ORDINANCE AMENDING CHAPTER 17 ST. CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AG-RESIDENTIAL TO COMMERCIAL ORDINANCE NO. LP L 1 ( c04 WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning and Zoning Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on the rezoning request of EDWARD SAMPAIR on November 3, 2004, in the St. Croix County Government Center in Hudson, Wisconsin; and WHEREAS, the St. Croix County Planning and Zoning Committee having considered all written information and verbal testimony presented at the hearing, voted to approve a rezoning of the following described land: 5 -acres in the SE 1/2 of the SE1/4, Section 26, T31N -R19W, Town of Somerset. (See attached) Based on the following findings: 1. The site has an existing office ans shop buiding and a house. 2. The site is part of a larger parcel of approximately 99 acres. An auto salvage operation, Somerset Auto Salvage, has been in business on the whole parcel for over 40 years. It is a non-conforming use. 3. None of the parcel is identified on the primary environmental corridor map. 4. None of the parcel is prime farmland. 5. None of the site has limiting soils for Private Onsite Wastewater Treatment(POWTS). 6. Site is located on the STH 35. There are two existing accesses. 7. Proposed use of the site is to demolish the existing house and construct a new shop building. Uses on the site would include auto repair, parts sales, and processing vehicles. 8. A site layout showing access is provided. 9. The application states that access to the site has been discussed with WisDOT. WisDOT is requiring that the southern driveway access be removed the owner has agreed to remove the southern driveway to the site. 10. The applicant has identified that a second access, on Dale Street through the Village of Somerset, is available to access the remaining property which will still be zoned ag residential. 11. If approved, site design should buffer the existing and proposed commercial uses from the neighboring residential uses. 12. Town of Somerset has recommended approval of the rezoning and states that the rezoning does comply with Wisconsin Statutes Chapter 91 and the Town Comprehensive Plan. 13. The Somerset Town Plan uses Five guidelines to delineate where preferred development areas shall be located. Based on the criteria in the plan, this rezoning is consistent with four of the five guidelines in the Town Plan. With the following condition: 1. The rezoning will not take effect until the applicant obtains an approved special exception permit for a junk and salvage yard on the remaining property zoned ag residential. This would bring the whole site into conformance with the zoning ordinance and would remove the nonconforming status. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 5 -acre parcel in the Town of Somerset is now rezoned from Ag- Residential to Commercial.
