CROIX COUNTY GOVERNMENT CENTER, HUDSON, WI April 24, 2001 Present: Supervisors Ron Raymond, Linda Luckey, Art Jensen, Buck Malick and Gerald Larson. Staff: Steve Fisher, Mary Jenkins, Debbie Zimmermann. Others: Ron Johnson, Doug Zahler, Ed Flanum, Leroy Urhammer, Adele Urhammer, Betty Zuettel, Charles S. Cook, Joe Granberg, Jim Jahnke Chair Raymond called the meeting to order at 9:00 a.m. It was noted that the final plat for The Orchard has been withdrawn from the agenda. Malick moved, seconded by Larson and carried, to adopt the agenda with the change noted. Minutes/ Meeting Dates: Raymond said the next meeting is May 8th. Motion by Jensen, second by Larson and carried to approve minutes from the March 21, 2001 meeting. Minor Subdivisions: See Attachment A Major Subdivisions: See Attachment B : A discussion was held on outlots in the Eagle Bluff major subdivision and the Feyereisen CSM in the Town of Troy. Chuck Cook, developer, was present to discuss. Motion by Malick second by Jensen and carried to allow nature trails, walking paths (to extend to the south to continue into Eagle Bluff subdivision), picnic areas and an open - air structure that will not exceed 35 -feet by 35 -feet on the Feyereisen outlot. This information to be placed on the face of the map. A second motion was made to allow outlots in Eagle Bluff major subdivision to include nature trails, walking paths, picnic tables and sitting benches. Developer is required to record an Affidavit with the Register of Deeds identifying these uses on the outlot. A copy of the Affidavit is to be reviewed by staff before recordation. Motion carried. Scheduling of Rezoning Requests: The following rezoning requests were scheduled: May 15, 2001 at the Agriculture Center in Baldwin at 7:00 p.m.: James and Mary Sander, Town of Rush River, and Kenneth Graf, Town of Baldwin. May 23, 2001 at the Government Center in Hudson at 7:00 p.m.: David Screaton, Town of Troy and Debra Potting, Town of Somerset. May 30, 2001 at the Government Center in Hudson at 7:00 p.m.: Gloria Basil, Town of St. Joseph Betty Zuettel, Town of Baldwin, addressed the Committee, asking that an outlot on her property be looked at by appropriate officials to determine if it could somehow be defined as a buildable lot. Fisher recommended that the Land and Water Conservation Department and the DNR take a look at this, as there are floodplain issues, and send zoning a recommendation. The Committee recessed from 10:20 a.m. to 10:30 a.m. Modifications to Tower Ordinance: Malick presented proposed ordinance to the committee. It is the opinion of Corporation Counsel, that there is no conflict of interest for Malick to serve on this committee and be part of the work group that edited the existing tower ordinance. Malick went over proposed changes to the current ordinance. Discussion held. Motion by Malick, 1 second by Larson to table a decision on this ordinance. It will be placed on an agenda at a later date. Capital Outlay Planning: The committee will review the handouts given to them by Planning and Zoning regarding this issue, and will discuss at the meeting on May 8"'. The Committee recessed at 11:00 a.m. to go to the University of Wisconsin - River Falls to listen to a presentation on Conservation Design. Staff Recommendation: Approval Committee action: Motion by Malick, second by Larson to approve. Motion carried. 2. Owner: Leroy Urhammer Location: SE' /4- SE' /4, & the SW' /4 - SE' /4, Section 14, T30N -R20W, Town of Somerset, 3 lots totaling 32.60 acres, original parcel, 32.60 acres. Staff Recommendation: Approval Committee Action: Motion by Malick, second by Larson to approve. Motion carried. 3. Owner: Raymond & Pauline Henke Location: NE 1 /4- SE' /4, Section 16, T29N -R16W, Town of Baldwin, 1 lot totaling 10.00 acres, original parcel, 200 acres. Staff Recommendation: Approval Committee Action: Motion by Larson, second by Jensen to approve. Motion carried. Is noted that this is being created through Farm Consolidation 4. Owner: Glen Sather Location: SW 1 /4 -SW 1 /4, Section 10, T29N -R17W, Town of Hammond, 2 lots totaling 39.78 acres, original parcel, 39.78 acres Staff Recommendation: Approval Committee Action: Motion by Larson, second by Malick to approve. Motion carried. 5. Owner: Norman and Shirlee Feyereisen Location: SE 1 /4- SE 1 /4, Section 8, T28N -R19W, Town of Troy, 3 lots plus 1 outlot totaling 11.5 acres, original parcel, 193 acres. Staff Recommendation: Conditional Approval: 1) Financial guarantees equal to 120% of the construction bid are required for erosion control and road construction. A written estimate must accompany the bids; 2) No construction, including earth moving, shall take place prior to approval of the financial guarantees; a construction waiver may not be approved for the next phase of the plat until guarantees are approved; 3) The County Highway Department and the Land and Water Conservation Department must be notified 3 days prior to construction beginning. Committee Action: Motion by Malick, second by Jensen to approve with conditions recommended by staff and with the addition of condition #4) A note is to be placed on the map stating that open air structures may not exceed 35' x 35' in size. Motion carried. 6. Owner: Darcy Hagenson Location: NW 1 /4 -NE 1 /4, Section 25, T29N -RI 6W, Town of Baldwin, 1 lot totaling 2.28 acres, original parcel, 80 acres Staff Recommendation: Approval Committee Action: Motion by Luckey, second by Malick to approve. Motion carried. 7. Owner: Dwight and Shirley Alwin Location: NE ' / -NW '/4 & NW '/4 - NE '/4, Section 14, T29N -R17W, Town of Hammond, 2 lots totaling 11.71 acres, original parcel, 11.71 acres. Staff Recommendation: Approval Committee Action: Motion by Larson, second by Malick to approve. Motion carried. 8. Owner: Norman and Mary Logterman Location: SE '/4 - SW' /4, Section 15, T30N -R16W, Town of Emerald, 1 lot totaling 31.69 acres, original parcel, 51.56 acres (The remainder is being added to an existing lot). Staff Recommendation: Approval Committee Action: Motion by Jensen, second by Malick to approve. Motion Carried.. 9. Staff Recommendation: Conditional Approval: Lot 1 shall access from 210 "' Avenue per Highway Department review; a note is to be place don the map regarding access. Committee Action: Motion by Malick, second by Luckey to approve with conditions recommended by staff. Motion carried. 10. Staff Recommendation: Approval Committee Action: Motion by Luckey, second by Jensen to approve. Motion Carried. 11. Glover Prairie - Preliminary Owner: Robert Bjerstedt Location: Section 15, Town of Troy, 8 lots + 1 outlot totaling 35.89 acres Staff Recommendation: Conditional Approval: 1) Financial guarantees equal to 120% of the construction bid are required for erosion control and for the construction of joint access; 2) No construction, including earth moving, shall take place prior to approval of the financial guarantees; a construction waiver may not be approved for the next phase of the plat until guarantees are approved; 3) The County Highway Department and the Land and Water Conservation Department must be notified 3 days prior to construction beginning; 4) A stormwater discharge permit must be obtained from the DNR; Committee Action: Motion by Malick, second by Jensen to approve with conditions recommended by staff, and with the addition of condition #5) Wording to be placed on plat that no construction is to take place on the outlot.
