Staff present: Steve Fisher and Deb Zimmermann Chairman Raymond called the meeting to order at 7:00 p.m. A motion was made by Jensen, seconded by Luckey and carried to adopt the agenda.. The next meeting will be October 24 at the Government Center in Hudson. Raymond explained the hearing process and opened the hearing. The notice was read into the record. John Schachtner: The request is to rezone approximately 17 +/- acres of land from Agriculture to Ag/Residential. Location: A parcel of land located in the NW 1/4 of the NW 1/4, Section 26, T31N, R16W, Town of Cylon, St. Croix County, Wisconsin. John Schachtner, property owner, is planning to rezone the property to use for future building sites for himself and his children. He said that there is no ag land on this property. Fisher told the committee that the request somewhat conforms to the County Plan, and the Town of Cylon has approved of the request, stating that it meets the criteria for § 91.77. Fisher went over the staff report, stating that this is a heavily wooded parcel and reiterated that it is not used for farming. A question was raised on whether or not a perk test has been done on the property to see if it can handle a septic system. Schachtner stated that there are a couple sites that perk for a mound system, but they are in the process of having more tests done. There was no opposition to the rezoning request. The hearing was recessed. A motion by Malick was seconded by Luckey and carried to table the request until there is evidence that the property will perk and the committee would like more information on the intended use of the property and how many home sites there may be. Roger Hillebrandt: The request is to rezone approximately .7 +/- acres of land from Agriculture to Ag/Residential. Location: A parcel of land located in the SW 1/4 of the SW 1/4, Section 1, T31N, R18W, Town of Star Prairie, St. Croix County, Wisconsin. Walt Schommer, 347 Huntington Drive, Star Prairie, is the buyer of the property. He explained that he wants to purchase this piece of property to use as an access to another 35 acres of property that he bought. He has no plans to develop the property. He bought for his own use. There was no opposition to the request. Fisher went over the staff report, and stated that he had visited the site and the staff would recommend approval of the request. Schommer's property is ag- residential, and according to the ordinance, property cannot be combined unless it is zoned the same. The Village of Star Prairie and the Township have given favorable approval of the request. Motion by Jensen, second by Luckey and carried to close the hearing. Motion by Jensen, second by Malick and carried to recommend approval and forward to the County Board based on the following findings: 1. The Town of Star Prairie supports the rezoning request and certified that the provisions of §91.77 have been met. The Village of Star Prairie certified no objections to the rezoning proposal under their extraterritorial review. 1 2. The request generally conforms to the County Plan. 3. The parcel is in the rural planning area and is an appropriate use. 4. The parcel is not identified on the potentially productive agriculture map. 5. The site features include heavily wooded slopes and a flat area. 6. The parcel is part of a larger 80 -acre site. 7. The site is not located on any roads. 8. The surrounding land uses include large acreages and small tracts and the Village of Star Prairie to the east, approximately 'Vs mile away. 9. The owner proposes to sell the parcel to an adjoining landowner who wants to use the parcel to access two 40 -acre parcels located diagonally from each other. 10. The parcel is too small for development. 11. The potential buyer states in the application that he does not intend further development on he two 40- acre parcels. He intends to create a trail to drive on for personal use. There is an area approximately 75- feet wide where the trail can be created without impacting the wooded slopes. 12. If rezoned, the owners should be aware of limitations of development on steep slopes and roadway standards. 13. Best management practices, erosion and sediment control and stormwater management should be utilized to avoid impacts to the surrounding water bodies. 14. The St. Croix County Natural Resource Management Plan Goals II, III and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats; and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. Request will go to County Board on October 30 . Three - Putt: Fisher went over the findings listed on the Ordinance for this rezoning. Corporation Counsel has approved. The request will be placed on the October 30 County Board agenda. Budgets: The committee asked Fisher to invite Chuck Whiting to attend the October 24 meeting to discuss budget issues related to zoning and parks. Fisher informed the committee that zoning has filled their vacant secretarial position and will be interviewing for the remaining vacant position on October 28 Malick will sit in on the interviews.
