HomeMy WebLinkAboutOrdinance 2004 (649) ORDINANCE AMENDING CHAPTER 17 ST. CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG.-RESIDENTIAL ORDINANCE NO. LO u c ( (-1) WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of DAVID GAZDIK on January 14, 2004, in the St. Croix County Government Center in Hudson, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: 40 acres of land located in the SE 1 /4 of the NW 1/4,Section 14, T3ON- R19W,Town of Somerset. Based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. Site consists of open rolling land with some woods, a residence, outbuildings, a man-made grade stabilization structure in the northeast. 3. The site is currently a single residence and former farm fields. 4. The site has woodlands, moderate slopes and shorelands and is adjacent to a waterfowl protection area. 5. The whole site is an environmental corridor. 6. Approximately 1/3 of the site is prime farmlands. 7. There are no limitations for Private Onsite Wastewater Treatment Systems (POWTS) on the site. 8. Surrounding land uses include open agricultural land to the west and south, U.S. Fish and Wildlife lands to the east and smaller residential sites to the north. 9. Surrounding zoning is exclusive ag to the west and south, ag residential to the north and conservancy to the east. 10. The site has access to a town road, 75 Street, to the east. 11. Proposed use is to sell the existing structures with five acres and construct a residence on the remaining 35 acres. 12. Potential development is approximately 12 lots. 13. The St. Croix County Natural Resource Management Plan Goals II, III and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats; and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. 14. The Town of Somerset has recommended approval of the rezoning, and has considered §91.77 in making their recommendation. The Somerset Town Plan uses five guidelines to delineate where preferred development areas shall be located. Based on the criteria in the plan, this rezoning is generally consistent with the Town Plan. 15. The area is in proximity to some existing development. The parcel's terrain is suitable for development. 16. The area is located in the southern part of the town. 17. Avoid areas adjacent to or in proximity to rivers, wetlands, lakes and conservancy areas. 18. Justify non - agricultural uses on land in the agriculture district. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 40 -acre parcel in the Town of Somerset is now rezoned from Agriculture to Ag- Residential.
