Staff present: Steve Fisher, Deb Zimmermann, Greg Timmerman, Dave Fodroczi, Pete Kling, Dave Johnson. Others: Roger VanBeek, Jerry Morrow Chairman Raymond called the meeting to order at 10:10 a.m. A motion was made by Jensen, seconded by Larson and passed, to adopt the agenda. Chairman Raymond explained that today's meeting is for the Committee to discuss the rezoning request of Three -Putt LLC. It is not a hearing to take testimony from those present representing Three -Putt LLC. Fisher went over the letter sent to Three -Putt, outlining the six items that Committee asked the applicants to address. Timmerman spoke to the Committee on conditional zoning, and stated that it is a legal option in Wisconsin; however, contract zoning is not. He talked about the difference, stating that contract zoning is not enforceable. Timmerman said that it is important that this rezoning comply with the County Plan and be compatible with surrounding uses. Fodroczi said that the proposed use for this property is partly compatible with the County Plan. Part of this land lies in the urban planning area. The part in the rural planning area is near a major traffic corridor, Highway 65 and I -94, and according to the Plan, commercial and light industrial uses would be allowed. Therefore, this rezoning request would be consistent with the County Plan except for the unavailability of sewer and water for the industrial use. It was discussed that the applicants have requested annexation into the Village of Roberts. At the present time, there is no legal way to annex this property, as there is no Village land contiguous to this property. The Village does not have capacity for water and sewer service either. A discussion was held on having residential property near commercial and industrial property. Fodroczi said that this may pose a problem, but could be looked at if there is a buffer area between the properties. The applicant stated they are willing to look at dropping the residential rezoning, and just rezoning to commercial and light industrial. The Committee reviewed a map showing the location of environmental corridors on the property. A discussion was held on the need for an intersection study and traffic analysis. The DOT has indicated that it may well conduct such a study near this site in the spring of 2001. The Committee strongly believes that some study must be done before rezoning of the property can be completed. This could be a potentially dangerous intersection if plans are not done correctly from the start. The Committee directed the staff to look at options available to move this rezoning process forward. Staff is to prepare a draft conditional zoning memorandum listing the exact conditions. The Committee felt it was important to limit industrial uses to light industrial uses and exclude uses that would be better served on municipal sewer and water. They should find out from the DOT what type of study would be required to address traffic issues. Staff is to work with the i �� ...J. applicant on this request so that it moves forward and a decision can be made. Staff will report back at a future meeting. Scheduling meetings /viewings: The Committee requested an update on the Villafana (Birch Park) rezoning at the next meeting on February 13 Staff is to ask the applicant for an update, too. Viewings of upcoming rezonings will be conducted on February 13 Homestead Park at Perch Lake: Pete Kling addressed the Committee regarding road issues at Homestead Park. He met with Fedderly on February 5. Highway has been talking to Pember Excavating about extending the contract to get the road done in a timely manner. The project suddenly appears over budget. Kling put together a list of actual costs and shared it with Fedderly. The Committee instructed Kling to work with Highway, and Rich Loney. It is extremely important to move forward on this project.
