ORDINANCE AMENDING CHAPTER 17 ST. CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG- RESIDENTIAL ORDINANCE NO. (..vZ.i ' Gaooy WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning and Zoning Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on the rezoning request of VALLEY LAND CO./ GARY VALLEY on November 3, 2004, in the St. Croix County Government Center in Hudson, Wisconsin; and WHEREAS, the St. Croix County Planning and Zoning Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: 266.5 +/- acres in the NE 1 /4 and the SE 1/4, Section 17, T28N -R19W, Town of Troy. (See attached) Based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. Access to the site is from town roads, East Cove Road, Towns valley Road, Whitetail Lane, Crocus Hill Road and possibly several connecting roadways in new subdivisions. 3. Proposed us is 123 one -acre lots and one farmette lot under the Town of Troy Subdivision Ordinance — approximately 61 lots under the 40/60 farm plan and approximately 62 lots from the Transfer of Development Rights. 4. The applicant is clustering the development and preserving open space through 14 outlots with conservation easements and will be transferring development rights from another site in the Town of Troy. 5. Town of Troy has reviewed the rezoning and recommends approval and has considered §91.77 in making their recommendation. 6. If approved, the site design configuration of both roads and lots should avoid disturbance of 20 percent and greater slopes, the intermittent stream and the close depression. 7. The proposed subdivision would improve the alignment of the existing Cove Road.
