to the topography, there could not be more than two homes located on this 10 -acre parcel. Motion by Malick, second by Larson and carried to close the hearing. A motion by Jensen was seconded by Larson and carried to recommend approval of the rezoning and forward the recommendation to the County Board based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. The parcel is not identified on the potentially productive agriculture map. 3. The entire site is identified on the primary environmental corridors map. 4. The proposed residential use of the land is appropriate. It is separated from the neighboring commercial uses by site characteristics. 5. The site does not meet the standards of the County Plan for commercial use. 1 6. If rezoned, the owners should be aware of limitations of development on steep slopes and roadway standards. 7. The Somerset Town Plan uses five guidelines to delineate where preferred development areas shall be located. Based on the criteria in the plan, this rezoning generally conforms to the Town Plan. 8. The area is in proximity to some existing development. There are smaller acreage farms and homes surrounding the site and a subdivision to the north. 9. Some of the parcel's terrain is not suitable for extensive development because of steep slopes and the wetland. 10. The area is located in the southern part of the town. 11. The land in the area is not good for farming and there is increasing development around the area. 12. The request generally conforms to the County Plan.
