St. Croix County Planning, Zoning and Parks Committee
February 21, 2001
St. Croix County Government Center, Hudson, Wisconsin
Committee members present: Supervisors Ron Raymond, Linda Luckey, Art Jensen and Gerald
Larson. Supervisor Buck Malick was excused. Staff present: Steve Fisher and Deb Zimmer-
mann
Chairman Raymond called the meeting to order at 7:00 p.m. A motion was made by Jensen,
seconded by Luckey and passed, to adopt the agenda.
The Committee will be meeting again on February 26"' and 27"' and March 7th
Raymond explained the hearing process. Fisher read this notice into the record:
1) Jon M. Schiltgen to rezone approximately 31.17 +/- acres of land from Agriculture
to Ag -II. Location: The NE 1 /4 of the NE' /4 of Section 2, T28N R19W, Town of
Troy
2) Norm and Shirley Feyereisen to rezone approximately 12.5 +/- acres of land from
Agriculture to Ag/Residential. Location: The SE 1 /4 of Section 8, T28N R19W,
Town of Troy
Jon Schiltgen/John Larsen: John Larsen appeared on behalf of the Schiltgens. Larsen has an
existing mining business where sand is mined. It was discovered that half of the sand being
mined is on the Schiltgen property, and Larsen is asking to have the property rezoned to Ag -II to
allow him to continue his mining operation on the Schiltgen property. He plans to "flatten" the
hill on the property by mining the sand, and not to mine deep into the ground. He has received a
permit for road access from the Highway Department.
Fisher explained to the Committee that mining on property that is zoned Ag -II is allowed under
the ordinance with a Special Exception permit, but is not allowed on property zoned Agriculture.
Fisher said that there were two neighbors that sent letters to the zoning office in opposition of
this request. He further stated that if this property is rezoned, the Zoning staff will be asking the
applicant for preparation of detailed engineering plans for the Special Exception permit request.
The neighbors' specific mining concerns can be addressed at the time of the Board of Adjust-
ment Hearing.
The County staff feels that the request generally conforms to the County and Town plan. Dean
Albert, Town of Troy Chairman, stated that the Town of Troy supports this request. A question
was raised by Mel McElwain, a neighbor to the Schiltgens, with regard to property line setbacks,
buffers between surrounding property and the mining operation, and road traffic concerns. Fisher
reiterated that these issues would be addressed at the Special Exception hearing with the Board
of Adjustments, and that setbacks and buffers will be part of the engineered plans, and are re-
quired by the ordinance. According to Mr. Larsen, he has already been issued an access permit
for the property from the Highway Department.
The hearing was recessed. Motion by Larson, seconded by Luckey and carried to table this re-
quest to the February 27 meeting for a decision. Fisher will check with the Highway Depart-
ment to assure that all access issues have been addressed.
Norm and Shirley Feyereisen:
Chuck Cook, of Troy Development Corp., represented the Feyereisens. He showed the Com-
mittee a map of the proposed plat that would be developed if the rezoning is approved. The land
ties into the Eagle Bluff subdivision and would be part of that Homeowner's Association. This
land would have three lots for building and there will be land left open as green space. The plat
has been designed under the "Whole Farm Plan" required by the Town of Troy Subdivision Or-
dinance. Dean Albert appeared for the Town of Troy stating that the Town recommends ap-
proval and the plan meets all of the Town's requirements.
Fisher went over the staff report and stated that it is staff's opinion that the request complies with
the Town and County Plan. All questions that the Planning Department had on this request have
been answered with the subdivision concept proposal.
Motion by Luckey, second by Jensen and carried to close the hearing.
Motion by Larson, second by Luckey and carried to table a decision on this request until the
meeting on February 27
A motion was made at 7:45 p.m. by Larson, seconded by Jensen and passed, to adjourn.
