Simon to rezone approximately 20 acres of land from Agriculture to Ag -II. Location: The NW % of the NW '/4 of Section 29, T31 N R17W, Town of Stanton. 2) Merlin Frank to rezone approximately 13.3 +/- acres of land from Agriculture to Ag /Residential. Location: Part of the NE' /4 of the SW '/4 and part of the SE '/4 of the SW '/4 of Section 14, T31 N R1 7W, Town of Stanton. 3) Reconsideration of Steve and Theresa Johnson Certified Survey Map to discuss additional conditions. Staff present: Steve Fisher and Deb Zimmermann Chairman Raymond called the meeting to order at 7:00 p.m. A motion was made by Luckey, seconded by Malick and carried to adopt the agenda. The upcoming meetings for this Committee are June 12 and 13, 2001. Raymond explained the hearing process and opened the hearing. The notice was read into the record. Joseph K, and Judy A. Simon : The request is to rezone approximately 20 +/- acres of land from Agriculture to Ag -II. Location: A parcel of land located in the NW 1 /4 of the NW '/4, Section 29, T3 IN, RI 7W, Town of Stanton, St. Croix County, Wisconsin. Judy Simon, property owner, lives at 1519 200 Avenue, New Richmond. She appeared on behalf of the applicants. She explained that she and her husband would like to build a house on this site for themselves. The remainder of the property will remain in pasture, and they will have some livestock. The house will be built on the least productive part of the property. The committee viewed pictures of the property. The Simons are having a Certified Survey Map completed. Eileen Simon, 1499 200 Avenue, New Richmond, stated that she is in favor of the rezoning. No one spoke in opposition of the request. Fisher went over the staff report and analysis, stating that the request meets the ordinance requirements and generally conforms to the County Plan. The Town has approved the request, and found that the request meets the requirements of State Statute 91.77, which was considered by the Town in making the decision, forwarded in a letter dated May 14. The hearing was recessed. A motion by Malick was seconded by Luckey and carried to table the request until the meeting on June 12 The Committee will view the property on June 12 th . Merlin Frank: The hearing was reopened by Raymond. The request is to rezone 13.3 +- acres of land from Ag to Ag/Residential. Property is located in the NE 1/4 of the SW i / 4 and part of the SE t /4 of the SW t /4, Section 14, T3 IN, R17W, Town of Stanton. Merlin Frank, 1811210"' , New Richmond, was present to speak on his behalf. He went over a map of the property with the Committee. He believes this part of his property is undesirable for farming, and he planted it in trees. He has a letter from the Natural Resources Conservation Service stating that it is not good farmland. His intention is to subdivide the property. Joe Camine, Steve Halleen, and Rich Krampert spoke in support of the request. Mary Barney, 1413 200 New Richmond, spoke in opposition of the request, stating that she believes this to be good farmland, and the Town of Stanton Guidelines should be followed. The guidelines state that land classified as class 1,2 or 3 should remain in Ag. Barney added that the Town needs to follow guidelines that have been set by the Town, or change them. Dick Hesselink, Town of ,0 Stanton Chairman, spoke on behalf of the Town, stating that they believe Frank should be able to rezone. According to information they received, the soil classifications meet the requirements of the township, with the majority of the soils on this parcel designated as poor farmland. "Walter Anderson, 2075 150 St., New Richmond, agreed with Hesselink. Discussion was held on how soils are determined. Zoning will look into this. Hesselink further added that the Town of Stanton is presently looking into a Smart Growth Plan and working with the County to move forward on this plan. Fisher went over the staff report and analysis. With the information that zoning has received, the request generally does not conform to the County Plan. A motion by Luckey was seconded by Jensen and carried to close the hearing. A motion by Larson was seconded by Malick and carried to table the request until more information is received. The committee will view the property on June 12 Johnson CSM: Motion to reconsider the conditions of the Steve and Theresa Johnson CSM by Malick, seconded by Luckey and carried. Discussion held on the conditions of the CSM. Motion by Malick, seconded by Luckey and carried, condition number three will be placed on the CSM to read as follows: "No sanitary permits or building permits will be issued until the private road is constructed to town and county standards and dedicated in its entirety consistent with 18.16(H)(3). This construction and dedication includes the road located north of this CSM and the road to the west of the CSM. Escrow money in the amount of 120% of the estimated cost may be provided in lieu of the actual roadway construction, to insure that roads will be upgraded as required." Carried.
