Location: Part of the NE 1 /4 of the NE 1 /4 of Section 5, T31 N- R19W, Town of Somerset. 2) Kenneth and Renee Dykhouse to rezone approximately 4 ( + / -) acres of land from Agriculture to Ag /Residential. Location: The SE % of the SW 1 /4 Section 33, Town of Baldwin. 3) Kent Wynveen to rezone approximately 1.72 +/- acres of land from Ag/ esidential to Commercial. Sta present: Steve Fisher and Deb Zimmermann Chairman Raymond called the meeting to order at 7:10 p.m. A motion was made by Jensen, seconded by Luckey and carried to adopt the agenda. Three -Putt LLC -fi Finalize Rezoning Decision: Fisher presented draft findings and conditions for the rezoning of the ee -Putt request for 37 acres from Ag/Residential to Commercial and 42 acres from Ag/Residential to ndustrial. Fisher told the committee that the Planning staff and Corporation Counsel have reviewed thi material. A question was raised on whether or not the County Plan would have to be amended to allow this rezoning. Fisher does not think so, but will check with Corporation Counsel. Fisher reminded the Committee that any use on the property will have to go through the special exception process. The Committee re iewed the material, and made suggestions for the staff. Motion by Raymond, second by Jensen and ca 'ed to accept findings 1 -15 from staff, and to have Corporation Counsel review the remainder, with th suggestions of the Committee. This will be on the October 10 agenda for final review. Raymond explained the hearing process and opened the hearing. The notice was read into the record. Lyle Palmsteen : The request is to rezone approximately 20 +/- acres of land from Agriculture to Ag/Residential. cation: A parcel of land located in part of the NE '/4 of the NE %, Section 5, T31N, R19W, Town of Bialdwin, St. Croix County, Wisconsin. Lyle Palmsteen, property owner, is planning to rezone the property to sell to his neighbor. The original buyer, JEO /Springbrook Development, is no longer interested. Fisher told the committee that the request conforms to the County Plan, and the Town of Somerset has approved of the request, stating that it meets the criteria for § 91.77. The request meets four of the five criteria for the Town of Somerset requirements for rezoning. There was no opposition to the request. The hearing was recessed. A motion by Malick was seconded by Jensen and carried to forward to the County Board based on the following findings: 1. The Town of omerset supports the rezoning request. The Somerset Town Plan uses five guidelines to delineate whe e preferred development areas shall be located. Based on the criteria in the plan this rezoning conforms to the Town Plan. 2. The request g. erally conforms to the County Plan. 3. The Town ce ified that the provisions of §91.77 have been met. 4. The parcel is • the rural planning area and is an appropriate use. 5. The site is pre .ently cropped. 6. Approximatel 1/3 of the parcel is identified on the potentially productive agriculture map. 7. Approximatel half the site is farmed, the other half is rolling and wooded. 8. Approximatel 3 /4 of the parcel is identified on the primary environmental corridors map. 9. The environm-ntal features include: Shoreland to a nearby wetland and 6 to 12 percent slopes. 10. Limiting soils for Private Onsite Wastewater Treatment Systems (POWTS) are found on a small portion of the site. 1 .. 11. The surrounding land uses include large active farms, and a subdivision to the west. 12. Access to the site is from two town roads. 13. Large lot devel would be consistent with the rural character of the areas. 14. There is total p tential development of approximately 6 lots. 15. The owners should be aware of the limitations associated with the environmental features. The area with soil limitation for POWTS should not be associated with a drainfield. 16. As the owners onsider design elements, they should be encouraged to use best management practices, erosion and se iment control and stormwater management for the steep slopes; direct drainage away from the wetl d. I Request will go to Iounty Board on October 30 Kenneth and Renee Dykhouse: The hearing was reopened by Raymond. The request is to rezone 4 +- acres of land from Ag to Ag/Residential. Property is located in the SE 1/4 of the SW 1 /4, Section 33, T29N -R16W, Town of Baldwin. Renee and Kennet Dykhouse were present to speak. They plan to build one single- family home on the property, and in or er to get a better rate on their loan, they need to have the property rezoned. Fisher said the staff does not object. Joe Hurtgen, Chai '' an, Town of Baldwin, told the committee that these applicants have not been before the town with thei request. Fisher stated that it was an oversight, and that it is his understanding that their hearing is to orrow evening. The hearing was recessed. Motion by Malick, second by Luckey and carried to table the request until October 10`" to give the Town time to respond after their hearing. i Kent Wynveen: a hearing was reopened by Raymond. The request is to rezone 1.72 acres of land from Ag/Residential to Commercial. The property is located in part of the SE 1/4 of the SE 1 /4, Section 24, T29N -R17W, To of Hammond. Kent Wynveen, the owner of the property, purchased the property 17 years ago and has been operating a commercial business since that time. He did not know that it was not zoned commercial. Jeff Hellendrung, 1 180 Oak Street, wants to purchase the business, and wants the zoning corrected. Fisher told the committee that the staff supports the request to correct a zoning problem. This zoning is consistent with th$ County Plan. Motion by Jensen second by Luckey and carried to close the hearing. Motion by Malicl4 second by Larson and carried to recommend that this rezoning be recommended to the County Board, based on the following findings: 1. The Town of ammond supports the rezoning request 2. The rezoning s consistent with the St. Croix County Land Use Management Plan. 3. The site is an xisting commercial operation that was not identified on the Town of Hammond's original zoning map. a commercial use has existed for approximately 20 years, according to the application. 4. Surrounding 1 nd uses include a commercial use to the south and farmland to the north, east and west. 5. The surround' g zoning is Commercial to the south and Ag/Residential to the north, east and west. 6. The site is loc ted on State Highway 63 approximately a quarter mile from theBaldwin village limits. 7. Site features include a small piece of prime farmland and very poor soils for Private Onsite Wastewater Treatment Sytems (POWTS). 2 . 8. Expansion of tie commercial use is limited by the soils for onsite wastewater treatment and the nor conforming parcel size. 9. The zoning on this site should be corrected to avoid a non-conforming use situation. The request will bf placed on the October 30 County Board agenda.
