ORDINANCE AMENDING CHAPTER 17
ST. CROIX COUNTY LAND USE ORDINANCE
REZONING LAND FROM AGRICULTURE TO AG- RESIDENTIAL
ORDINANCE NO. ( (n (acog)
WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development
Committee to act in all matters pertaining to county planning and zoning; and
WHEREAS, the St. Croix County Board has established the St. Croix County Planning and
Zoning Committee; and
WHEREAS, at the request of the County Board this Committee is to review petitions, hold
public hearings, and present its recommendations for rezoning requests to the County Board for
action; and
WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on
the rezoning request of CHRIS AND DIANNA KUSILEK on November 3, 2004, in the St. Croix
County Government Center in Hudson, Wisconsin; and
WHEREAS, the St. Croix County Planning and Zoning Committee having considered all
written information and verbal testimony presented at the hearing, and finding that the request
meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following
described land:
86.4 +/- acres in the S 1/2 of Section 33, T28N -R19W, Town of Troy. (See attached)
Based on the following findings:
1. The parcel is in the rural planning area and is an appropriate use.
2. None of the site is environmental corridor.
3. Site accesses County Road M. In March of 2004, the applicants received approval from the
Board of Adjustment to disturb 20 Percent and greater slopes to improve the driveway access
for farm machinery.
4. Proposed development is three 3 -acre lots and one larger farmette lot as allowed under the
Town of Troy subdivision ordinance. However, the applicant would have the right to further
subdivide under the Town's Transfer of Development Rights in the future.
5. Town of Troy has reviewed the rezoning and recommends approval and has considered
§91.77 in making their recommendation.
6. The applicant, by conservation easement, is surrendering the right to develop more than four
lots.
With the following condition:
1. The County will have an easement right to disapprove any change of lot boundaries in the
future.
THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting
in regular session, that the 86.4 -acre parcel in the Town of Troy is now rezoned from Agriculture to
Ag- Residential.

said East -West Quarter line S89 °50'43 "E a distance of 1985.95 feet to the northeast corner of said NE1 /4
of SW1 /4; thence along the North -South Quarter line of said Section 33 S00 °11'53 "W a distance of
1731.75 feet; thence S54 °22'53 "W a distance of 552.27 feet; thence SO4 °53'07 "E a distance of 83.99
