2) Debra Potting to rezone approximately 20 +/- acres of land from Agriculture to
Ag /Residential. Location: Part of the NW '/4 of the NE % of Section 8, T31 N
R1 9W, Town of Somerset.

MINUTES
St. Croix County Planning, Zoning and Parks Committee
May 23, 2001
St. Croix County Agriculture Center, Baldwin, Wisconsin
Committee members present: Supervisors Ron Raymond, Linda Luckey, Art Jensen, Gerald
Larson and Buck Malick. Staff present: Steve Fisher and Deb Zimmermann
Chairman Raymond called the meeting to order at 7:00 p.m. A motion was made by Jensen,
second by Malick and carried to adopt the agenda. The upcoming meetings for this Committee
are May 29 and May 30, 2001. The committee will tour the properties for the upcoming
rezonings on Tuesday, June 12 The tower ordinance amendments will be placed on the agenda
for June 13 for a public hearing
Minutes: Motion by Malick, second by Luckey and carried to approve minutes from the April
24, 2001 meeting.
Raymond explained the hearing process and opened the hearing.
David Screaton, owner/ Brian Nelson, agent : Fisher read the notice into the record.
The request is to rezone approximately 1 +/- acre of land from Agriculture to Ag/Residential.
Location: A parcel of land located in the NE t /4 of the SE 1 /a, Section 28, T28N, R19W, Town of
Troy, St. Croix County, Wisconsin.
Brian Nelson, 138 Bjersted Lane, River Falls, Wisconsin, is the agent representing this request.
The owner plans to acquire approximately one acre of land to add onto his parcel, to create a
buffer space between properties. The property line will be straightened out.
The Town of Troy has approved this request, and stated so in a letter dated March 23, 2001, and
have considered W1. Stat. 91.77 in making their decision. Nelson stated that restrictive
covenants have been signed, as required by the Town, a copy of which was presented to the
committee.
Fisher went over the staff report, stating that the parcel conforms to the County Plan, and staff
believes the buffer space is an improvement to the property.
The hearing was recessed by Raymond. A motion by Malick was seconded by Jensen and carried
to forward to the June 19 County Board meeting, based on the following findings:
1. The Town and County have certified that the provision of State Stat. 91.77 has
been met.
2. The Town of Troy has recommended approval of the request.
3. The land is in the rural planning area and is an appropriate use.
4. The parcel is identified on the potentially productive agriculture map.
5. Approximately '/z acre was farmed.
6. The parcel is identified on the primary environmental corridor map.
7. Environmental features consist of 12 to 20 percent slopes.
8. The one -acre is being removed from a 150 -acre farm.
9. The proposed use of the land to add one acre to an existing homesite and provide
an additional buffer to the existing farm fits the policies of the County Plan.
10. The resultant parcel will be approximately 6.5 acres. However, additional
development is limited by the roadway easement and physical layout of the
homesite.
11. The surrounding land uses are small acreages, an active farm and a subdivision.
Debra Potting, owner /JEO, agent: The hearing was reopened by Raymond. Fisher read the
notice. The request is to rezone 20 +/- acres of land from Ag to Ag/Residential. The property is
located in the NW '/4 of the ME '/4, Section 8, T3 IN R1 9W, Town of Somerset.
Don Potting, 355 23 Avenue, Somerset, Wisconsin, was present to speak on behalf of the
applicant. They plan to divide the 20 acres into 2 lots, one lot being 7 acres, the other 13 acres.
They have had offers from buyers on these two parcels.
Fisher went over the staff report. The request complies with the County Plan, and the land is in
proximity to other subdivision development. The land is not good for farming. The Town of
Somerset has recommended approval, and stipulated in writing that they have considered State
Statute 91.77 in their decision.
A motion by Jensen was seconded by Larson and carried to close the hearing. A motion by
Malick was seconded by Jensen and carried to forward the request to the County Board based on
the following findings:
1. The Town of Somerset has recommended approval of the rezoning request.
2. The request complies with the County Plan.
3. The parcel is in the rural planning area and is an appropriate use.
4. A small portion of this parcel is identified on the potentially productive agriculture map.
5. Approximately half the site is farmed and the other half is rolling and wooded.
6. Approximately half the parcel is identified on the primary environmental corridor map.
7. The environmental features include: woodlands, a closed depression and drainage channel
and steep slopes.
8. The proposed use of the land for two lots of 7 and 13 acres meets the policies of the County
Plan.
9. Large lot development would be consistent with the rural character of the area.
10. There were no objections to the request.
11. The Town and the County have certified that the provisions of §91.77 have been met.
The requests will be forwarded to the County Board meeting June 19, 2001.
A motion by Jensen was seconded by Raymond and c . d to adjourn at 7:37 p.m.
