CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG- RESIDENTIAL AND REZONING LAND FROM AGRICULTURE TO RESIDENTIAL ORDINANCE NO. (50 L O6Lt) WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of TIM BAZILLE on January 14, 2004, in the St. Croix County Government Center in Hudson, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: See attached descriptions (5 -acres Agriculture to Residential, 2 -acres Agriculture to Ag- Residential) Based on the following findings: 1. The parcels are in the rural planning area and are an appropriate use. 2. Both sites are presently open land. 3. Site access to both sites is a town road, 80 Avenue. 4. Neither site has any environmental corridor. 5. There are no limitations for Private Onsite Wastewater Treatment Systems (POWTS). 6. Surrounding land uses include a church and two small residential lots to the east and open agricultural land to the west, north and south. 7. Surrounding zoning is exclusive ag to the north, west, south and southeast and ag- residential to the northeast. 8. Proposed use of the five -acre site is expansion for the church, including a one -acre parking lot, 1/3 of an acre for an easement to access the fields to the north and three plus acres for future playground and as a buffer against future development. These three acres will be farmed temporarily. 9. Proposed use of the two -acre site is one building site. 10. Potential development is two lots on the five -acre site and one lot on the two -acre site. 11. The St. Croix County Natural Resource Management Plan Goals II, III and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats; and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. 12. The Town of Baldwin has recommended approval of the rezoning, and has considered §91.77 in making their recommendation. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 2 -acre parcel is now rezoned from Agriculture to Ag- Residential and the 5 -acre parcel is now rezoned from Agriculture to Residential. Both properties are located in the Town of Baldwin. Dated this GI O day of l cr` , 2004. ST.
