CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG- RESIDENTIAL ORDINANCE NO. !0(0G2 ( d-) -2, WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning and Zoning Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on the rezoning request of JOHN AND GEORGINE SCHOTTLER on August 25, 2004, in the St. Croix Government Center in Hudson, Wisconsin; and WHEREAS, the St. Croix County Planning and Zoning Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: SEE ATTACHED FOR LEGAL DESCRIPTION (174 +/- ACRES) Based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. Less than 1/4 of the site is prime farmland. 3. There are a few severe limitations for Private Onsite Wastewater Treatment Systems (POWTS) on the site. 4. Surrounding land uses include a major subdivision to the north and northeast, farmland to the east, west and south and U.S. Fish and Wildlife land to the west. 5. Surrounding zoning is ag residential to the north, east, south and southwest and conservancy to the northwest. 6. The site has access to a town road to the south. 7. Proposed use is a one -lot split for a family member with gradual development of additional lots. 8. If rezoned, the owners should be encouraged to incorporate the environmental elements into any type of development. 9. As the owners consider design elements they should be encouraged to: protect the closed depressions and wetlands; use best management practices, erosion and sediment control and stormwater management for the steep slopes; and protect the prairie remnant. 10. Town of Somerset has recommended approval of the rezoning and states that the rezoning does comply with Wisconsin Statutes Chapter 91 and the Town Comprehensive Plan that it meets all five criteria of the plan. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 174 -acre parcel in the Town of Somerset is now rezoned from Agriculture to Ag- Residential.
