HomeMy WebLinkAboutOrdinance 2004 (648) ORDINANCE AMENDING CHAPTER 17 ST. CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG-RESIDENTIAL ORDINANCE NO. L 4 ' (a 66 -I WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of RICHARD AND PHILIPPINE BEER on December 17, 2003, in the St. Croix County Government Center in Hudson, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: See attached description (219.14 acres from Agriculture to Ag- Residential) Based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. Site consists of farm fields, farm structure and some woods. 3. All but 40 acres of the site is environmental corridor. 4. The environmental features include: 12 -20 percent slopes, proximity to the Willow River and Willow River State Park, woods and some shorelands and one closed depression. The Willow River is approximately 500 feet from the southeastern side of the site. 5. There are no limitations for Private Onsite Wastewater Treatment Systems (POWTS). 6. Surrounding land uses include the Willow River State Park on the east, southeast and west, large acreages to the west and north and small acreage homesites to the northwest and southwest. 7. Surrounding zoning is ag residential to the north, northeast and southwest and conservancy to the west, southeast and east. 8. The site is accessed by three county roads, I to the south, A to the east and E which splits the northern portion of the site. The northern 40 acres of the site also has access to a town road, Bass Lake road. 9. For the present time, the proposed use is approximately three three -acre home sites. Retirement planning is the stated reason for rezoning. 10. Potential development is approximately 72 three -acre lots. 11. The St. Croix County Natural Resource Management Plan Goals II, III and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats; and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. 12. The Town of St. Joseph has recommended approval of the rezoning, and has considered §91.77 in making their recommendation. 13. The Ag Residential zoning designation for 220.76 acres is consistent with the Town of St. Joseph Comprehensive Plan, dated 1995, amended 2003. 14. The Town motion states that the rezoning does not have an impact on woodlands or environmental features because no change in use or development is proposed at this time. The Town further states that the property is suitable for potential development in the future and potential development would not cause negative impacts to environmental features or areas. The motion further states that any impacts to environmental areas would be addressed through the town subdivision ordinance. 15. The Town also states that they have, or intend to provide, adequate public facilities to accommodate any potential development of the property. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 219.14 -acre parcel in the Town of St. Joseph is now rezoned from Agriculture to Ag- Residential.
