Staff present: Rod Eslinger and Deb Zimmermann Chairman Raymond called the meeting to order at 7:00 p.m. A motion was made by Jensen, seconded by Larson and carried to adopt the agenda, noting that the Tower Ordinance will be taken off the agenda. The upcoming meetings for this Committee are May 23, May 29 and May 30, 2001. Minutes: Motion by Malick, second by Luckey and carried to approve minutes from the April 10 and April 18, 2001 meetings. Raymond explained the hearing process and opened the hearing. The notice was read into the record. Kenneth Graf/ John Vrieze : The request is to rezone approximately 4 +/- acres of land from Agriculture to Ag/Residential. Location: A parcel of land located in the SW 1 /4 of the SW 1 /4, Section 11, T29N, R16W, Town of Baldwin, St. Croix County, Wisconsin. Kenneth Graf, property owner, lives at 1152 24 Street, Baldwin, and is here on behalf of the applicants. He explained that he would like to sell this remnant building site to John Vrieze for a future home. Vrieze, 987 200 Street, Baldwin, Wisconsin, stated that he has an offer to purchase on the property, contingent on this rezoning. He may build a home on the property. in the future for himself or for one of his children. Albertine Jacobson, 2517 County Road E, Baldwin, stated that she has no objection to the request, and attended the hearing to find out what the intent was behind the rezoning. Joe Hurtgen, Chairman of the Town of Baldwin, stated that the Town has approved the request, and found that the request meets the requirements of State Statute 91.77, which was considered by the Town in making the decision, forwarded in a letter dated April 6. Eslinger went over the staff report, stating that the request generally conforms to the County Plan. The Town is aware that the property is exactly 4 acres. The hearing was recessed. A motion by Jensen was seconded by Malick and carried to forward to the County Board based on the following findings: 1. The Town of Baldwin has recommended approval of the rezoning request. 2. The request complies with the County Plan. 3. The request is compatible with the surrounding land uses. 4. The land is in the rural planning area and is an appropriate use. 5. There is a former homesite on the property. 6. There were no objections to the request. 7. The Town certified that the provisions of §91.77 have been met. r James and Mary Sander: The hearing was reopened by Raymond. The request is to rezone 40 +- acres of land from Ag to Ag -II. Property is located in the SE 1/4 of the SE 1 /4, Section 26, T28N,R17W, Town of Rush River. James and Mary Sander were present to speak on their own behalf. They bought the property in 1990 and would like to build a home for themselves. The west half of the property perc'ed for a septic system, and the east half did not. The property has not been farmed for many years, and is not good property for farming. Eslinger went over the staff report, saying that the property is not good farmland. The request complies with the County Plan. The Town of Rush River has recommended approval, after considering Statute 91.77. A motion by Jensen was seconded by Larson and carried to close the hearing. A motion by Jensen was seconded by Malick and carried to forward the request to County Board based on the following findings: 1. The Town of Rush River has recommended approval of the rezoning request. 2. The request complies with the County Plan. 3. The request is compatible with the surrounding land uses, which include small hobby farms and large active farms. 4. The land is in the rural planning area and is an appropriate use. The proposed use is for one homesite. 5. Approximately half the parcel is identified on the potentially productive agriculture map. 6. The site has been converted to wildlife habitat mostly planted with deciduous and conifer trees. 7. Soil limitations likely preclude a second homesite on the property. 8. There were no objections to the request. 9. The Town certified that the provisions of §91.77 have been met. Both requests will be forwarded to the County Board meeting on May 22, 2001. Rezoning Schedule: The following rezoning requests were scheduled: June 6, 2001, Stanton Town Hall, 7:00 p.m.: Simon, Frank, and Krampert, all in Stanton. June 13, 2001, Gov. Center in Hudson, 7:00 p.m.: Sheifelbein request, Town of Somerset A motion by Malick was seconded by Jensen and carries to adjourn the meeting at 7:45 p.m. A Debra Zi e ann, Recorder C. W.
